LEGAL NOTICE
NOTICE IS HEREBY GIVEN that sealed proposals will be received by the City of Anaheim at the office of the City Clerk up to the hour of 2:00 o'clock P.M. on the 4th day of August, 1960, and will be opened on said date at the hour of 2:00 o'clock P.M., in public, in the City Council Chambers in the City Hall, in the City of Anaheim, State of California, by the City Clerk and the City Engineer for furnishing files in the office of the City Engineer or City Clerk of the City of Anaheim, the following public improvement, to wit: The Orangewood Avenue Street Improvement, consisting of grading and paying Orangewood Avenue, from Placentia Avenue to the Santa Ana Freeway, in the City of Anaheim, including all appurtenant work as more particularly set forth in the plans and specifications on the Office of the City Clerk or City Engineer Job No. 517, and shall be tabulated by the City Engineer and the result thereof reported to the City Council at its next regular or adjourned regular meeting, for action thereon by said City Council.
PURSUANT to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim has appointed a local planning rate of wages in the locality in which this type of work is to be performed multiplied by eight. Eight hours shall constitute a day's work, it being understood that in that work men are employed less than eight hours per day the per diem wage shall be that fraction of the per diem wage herein established that the number of hours of employment bears to eight hours.
The overtime rule establishing the rate of overtime and holiday wage shall be in accordance with the following: Where a single shift is worked, eight hours of continuous employment, except for lunch periods, shall constitute a day's work beginning on Monday and continuing through Friday each week. Where work is required in excess of eight hours in any day or until midnight of time from 5:00 o'clock P.M. Friday and 12:00 o'clock midnight Saturday, such work shall be paid for at the minimum rate of one and one-half times the basic rate of wages, and on Sundays and holidays such work shall be paid for at the minimum rate of double the basic rate of wages, except as otherwise provided on September 1959 revision of the A.G.C. B.C.A.H.B.E.G.C.A.A., A.F.L.C.L.O., Southern California Master Labor Agreement.
Holidays as herein referred to shall be deemed to be New Year's Day, Decoration Day, Independence Day, Labor Day, Veterans Day, Thanksgiving Day and Christmas Day. If labor mentioned other than Labor Thanksgiving Day falls on Sunday, the following Monday shall be considered a legal holiday.
It shall be mandatory upon the contractor to whom the contract is awarded and upon any subcontractor under him to pay not less than the total cost of wages to all laborers, workers and mechanics employed by them in the execution of the contract.
Each bid shall be made out on a form to be obtained at the office of the City Clerk or the City Engineer of the City of Anaheim and shall be accompanied by a certified or cashier's check or bid bond for ten (10) paid amount to the bid, made payable to the City of Anaheim, and shall be sealed and delivered to the City Clerk at the City Hall of the City of Anaheim before 2:00 o'clock P.M. on the 4th day of August, 1960, at which time sealed proposals will be opened in public by the City Clerk and the City Engineer. Apprentices may be employed in conjunction with Section 1777.5 of the California Labor Code.
The rates of per diem wages for each of the various classifications of work shall be the hereinbefore set forth prevailing rates of hourly wages.
Each bid shall be made out on a form to be obtained at the office of the City Clerk or the City Engineer of the City of Anaheim and shall be required by a subcontractor who will perform work or labor or render services to the contractor in or about the construction of the work or improvement and the portion of the work which will be done by each subcontractor. A subcontractor should specify a contractor submitting such bid agrees to perform the work himself.
The successful bidder will be required to furnish a faithful performance bond in an amount equal to 100% of the contract price and a labor and an amount equal to 100% of the contract price and a bond to be secured from a surety or bond company satisfactory to the City Council of the City of Anaheim and shall be approved by the City Attorney as to form and sufficiency before acceptance.
Plans and specifications may be obtained from the City Engineer or the City Clerk of the City of Anaheim at the City Hall, Anaheim, California for the sum held by $60,000 if picked up at said offices, or the sum of Six Dollars ($6.00) if forwarded by mail.
The successful bidder will be required to continuously maintain adequate protection of all his work and adjacent property from damage arising out of the performance of the contract and to furnish the City with public liability insurance in an amount not less than $200,000 for injuries including accidental death of any one person, $80,000.00 on account of any one accident, and property damage insurance in an amount not less than $50,000.00 and public liability insurance to cover vehicles used by him whether on or off the premises in an amount of $50,000.00 for injuries to any one person or $100,000.00 for any one accident and property damage in an amount of $10,000.00 Compensation and employer's liability insurance shall be maintained during the life of the contract covering all employees on the project. The contractor shall be responsible that all employees of subcontractors are protected by such insurance. Such insurance may be provided by companies satisfactory to the City and attorney as to form and sufficiency.
The successful bidder and any subcontractor and contractor employed by him in the performance of said work or any part of the work of said public improvement will be required to have such manufactures materials and supplies as have been mined or produced in the United States, and only such manufactured
