Early Florida Citrus Shipping Forces Shift to California Fruit
A queer twist of the reverse economies has placed a relatively light crop of Florida valencia oranges in the position of making somewhat dubious citrus history.
The bizarre chain of events began around the first of March when shipments of early and mid-season oranges dwindled to practically nothing. Florida had depleted these varieties almost a month earlier than usual.
Many shippers, figuring to get a head start on the fresh valencia market, began shipments of that variety in volume a full month before the oranges were actually fully mature and ready to eat. The fruit was unusually tart, gave no consumer satisfaction, and resulted in extreme unfavorable trade reaction. Housewives, in many instances, turned to California oranges and competitive fruits.
Prices were what was expected under the circumstances. Up to the middle of last week, small sized valencias had leveled to $3 per box f.o.b. while the larger fruit sold for $2.75.
About this time large retail stores in the north, despairing of Florida orange movement, started featuring the larger sizes in store-wide promotions and a scramble ensued. The result was a surplus of prized smaller sizes and a shortage of the normally unwanted larger. Such reverse economics brought a furrow of amazement to the faces of industry sales managers.
"Believe me, we're going to take full advantage of the situation and raise the ante on larger sides and attempt to level the price at $3 straight across the board," prophetized Fred S. Johnston, general sales manager of the Florida Citrus exchange which handles almost a third of the fresh fruit crop. "Greater demand for the larger sizes which has resulted from store promotions makes this almost a certainty."
The present season, many believe, may wind up as an "average" one pricewise.

New Law Would Decide Damage Suits Comparative Responsibility Basis
By GEORGE E. HART
Legal circles of Orange county are interested in a bill pending bethe state legislature that would make a radical change in the appach to damage suits. The bill proposes to decide personal injury
suits on the basis of comparative responsibility.
Insurance companies are even more interested than the lawyers,
from an exactly opposite standpoint. They usually have to pay
judgments which the lawyers
for their clients.
That reason, perhaps, the foo, should be interested,
se more damage judgments higher insurance rates on family car.
More Judgments
pending bill presumably would mean more damage judgments, which explains why the attorneys like it and the insurance companies do not.
Under existing statutes, no person who is even slightly responsible for the accident which injuried him, can collect damages from the other party, no matter how much more responsible the other might be for the injury. The doctrine of contributory negligence is a bar to any such recovery of damages.
The pending bill, backed by the lawyers, would substitute the doctrine of comparative negligence for contributory negligence. Damage judgments could be granted in cases where both parties were negligent, the award being decided on the basis of comparative degree of negligence.
Insurance Co.'s Opposed
Observing the prospect of more damage judgments to pay, the insurance companies are said to be leveling on the bill with all their might.
The attorneys argue, as an example, that it is not right that an accident victim, hit by drunk driver, cannot get damages, even though the drunk driver was 90 per cent responsible for the injury while the victim was only 10 per cent responsible. Under existing

Under existing law, the drunk driver gets off scott free, as far as civil liability is concerned, though liable for criminal prosecution of a felony charge.
While the bar as a group supports the proposed legislation, there must be some within it who side with the insurance companies. That's because they are hired by the insurance companies to defend damage suits, and the doctrine of contributory negligence is a powerful weapon to their hand. They are not anxious to change the status quo, at least as long as they are on the defense side. Of course, the insurance company attorneys of today may be the plaintiff's counsel next year.
Deadly Maneuvering
The legal maneuvering that instantly follows any injury accident is perhaps the most deadly of any type of litigation. That is entirely aside from ambulance chasing. The swift moves and counter moves that swirl about the untutored head of the accident victim, before he has even had time to think about going to court, not only would amaze the layman, but often determine how he would fare in court when he does get around to thinking of such a move.
There are tricks in all trades, but the business of prosecuting and defending injury damage suits has a whole bagfull.
