ORDINANCE NO. 479 AN ORDINANCE PROVIDING REGULATIONS FOR THE SUBDIVISION OF LAND IN THE UNINCORPORATED AREA OF ORANGE COUNTY, CALIFORNIA, AND FOR THE PREPARATION AND PRESENTATION OF SUBDIVISION MAPS THEREOF; AND REPEALING ORDINANCE NO. 296. In order to promote the: (a) Public health, safety and general welfare. (b) Ordinance growth and development of the County. (c) Proper use of land. (d) Conservation, stabilization and protection of the value of property. (e) Adequate provision for necessary utilities and conveniences, the Board of Supervisors of the County of Orange, State of California, do ordain as follows: SECTION 1. AUTHORITY. Pursuant to the State of California "Subdivision Map Act", the provisions of this Ordinance are supplemental to those of said Act and shall apply to all subdivisions hereafter made, of land entirely or partially within the unincorporated territory of Orange County, California; and all terms used herein which are defined in the "Subdivision Map Act" shall have the same meaning as ascribed thereto in the Act, and as the Act may thereafter be amended. The Orange County Planning Commission is hereby designated as the "Advisory Agency" referred to in the "Subdivision Map Act" and is charged with the duty of making investigations and reports on the design and improvement of proposed subdivisions; and is hereby authorized to approve, conditionally approve or disapprove tentative maps of subdivisions prepared and filed according to this Ordinance and the "Subdivision Map Act", to recommend the kinds, nature and extent of the improvements required to be installed in subdivisions, and to report direct to the subdivider the action taken on tentative maps. SECTION 2. STANDARDS OF DESIGN. The following shall be the standards of design except in those cases where the Orange County Planning Commission determines that the size or shape of the land, topographical conditions or proposed land use make compliance therewith impractical. STREETS C. No lot shall be divided by a city or county boundary line. D. Side lines of lots shall be approximately normal to the street line. E. When large lots are proposed, the shape, building locations and building lines may be required to be so established as to make it practical to resubdivide the lots into building sites approximately 60 feet wide by 120 feet deep without injury to adjoining lots. Cross sections of proposed street improvements. 15. Width of alleys. 16. Width of easements. 17. Dimensions of reservations. 18. Existing structures. 19. Location of existing and proposed public utilities. 20. Existing sewers. 21. Elevation of sewers at proposed connections. 22. Existing water mains. 23. Existing culverts and drain pipes. 24. Water courses. 25. Land subject to overflow, inundation or flood hazard. 26. Railroads. 27. Lot lines and approximate dimensions. 28. Approximate radius of curves. 29. Setback lines. 30. Lands and parks to be dedicated for public use. 31. Contours at 5 foot intervals if slope greater than 10 percent. 32. Contours at 2 foot intervals if slope less than 10 percent. 33. Proposed land use: a. Single-family. b. Multi-family. c. Business. d. Industrial. 34. Name of adjoining subdivisions. 35. Existing use of property immediately surrounding the tract. 36. Land registered. B. PROCEDURE— 1. After noting the above, the subdivider should confer with the staff of the Planning Commission before preparing the tentative map of the proposed subdivision. 2. Prior to filling of a tentative map, a number shall be obtained from the County Surveyor upon deposit with him of $5,000, the final map recording fee. If the subdivision map is withdrawn prior to recordation, the fee will be returned. 3. The tentative map shall be prepared in accordance with the "Subdivision Map Act" and the provisions of this Ordinance, and shall be filed B. PREPARATION— After approval of a tentative map by the Orange County Planning Commission, "the subdivider may cause a final map to be prepared in accordance with a completed survey of the subdivision and in substantial compliance with the approved tentative map, and in full compliance with the "Subdivision Map Act" and this Ordinance. 1. SIZES AND MATERIALS—The final map shall be clearly and legally delineated upon tracing cloth or good quality. All lines, letters, figures, certificates, acknowledgments and signatures shall be made in black waterproof india ink, except that affidavits, certificates and acknowledgments may be legibly stamped or printed upon the flap with black opaque ink.The size of each sheet shall be 18 by 26 inches.A marginal line shall be drawn completely around each sheet, leaving an entirely blank margin of one inch.The scale of the map shall be large enough to show all details clearly and enough sheet shall be used to accomplish this end.Each sheet shall be numbered,the relation of one sheet to another clearly shown,and the number of sheets used shall be set forth on each sheet.The tract number, scale, north point and sheet number shall be shown on each sheet of the final map. 2. TITLE SHEETS — Below the title shall be a sub-title consisting of a general description of all the property being subdivided, by reference to deeds, subdivisions or to sectional surveys.References to tracts and subdivisions shall be spelled out and worded identically with original records, with complete reference, proper book and page of the record.The title sheet shall show in addition the basis of bearings.Maps filed for the purpose of reverting subdivided land to acreage shall be conspicuously marked under the title"The Purpose of this Map is a Reversion to Acreage." 3. CERTIFICATES — Forms for certificates required by the "Subdivision Map Act" and this Ordinance may be secured from the County surveyor. 4. SURVEYING DATA FOR LOTS—Sufficient data shall be shown to determine readily the bearing and length of each line.Dimensions of lots shall be the net dimensions.Neito marks shall be used.Lots containing one acre or more shall show net acreage to nearest hundredth. 5. SURVEYING DATA—The final map shall show the center lines of all streets, length, tangent, radius and central angle or radial bearingsof all curves;and the bearing or radial lines to each lot corner ofar curve,the total width of each streetthe width of the portion being dedicatedand the width of existing dedication,and the width each side ofar center line,也如width rights of way of railroads,flood control or drainage channels and any other easements appearing onthe map.Surveys in connection withthe preparation of subdivision mapsassin in this Ordinance provided shallbe made in accordance with standard practices and principles for land surveying.A traverse of the boundariesof the subdivision and all lots andblocks shall close within a limitof error of 1 foot in 10,000 feet per meter. 5. STREETS A. The subdivision plan shall conform to the official or master plans of highways. B. The street system in the proposed subdivision shall relate to the existing streets in the area adjoining the subdivision. All existing local streets adjacent to the subdivision need not be carried into the new subdivision. C. Half-width streets shall not be permitted. D. Along major highways, a service roadway separated from the major highway by a 25 foot planting strip will be required for access to private property and local streets. E. Minimum widths for major highway, service road and planting strips shall be: Center planting strip...20 feet Roadway (2)...36 feet Planting Strip (2)...20 feet Service road (2)...32 feet Parkway (2)...5 feet Sidewalk (2)...5 feet F. General local street rights of way shall be not less than 60 feet wide. G. Short, local street rights of way shall be not less than 50 feet wide. H. Steep hillside, local street rights of way shall be not less than 40 feet wide. I. Design of local streets where railroads, parkways, grade separations, freeways or hillside territory is involved shall receive special attention. J. Dead-end streets shall be terminated by a turn-around not less than 100 feet in diameter separated to the depth of one lot from the exterior boundary line or other topographical features of the subdivision. K. Street grades between 6 percent and 10 percent will be approved only for such distances as topographical conditions make a lesser grade impractical. A grade exceeding 10 percent will be approved only when conclusive evidence shows that a lesser grade is impractical. L. Curved streets in comparatively level locations shall have a center-line radius of 500 feet or greater and 300 feet or greater in steep hillside locations. EXISTING USE OF PROPERTY IMMEDIATELY SURROUNDING THE FRACT. 36. Land registered. B. PROCEDURE— 1. After noting the above, the subdivider should confer with the staff of the Planning Commission before preparing the tentative map of the proposed subdivision. 2. Such filling should be prior to the completion of final surveys of streets and lots and before the start of any grading or construction work within the proposed subdivision. 4. The subdivider shall ascertain of the Orange County Planning Commission the number of required copies of the tentative map. 5. The tentative map shall be accompanied by reports and written statements from the subdivider giving essential information regarding the following matters: a. Subdivision development plan. b. Source, quality and an estimate of available quantity of domestic water supply. c. Type of street improvements and utilities which the subdivider proposes to install. d. Proposed method of sewage disposal. e. Proposed storm water sewer (grade and size). f. Protective covenants to be recorded. g. Proposed tree planting. h. Upon filling with the Orange County Planning Commission the required number of copies of the tentative map, one copy thereof shall be immediately forwarded to each of the following: County Superintendent of Highways, County Surveyor, Orange County Flood Control Engineer, County Health Officer, and any municipal entitled thereto; and if a State Highway is involved, two copies of the map shall be forwarded to the District Engineer of the Division of Highways, Department of Public Works of the State of California. The Orange County Planning Commission shall cause to be certified upon its official filed copy of the tentative map, a statement as to the above transmittals giving the date in each case. 7. Within 20 days after each County officer or department has received a copy of the tentative map, the officer or department shall make a report in writing to the Planning Commission as to any A memorandum in duplicate showing: a. The total area of the subdivision. b. The total area in streets. c. The total area in lots. d. The area in parks, school sites, or other lands offered for dedication or reserved for future public or quasi-public use. The fee for examining a final map shall be $5.00, provided that where a large amount of checking is required and/or field surveys are necessary to check the accuracy of the data shown on the final map, an additional fee estimated by the County Surveyor to be sufficient to cover the actual cost shall be deposited with him. Provided, further, that any balance shall be returned to the subdivider, or in case the fee is not sufficient, the subdivider shall pay the difference between the estimated and actual cost of examination. After issuance of a receipt for the final map, the County Surveyor shall examine it as to sufficiency of affidavits and acknowledgments, correctness of surveying data, mathematical data and computations and such other matters as require checking to insure compliance with the provisions of the "Subdivision Map Act" and of this Ordinance. If the final map is found to be in correct form and the matters shown thereon are sufficient, the County Surveyor shall endorse his approval thereseon and transmit it to the Board of Supervisors together with plans and specifications of proposed improvements and such other matters as are required to enable the Board of Supervisors to consider the final map, or return the final map to the subdivider together with a statement setting forth the grounds for its return. All improvements shall be installed to grades approved by the County Road Department. Plans, profiles and specifications of proposed street improvements shall be furnished to the County Road Department prior to the time of submitting the final map to the County Surveyor, and be approved by the County Road Department before the map shall be filed with the Board of Supervisors. These plans and profiles shall show full details of the proposed improvements which shall be according to the standards of the County of Orange. If street lights, water mains, sanitary sewers, or storm drains are to be installed as a part of the improvements of the subdivision, plans, profiles, specifications and all necessary details of the proposed construction shall be submitted to the County Surveyor prior to the time of submitting the final map for checking, and be approved by him before the final map shall be filed with the Board of Supervisors. These plans and profiles shall show full details of the proposed improvements which shall be according to the standards of the County of Orange. If such improvement work is not completed satisfactorily before the final map is approved, the owner or owners of the subdivision shall immediately upon approval of the final map, enter as contractor into an agreement with the Board of Supervisors whereby, in consideration of the acceptance by the Board of Supervisors of the streets and easements offered for dedication, the contractor agrees to furnish the equipment and material necessary and to complete the work within the time specified in the agreement. To assure the county that this work will be completed, a bond shall be furnished guaranteeing the faithful performance of the work in the sum equal to the estimated cost. This bond may be furnished by a qualified surety company, except in cases where a cash deposit is required by the Board of Supervisors. E. Mother of Mrs. Travis Cushman Passes Away Mrs. Travis Cushman of South Palm street received after gram last Friday that carried sad news that her aged mother Mrs. Mary Kampling of Gar Plains, Kansasas had passed away Mr. and Mrs. Cushman left following day for the midwest state to attend the funeral. Mrs. Cushman visited her mother Mrs. R.W.Royce of 221 W Broadway street Wednesday evening of last week but appeared nothing was stolen. When Mrs. Royce returned her home at 9:30 in every she found a window open as well as back door. She immediately notified the police department who investigated. IMPROVEMENTS REQUIRED—The minimum improvements which the subdivider will be required to make or enter into an agreement to make in the subdivision, prior to the acceptance and approval of the final map by the Board of Supervisors, shall be: 1. Adequate distribution lines for domestic water supply to each lot where the subdivision is to be supplied with water. 2. Sewage disposal system where main lines are available or private disposal plant advisable. 3. Adequate drainage of the subdivision, streets, highways, ways and alleys. 4. Adequate grading and surfacing of streets, highways, ways and alleys. 5. Curbs and gutters. SECTION 5. VALIDITY. If any section, sub-section, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the Ordinance. The Board of Supervisors of Orange County hereby declares that it would have passed each section, sub-section, sentence, clause and phrase of this Ordinance irrespective of the fact that one or more sections, sub-sections, sentence, clauses or phrases hereof be declared invalid or unconstitutional. SECTION 6. REPEAL OF CONFLICTING ORDINANCES. Ordnance No. 296 is hereby repealed. SECTION 7. ADOPTION. This Ordinance shall take effect and be in force at the expiration of thirty days from and after its passage, and before the expiration of fifteen days the same shall be published with the names of the members voting for and against the same, for at least one week in the Anaheim Gazette, a newspaper of general circulation published in the County of Orange, State of California, together with the names of the members of the Board of Supervisors voting for and against the same. MISSIONARIES TO TELL OF PAST EIGHT YEARS IN CHINA "Thrilling, inspiring, educational, worth going miles to hear" is the comment made by James B. Abbott, minister of the Free Methodist church, regarding the addresses to be given Sunday morning and evening at the church by Rev. and Mrs. Ashcraft, missionaries to China for the past 29 years. They will tell the story of their strenuous past eight years that included such experiences as living in bombed areas, carrying for refugees, preaching and teaching; their long trip back to the states and the welcome that they received upon their safe arrival. Rev. and Mrs. Ashcraft will sing in the Chinese language at both services and Paul Beatty will direct the congregational singing. The hour of services is 11 a.m. and 7:30 p.m. The church is located at the corner of Broadway and Clementine streets. Mrs. Ashcraft is the sister-in-law of Mrs. Cora P. Coyner of South Kroeger street and while in Anaheim she and her husband are enjoying Mrs. Coyner's hospitality. Services Held For E. X. Williard Last rites were held Monday afternoon at Backs, Campbell and Kaulbars for E. X. Williard, 89, who passed away last Thursday at his ranch home at Dale and Katella roads, after having resided there for the past 28 years. Born in Shermantown, Nev., he Episcopal Bishop To Hold Service at Santa Ana Church Rt. Rev. W. Bertrand Stevens, Episcopal Bishop of Los Angeles, will conduct the service at the First Methodist church in Santa Ana next Sunday evening, August 28, at 7:30 o'clock. Rev. Stevens is bishop for the southern area of the Episcopalian churches and will have an interesting message to bring to his audience. Members of St. Michael's Episcopal church are especially urged to attend this service, as well as members of other denominations who are interested in hearing an interesting speaker. Young people of St. Michael's church who need transportation are asked to meet at the church at 6:45 and a way will be provided for them. Death Claims Santa Ana Canyon Resident Mass was said at the Holy Family church in Orange Tuesday morning for John B. Cooper who passed away at his Santa Ana canyon home last Friday at the age of 88. There was a recitation of the Holy Rosary Monday evening at Backs, Campbell and Kaulbars' chapel. Interment was made in the Holy Sepulcher cemetery. The deceased was born in Puente but as an infant was brought by his parents to Santa Ana canyon where he lived throughout his lifetime. He is survived by one daughter, Mrs. Vera Ament of Los Angeles; one brother, Ramon Cooper of Santa Ana canyon, and one niece, Mrs. Phillip Yorba of the Services Held For E. X.
