CITY BOARD STANDS PAT Fuhrberg's Liquor License Remains Revoked, and Marshal Says Two Other Saloons will Get Their's, If they Don't Watch Out—Hahn Contests Election The meeting of the city council on Thursday evening was one of the most interesting of the year. A large delegation of representative citizens, including the clergy, were present as spectators, but there was no speechifying. The people were doubtless attracted to the meeting by the fact that the new liquor and Sunday-closing ordinance was up for first reading, and wanted to hear its contents. The additional fact that Andy Fuhrberg was to apply for a reconsideration of the revocation of his saloon license was also another cause for bringing out the crowd. Attorney Spencer, representing Fuhrberg, addressed the board in reference to the revoked license and asked that the action of the council revoking same be cancelled and that Mr. Fuhrberg be given another chance, for three months at most, as he intended anyway to sell out and quit the business. He characterized the action of the board in revoking the license, before giving the accused a hearing, as a sort of confiscation of his business. He maintained Mr. Fuhrberg was a law-abiding citizen. Mr. Fuhrberg also addressed the board along similar lines, and further entered denial to the charges preferred against him by Marshal Steadman at the last board meeting. Trustee Rust was in favor of giving Fuhrberg another chance. Trustee Gates spoke upon the matter and wanted to grant Fuhrberg a thirty-day respite, in which to dispose of his business, but "not to try to peddle his licence." Gates said emphatically any saloon keeper caught trying to barter his license for an excess value should have the same revoked forthwith. Marshal Steadman arose to address the board and the spectators eagerly leaned forward to listen, for the meeting was growing in interest. Steadman spoke earnestly and said he stood ready to substantiate all he had said about Furhberg. He made damaging statements against Fuhrberg as a saloon keeper. He said he lost three saloon licenses in Los Angeles before coming here. Steadman averred Fuhrberg was not entitled "to 15 minutes more time" to close out his business than that already granted to him. Among other things, he accused Fuhrberg "of taking twenty dollars from Viet Bentz" when the latter was once in the saloon. He advised the board to take no action and leave the license stand revoked. Marshal Steadman averred in passing "that two other saloons will get their's, too, if they do not watch out." Total... Two cars crude oil used, cost Hon. He was backed up by Trustee Stock, and Fuhrberg will quit the saloon business here June first. The Marshal reported the following collections: Water $638.60, license $563, light $669.90; total $1,871.50. Delinquents collected: Water $69.25, license $9, light $65.25; total $143.50. Delinquents reported: Water $76.80, license $8, light $71.75; total $156.55. The Recorder reported two cases in his court during the month and fines collected amounting to $59. The Treasurer reported a balance of $12,814.10 in the general fund on May 13th. A communication from Attorney Daniel of Santa Ana, in the interests of John Hahn of this city, was read protesting against the election of Frank Gates, as trustee, and asking for a recount. Gates defeated Hahn in the recent city election by one vote. The petition alleged votes counted for the former should by rights have gone to petitioner. The petition was filled and no further action taken in the matter. The contest will come up later before Judge West in the superior court. Samuel Kraemer asked for 1½ inch water connection for his new brick building on Center street. Granted. Matter of deed from Mrs. Rothaermel was referred to engineer for report. The board decided to sidewalk South Los Angeles street, from the railway depot. The city attorney was instructed to prepare the resolutions of intention for same. The bandstand was ordered moved from the Strodthoff lot to corner of Center and Lemon streets, on the Home telephone company's lot. The city band will give concerts therefrom Saturday evenings. The stand is not to be used for any political or religious gatherings. Gillett last fall were not holidays at all, as the legislative act creating them was class legislation and consequently void. The decision was rendered on the petition of M. H. Depenbrook for a writ of prohibition to determine the validity of Section 135 of the Code of Civil Procedure, as amended November 27, 1907, when the special holiday legislation was enacted. The original section declared the superior courts of the state should always be open (legal holidays and non-judicial holidays excepted), but injunctions and writs of prohibition could be issued and served on legal holidays and non-judicial holidays. By the amendment to the original section, all court business except the enforcement of contracts involving the payment of money was permitted. The supreme court holds that the exception is clearly class legislation, as all debtors were protected from suit at the will of the governor, and no situation could be extraordinary enough to justify such a course. This decision of the supreme court makes all business of whatever nature carried on at that time perfectly legal, as the holidays had no existence in the eye of the law.
