A Tax in New Register Law
An attack of much political importance was made a few days ago in the Supreme Court on the new law which requires the voter when registering to declare his party affiliation.
This law was passed by the last Legislature. It provides that at the time of registering a voter or elector must state the name of the political party with which he intends to affiliate himself at the ensuing primary election.
If he so states he cannot change his affiliation after the close of the registration, but he must vote the party designated or not at all. In the city and county of San Francisco alone some 7000 or 8000 duly qualified electors declined to state their party affiliations at the time of registering within the present year and so by the terms of the new law they were disfranchised.

Shostad, a member of the Union Labor party and a native born citizen, declined to state his affiliations and later he went before the Board of Election Commissioners and demanded that they include his name among the voters entitled to vote at the ensuing primaries and issue instructions to the precinct boards of elections. This the Board of Election Commissioners refused to do.
Today, Shostad through his attorney, Samuel Shortridge, applied to the Supreme Court of the state for a writ of mandamus in which the validity or the constitutionality of the new law is drawn in question and will be decided. Shostad claims that the new law is unconstitutional in that it is unequal and discriminative in its operation on duly qualified electors; is not uniform in its operation; is unreasonable and restrictive of the right of free suffrage; that under the guise of regulating the Legislature has destroyed the inviolability of the secret ballot, the free and equal suffrage guaranteed by the Constitution. On the other side it is claimed that the Legislature under an amendment to the Constitution, has the power to prescribe tests for voting at primaries and that the provisions for the new law are nothing more than a test.

When the world recognizes truth as the basic principle for life's guidance, there will be no more subterfuge, no more pretense, no more excuse and explanation. The domino will cast his gown to the old clothes shop and throw his mask to the boys in the street. We will be as we ought to be. Out in the open!
Quite a large section of the press is trying to get up a states rights excitement over the railroad rate situation. Several of the states have passed railroad legislation, affecting the lines within their own borders and in some of the states the railroads have declined to recognize the new law, holding that railroad legislation is a federal function and that the individual states have made their mandatory rates so low as to amount to confiscation, which is, of course, contrary to the constitution.
The first state in which there has been an absolute clash of state and authority has been in North Carolina where Judge Long, the state has fined the railroad $30,000 for observance of the two cent factions and has sentenced two of the agents to work in the chain gang lieu of their paying a fine.
Prichard, of the federal court allowed a writ of habeas corpus leased the agents, declaring the law unconstitutional. On this day of authority the excitement is as least excuse for hysterics.
