WASHINGTON, Aug. 4 — Southern Pacific Railroad cannot be compelled to join in the pense of erecting and operating union terminal depot in Los Angeles on a site remote from its new passenger terminal, necessitating the abandonment and scraping of its existing facilities, in order that confessedly dangerous grade crossings may be eliminated under a particular plan advocated by the city of Los Angeles, it was contended in a brief filed with the Interstate Commerce Commission today.
It was also contended the Santa Fe and Salt Lake lines cannot be compelled to join in the expense of erecting the proposed terminal in order to eliminate grade crossings on Alameda-st., over which their lines are now operated.

FALLING ROCK
FATAL TO MINERS
NANTYGLO, Pa., Aug. 4—Two miners were crushed and 50 others narrowly escaped with their lives when a fall of rock in the Springfield mine here today covered the cars in which they were riding.
Four other miners were seriously injured in the accident. Mine officials gave the names of the dead men as Stephens Kourosky and John Kosh.
RECOVER FROM WATER POISONING
Members of at least one other Anaheim family were poisoned by the same water at Balboa Park isades which caused the serious illness of O.B. Weaver and family of South Bush, st, according to Mrs. Weaver. At least one Santa Ana family also was sickened by the water.
Weaver, who was worst, is recovering.
Mrs. Weaver today denied that the family had been warned against the water, which was in a tank exposed to mosquitoes, flies etc. They illness, she said, took the form of violent cramps.
