PAGE FOUR CALIF. TRADEMARK ACT IS EFFECTIVE The new California trademark act, which prohibits the misuse of lug boxes used in the fruit growing and canning industry is now effective. Canners assert that the misappropriation of these boxes, which cost from 30 cents to 40 cents each, has brought about losses of thousands of dollars every year. An investigator for the Canners League of California recently found a crew of Chinamen operating in a large basement in the San Francisco produce district, their method being to pick up canners' lug boxes wherever possible, plane off the names stenciled on the ends and sides and sell the boxes as new. All over the produce markets and in all the growing districts of the state for years lug boxes have been used for purposes other than intended, and many peddlers, junk dealers, etc., have made large, illegitimate profits thereby. Under the new law, owners of lug boxes can register with the county clerk the wording or design stencilled on the boxes, and publish notice of registration once each week for three weeks in a newspaper. Having given this formal notice to the public covering ownership of the boxes, the burden of proof rests on the possessor of the boxes as to his right to have them or use them for any purpose other than that permitted in writing by the owner. It is also unlawful for any person to deface such boxes or to remove the marks. A contract which passes between a fruit grower and a canner gives written permission to the grower to use the canner's box, but only for the handling of the canner's fruit from the orchard to the packing house. Under the act, according to the interpretation of leading attorneys, peace officers have the right, without special warrant, to arrest any person who has possession of these boxes without written permission of the owner in the same manner that peace officers can arrest a violator of the traffic laws or other criminal acts, without special warrant. Aside from a penalty of 50 cents per box for each box misappropriation, the law provides for prison terms for offenders who traffic in these boxes. In addition to lug boxes, the law also covers other containers used by manufacturers or producers in any line, provided paper registration is made. BEGIN SUGAR MAKING CAMPAIGN THIS WEEK The eleventh campaign at the big factory of the Holly Sugar Corp. at Huntington Beach will open Wednesday or Thursday, and is expected to continue until about the first of October. C. A. Johnson, general manager of the Holly sugar factories in the west, states that while the acreage about Huntington Beach is below normal the yield will be good, considering the climatic conditions. One man was arrested in connection with the investigation, but released when he proved that he knew nothing of the girl's whereabouts. Anaheim Has Calif. Brother of Anaheim Man Wins Trophy Frank M. Bungay, of the Liberty Garage, is a brother of Robert H. Bungay who yesterday was awarded the American Trapshooting Assn. trophy at the Vernon Gun club's third registered shoot. The shoot was at 100 targets in four events of 25 birds each. Overstreet, 79, of Beaumont, suffered injuries to his face and hands when a sedan in which he was riding with Melvin E. Blake and four women of Beaumont was hit by a stage two miles southwest of Santa Ana about 8 a.m. Sunday. 15 DAYS FOR VAGRANCY Ben Hix was declared a vagrant in the court of Judge Howard this morning, and was sentenced to 15 days in the county jail. P. W. Slayden was arraigned on the charge of having turned in the middle of the street, and was fined 45. PICTURES BY NOTED ARTISTS AT LAGUNA Featured by the work of some of the nicat noted painters in America, the annual exhibition of the Laguna Beach Art association has opened at the association art gallery, Laguna. The work of hanging the canvasses was completed this morning and when the doors opened, the gallery was jammed with an eager and admiring throng of art lovers. It was announced today that the "popularity contest," which proved such an attractive feature this year, will be repeated this summer. Each person entering the gallery is entitled to one vote as to which picture he thinks the best. This year's contest will close in three weeks. It was further announced that simultaneously the artists themselves, by means of a jury of three, would decide upon which pictures they consider the best. Lagunans are now interested as to whether the artists' view will coincide with that of the public. While visitors to the gallery will have but one choice each, the artists' jury will have three, it was stated. Hanson Puthuff is represented in the present showing two canvasses. Two pictures are being shown by Alexander Many, of Washington, D.C., who is one of the newcomers at Laguna, but regarded as among the best. Last year he won an award at the Corcoran galleries, Washington. There are about 60 canvasses in the exhibition. Mr. and Mrs. William Wendt, nationally prominent artists, at Laguna, are packing a large number of pictures for shipment to Chicago, where they will hold a two-day exhi­bition at the Art Institute in Sep­ten­ber. DIVORCE ACTION ON FILE The first divorce complaint filed under the new law making such suita­pen to the public was on file in the county clerk's office today. The action was brought by Miguel M. Moya against Candida R. Moya. S. M. Davis is attorney for the plaintiff. The couple were married in Pasadena May 15, 1912 and separated in August, 1919. There are no children. Moya is seeking a divorce on the ground of desertion. "Sham," a Paramount picture, starrring Ethel Clayton, will be seen again tonight at the Fairryland. There will also be a Pathe News and Monte Bando comedy. The "Sunny South Minstrels" will be seen at the Grand tonight with their own band. There are comedians and funny-joke men, black as old black Joe. His brothers maybe. BUENA PARK MAN PNEUMONIA VICTIM BUENA PARK, Aug 1—Harvey Fred Hartman died at his home on Grand-ave. Sunday afternoon of pneumonia. He was born in Toledo, Ohio, 39 years ago, and came to this community from Pasadena, 14 years ago. He leaves a widow and four chil­dren. Funeral services will be held from the chapel of Barks and Terry, N. Lemon-st., Anaholm, Tuesday at 10 a.m. Burial will be at Mountain View cemetery, Pasadena.
