LAW IN ACTION WILFUL, DELIBERATE AND PREMEDITATED The punishment for first degree murder is death or life in prison; for second degree, five years to life; for voluntary man-slaughter one to ten years. In each case there is killing on purpose but with a difference. 1. First degree is a killing with malice aforethought—a planned, wanton killing, such as by poison, lying in wait, or torture. Killing during other dangerous crimes such as robbery, burglary, arson, mayhem, or the like is first degree murder. 2. Second degree murder is any other killing with malice aforethought but lacking some element of first degree. For example, it may be "wilful and deliberate, but not premeditated." The jury may also find that it was not done during an otherwise dangerous crime, but during, say, a fight. Perhaps the killing may lack cruelty or viciousness, and hence, no "deliberation." In view of the killer's immaturity, intoxication, or state of mind, the jury may find the killing was not wilful. 3. Voluntary manslaughter is not a killing in self-defense which is "justifiable homicide," but a killing one does on purpose but provoked by the victim. Thus, no "malice aforethought." In his defense the accused may show the court that he was provoked enough so that the court might speak of the killing in "a sudden quarrel or heat of passion." Examples: An unprovoked attack by the victim; a quarrel that breaks out into violence. Yet the jury can find murder if there was malice aforethought, no matter how short the time to make it wilful, deliberate, and premeditated. The jury may find that the provocation was not enough to justify a reasonable man's action. The accused may be a hot-headed killer, that is, a murderer. Residents Warned Against Do It-Yourself Hypnosis Orange Countians are being warned against the apparent growing interest in hypnosis as a do-it-yourself art or as a form of entertainment. Dr. Thomas E. Hanigan, president of the Orange County Medical Association, says the public needs to understand that unhappy and sometimes tragic circumstances can result from the use of hypnosis by anyone other than qualified persons. The physician's warning follows a statement in which the Committee on Mental Health of California Medical Association (CMA) cited the improper use of hypnosis as a potential hazard to mental and physical health. "When used with patients who are carefully selected, and when properly administered by a physician or dentist who is qualified in its use, hypnosis can safely provide sedation, relief of anxiety or suppression of symptoms," Dr. Hanigan says. Last year 3723 persons were killed and 154,760 were injured in California highway accidents. Some of these deaths and injuries were attributable to poor visibility, road or weather conditions. Most were attributable to driver error—lapses in awareness or violations of the law. Schools Get U.S. Funds According to an announcement by Congressman James B. Utt (R-28th Dist.), Anaheim School District has been awarded the sum of $60,271 for school operating funds pursuant to Public Law 874. Schools which are heavily burdened by the impact of Federal installations in their area are eligible for financial assistance under this Public Law. The amount certified for payment is determined from the tentative entitlement for the fiscal year computed on the basis of information and estimates contained in the application. The total entitlement for the School District for fiscal year 1961 has been set at $80,361, of which the above amount has been certified for immediate payment. Additional payments will be subject to such adjustments as may be required by actual data and by the availability of funds in relation to total entitlements for financial assistance. Kuchel of California that it looks sympathetically on his suggestion of using motion pictures to help check the narcotics menace among younger people and to discourage use of habit-forming drugs. As part of his program to strengthen Federal participation in campaigns to stamp out the drug traffic, Kuchel recently urged the Office of Education to consider preparing films showing the likelihood of addiction for showing in schools and on television as means of warning juveniles against taking narcotics. Micromodular Appoints Engineer Gerald E. (Jerry) Hughes has joined the Micromodular Components Division of Ling-Temco Electronics, Inc., of Anaheim, as head of applications engineering. This division of Ling-Temco is engaged in the design, fabrication and testing of highly compact miniature circuit modules. Western Scores In Math Meet Fourteen Western High School students took part in a cent Math Meet held at Cerris College. The meet pro- led competition in problem solving, use of the slide rule, speeches involving mathematics, and mathematics games. Fine prizes were awarded to the winners in each category. In the senior division, Doug McMurtrie and Roh Tamura placed second in the "Leap Frog Relay," which was a difficult problem solving test. Skip Lane also took a second place in the "Chalk-T Petition."
