LAW IN ACTION
WINDING UP ONE'S ESTATE
Mankind took ages to figure out what to do with a dead man's things—his house and land, his wives, slaves, livestock and children. Who owned them? Him?
The tribe?
His eldest son? His widows?
Today our law sets out who gets the property if a man dies without a will: Without kinfolk, his property "escheats" to California.
Within wide limits, one can will his property to anyone he likes.
Our courts act to pay off one's lawful debts and to divide his property among his rightful heirs. To do this the court names an executor or administrator as the deceased's representative who winds up his affairs, pays off his debts, and sees that his heirs share the property as he set out in his will.
This representative first finds and takes over all of the decedent's property. He publishes a notice in a newspaper at once to creditors. The notice invites them to send in their claims. Otherwise the claim will be barred.
The representative then takes care of the claims under court order. He also runs the decedent's business until he can turn it over to the heirs.
As a rule, after six months or more, the representative has settled most of the decedent's affairs and is ready to close the estate. He then files his final report, asks the court for a "decree of distribution," and posts a notice of the hearing. After 25 days or more, the court hears the matter and examines the report. If it is in order, the court approves it. The court also decides who the heirs are, and turns the property over to them. The court then discharges the executor or the administrator.

Children cannot be stacked like logs to wait for classroom to hold them when they are ready for education. Room must be ready for them, even if some piling up in double sessions is necessary. But local school districts, most of the already bonded to the legal limit, are no longer able to keep the population pressure on schools under control with out financial help from the state.
More than $1.2 billion in state bonds has been approved by California voters since 1940 to make loans to local school districts for classroom construction. The last addition this huge sum, $300 million was approved at the primaries election in June. But some kinks in the loan system have developed, and a sizeable backlog of construction needs is pending up.
Recently an extra ordinance conference of Legislators was called at the Capitol to discuss the emergency with experts from the departments of finance and education. A spokesman for the state's local associations board, which handles the loan funds, told the lawmakers attending that the present backlog of unfulfilled requests totals more than $2 million. Can Come From Dwarf Trees
Not too many years ago the family orchard was an integral part of the American scene. And we’d like to go on record as saying that those were the days.
Peaches never tasted so good as they did when picked fresh. And tree-ripened plums, apples, or any fruit, as a matter of fact, are lasting memories.
We can’t feel too sorry for ourselves, however, despite the ever-decreasing size of our gardens. For while the family orchard may be a luxury of space that most of us can’t afford, we still have the means to harvest home-grown fruit.
Or haven’t you heard of the combination and dwarf fruit trees offered by California nurserymen?
These innovations of modern gardening make home orchards possible with a minimum of space. And if you’re worried that fruit size or quality is diminished, you can stop worrying now. The fruit from dwarfs or combination trees is every bit as good as ever it was. Indeed, it’s better since the product has been improved by breeding through the years.
Dwarf trees, as you may know by now, are grafted on to dwarfing rootstock, which inhibits top growth. Many of your favorite fruits are available this way, including citrus, peaches, pears and dwarf apples in good variety.
Combination fruit trees have grown in popularity during recent years. These are normal-size trees, grafted two or three varieties to one rootstock. Marine Sgt. James M. Schwermer, husband of the former Willa A. Whitney of 3345 W. Lincoln Blvd., participated recently in Operation “Tri-Santa,” a Marine air-drop of food and clothing to needy Indians in Arizona. Transports from the El Toro Marine Corps Air Station flew six tons of supplies to four Indian settlements in Arizona which had been stricken by summer drought, followed by heavy winter snows.

It was said the program is getting more costly too, because of increases in the cost of school sites and construction.
In order to make the best possible use of proceeds from sale of the bonds, a limit of $5 million per month in loans was originally set, which was raised at our 1960 session to $10 million. It is apparent, however, that even this ceiling is too low and must be raised if we are to meet our ever-growing school building needs.
Under the law, these construction loans to school districts must be paid back to the state over a 30- or 40-year period on very easy terms related to the tax rate levied locally for school purposes. Under certain circumstances, particularly poor districts may be given entirely any obligation to repay. But the loan system does lend the greater credit to the state as a whole, as well as its larger tax resources, to the local districts.
At this meeting, a definitive commitment was made that legislation would be introduced early at our coming session to authorize immediate use of $5 million in bond funds to widen out the existing backlog of loan requests. This would enable construction of many rooms to house next year’s classes.
It was also agreed that the monthly ceiling on the amount which can be loaned should be increased. Legislation to raise it to $12 million per month will be introduced. This will probably mean that a new multi-million dollar bond issue will have to be put on the ballot for approval by the voters earlier than anticipated.
Combination fruit trees have grown in popularity during recent years. These are normal-size trees, grafted two or three varieties to one rootstock. Needless to say, they make a variety of fruit available to the gardener who has room for only one tree.
You'll find plums grafted three varieties to a trunk; peaches, pears and apples the same way. Often these are grafted with an eye to seasonal ripening—with an early, midseason and late peach on one tree, for example.
There is a third method of fitting fruit trees into small spaces, and that is to plant them three trees to a hole.
When done this way, the gardener can harvest three distinct crops—peaches, apples and pears—from what seems to be a single tree.
It's a novelty, to be sure, but one that has all the marks of being around for a long while.

Panama Is Topic Of Lecture Today
"Research in Panama" is the subject of an illustrated lecture scheduled at 4:30 p.m. today by Orange County State College on its campus at 800 N. Cypress Ave., Fullerton.
