State Senator As the first of its kind in the Nation, the new smog control legislation enacted at our recent special session is attracting attention across the continent. Interest is intense, of course, in automotive manufacturing centers, and the attitude of metropolitan centers in other states who are also afflicted by smog laden atmosphere is one of hopeful waiting. As I wrote in a previous column, while the new act is now on the statute books, having been signed by the Governor, it does not actually go into practical effect so far as California motor vehicle owners, dealers and servicemen are concerned until one year after two exhaust fume control devices have been legally approved by the state department of public health. However, so many queries concerning the operating dates in the law, and about possible devices themselves are pouring into our offices, so I thought it might be helpful to readers of this paper if I were to review the facts in greater detail. First, as to the effective dates and other operational features of the law. To repeat, no motor vehicle is required to have a "certified motor vehicle pollution control device." After that, every new passenger motor car and every used car sold to another owner must be equipped with one before it can be licensed by the department of motor vehicles. No commercial motor vehicle (truck) can be licensed after the second December 31 after the certification date unless a control unit has been installed. As an example, if the certification date were May 1, 1961, this truck date would be January 1, 1963. All motor vehicles are required to have control devices after the third December 31 following the certification date. Provisions of the law authorize boards of supervisors of counties not included in any air pollution control district to adopt resolutions, after public hearings as prescribed, which suspend the installation requirements of the law for vehicles based in such counties for periods of two years. Similar suspension powers are also given to the governing bodies of multi-county air pollution control districts to apply to all counties in each such district. Supervisors in counties only partly in a district are also given these powers with respect to the portions of such counties not in a district. The "afterburner" type mixes air with the exhaust and reburns the mixture to eliminate carbon monoxide and unburned fuel. Either type, it is felt can reduce polluting products the 90 or 95 per cent believed necessary. A thirteen member motor vehicle pollution control board, nine appointed by the Governor with Senate consent, and four representing state departments concerned, is established by the law. Its jobs are to adopt needed rules, have the devices tested, certify those passing the tests, exempt certain kinds of vehicles (such as motorcycles, farm vehicles, and other special types) from the law. The board is required to make regular reports to the Legislature. Penalties for violations? Refusal of car license, plus a fine or county jail sentence for making a false statement about a control device on a car.
