Anaheim Gazette Nov. 20, 1959) 11-31 ORDINANCE NO. 1411 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING ARTICLE II OF THE CITY OF ANAHEIM MUNICIPAL CODE RELATING TO THE ESTABLISHMENT OF ZONES IN THE CITY OF ANAHEIM AND THEREIN REGULATING THE USE OF LAND. HEIGHT OF BUILDINGS AND YARD SPACES; ADOPTING A METHODOLOGY FOR THE BOUNDARIES OF SAID ZONES; DEFINING THE TERMS USED THEREIN; PROVIDING FOR ADJUSTMENT; AMENDEMENT AND ENFORCEMENT; PRESCRIBING PENALTIES FOR VIOLATION AND REPEALING ALL SECTIONS OR SECTIONS IN CONFLICT THEREWITH. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt a resolution declaring its intention to change the boundaries of the zone or zones hereafter mentioned and described and fix a time and place for the holding of a public hearing theremon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code and did duly hold and conduct public hearing to consider such proposed change of zone or zones, and did receive and reports from persons interested therein, and did recommend a change or changes of zones as set forth in Resolution No. 227-Series 1958-59 of the City Planning Commission; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did fix the 16th day of June, 1959, as the time, and the Council Chamber in the City Hall of the City of Anaheim as the place, for a public hearing upon said proposed change or changes of zone, and did give notice thereof and provided said article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon consider the recommendation of the City Planning Commission, and did thereupon adopt Resolution No. 5293, finding and determining that a change or changes of zone should be made as set forth in said resolution. That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Lots 1, 2, 47, 48 and 49 of Tract No. 2260, as recorded in Book 133, Pages 1, 2, and 3 of Miscellaneous Maps Records of Orange County, California, now is Zone R-1, SINGLE FAMILY RESIDENTIAL, and that it be changed to and incorporated in C-1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That the residential appearance of the building shall be maintained. 2. That the owner of subject property place of record separate standard City of Anaheim C-1 Deed Restrictions on each lot, approved by the City Attorney, which restrictions shall limit the use of the property to business and professional offices, or for resident - office combinations only. 3. That no retail sales of any kind shall be permitted on the premises. 4. That the parking area for the building fronting on Katella Avenue shall be at the rear of the building, as shown on the layout presented to the City Council and on file with the City of Anaheim. 5. That the 10-foot driveway on the East boundary of subject property shall be eliminated. 6. That the owner of subject property shall erect a 6-foot masonry wall on subject property wherever it adjoins R-1 property. SECTION 2. He shall have supervision of the Electrical Inspectors. Section 2476. BUILDING DEPARTMENT. The Building Department shall be under the supervision of the Chief Building Inspector, which office is hereby created.
