NOTICE IS HEREBY GIVEN that sealed proposals will be received by the City of Anaheim at the office of Rail Check up to the hour of 2:00 o'clock P.M. on the 18th day of November, 1953, and will be opened on said date at the hour of 2:00 o'clock P.M., in public, in the City Council Chambers in the City Hall, in the City of Anaheim, State of California, by the City Clerk and the City Engineer, for furnishing the following:
All plant, labor, services, materials and equipment, and all utilities including power, fuel, water, and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the office of the City Engineer or City Clerk of the City of Anaheim, the following public improvement, to with: construction of a storm drain in Rail Check up to the hour of 2:00 o'clock P.M., including the installation of 8-inch reinforced concrete pipe, construction of a reinforced concrete junction box complete in place, excavation, haulaway of necessary removals, curb and gutter reconstruction, resurfacing with P.M.S., backfill and compaction, construction of concrete cradle, necessary connections, and appurtenant work as indicated on the plans, Job No. and shall be tabulated by the City Engineer and the result thereof reported to the City Council at its next regular or adjourned regular meeting, for action thereon by said City Council.
PURSUANT to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim has ascertained the general preemption laws in the locality which this type of work is to be performed for each type of work needed to execute this contract. The hourly wage scale so ascertained is as follows:

The successful bidder will be required to furnish a faithful performance bond in an amount equal to 100% of the contract price and a labor and material bond in an amount equal to 100% of the contract price and a bond secured from a surety or bonding company satisfactory to the City Council of the City of Anaheim and shall be approved by the City Attorney as to form and sufficiency before acceptance.
Plans and specifications may be obtained from the City Engineer or the City Clerk of the City Hall,Anaheim for an estimate based on an amount less than $100.000.00 for insurance including accidental death or any one person,$300.000.00 on account of any one accident,and property damage insurance in an amount not less than $50.000.00,and public liability insurance to cover vehicles used by him whether on or off his premises in an amount of $50.000.00 for injuries to any one person or $100.000.00 for any one accident.property damage insurance with appropriate employees liability insurance shall be maintained during life of the contract covering all employees on project.The contractor shall be responsible that all employees on project has ascertained this general preemption law which this type of work is to be performed for each type of work needed to execute this contract.The hourly wage scale so ascertained is as follows:

The rates of per dime wages for each of the various classifications of work shall be the hereinbefore set forth prevailing rates of hourly wages multiplied by eight. Eight hours shall constitute a day's work, it being understood that in the event that workmen are employed less than eight hours per day the per dime wage shall be that fraction of the per dime wage herein established that the number of hours of employment bears to eight hours.
The overtime rule establishing the rates of overtime and holiday work shall be accordance with the following: Where a single shift is worked, eight hours of continuous employment, except for lunch periods, shall constitute a day's work beginning on Monday and continuing through Friday each week. Where work is required in excess of eight hours in any one day or from 5:00 o'clock P.M. and 12:00 o'clock midnight Saturday, such work shall be paid for at the minimum rate of one and one-half times the basic rate of wages, and on Sundays and holidays such work shall be paid for at the minimum rate of double the basic rate of wages, except as otherwise provided in the May, 1958 revision of the A.G.C., B.C.A., H.B.I., E.G.C.A., A.F.L., C.I.O., Southern California Master Labor Agreement. Holidays as herein referred to shall be deemed to be New Year's Day, Decoration Day, Independence Day, Labor Day, Veterans' Day, Thanksgiving Day and Christmas Day. If any of the above mentioned holidays other than Labor Day and Thanksgiving Day falls on Sunday, the following Monday shall be considered a legal holiday.
It shall be mandatory upon the contractor to be issued and upon any subcontractor under him to pay not less than the specified rates of wages to all laborers, workmen and mechanics employed by them in the execution of the contract.
Each bid shall be made out on a form to be obtained at the office of the City Clerk or the City Engineer of the City of Anaheim and shall be accompanied by a certified or cashier's check or bid bond for ten (10) per cent of the amount of the bid, made payable to the City Engineer and shall be delivered to the City Clerk at the City Hall of the City of Anaheim before 2:00 o'clock P.M. on the 19th day of November, 1958, at which time sealed proposals will be opened in public by the City Clerk and the City Engineer. Each bid must specify the name and location of the mill, office of each subcontractor who perform work or labor or require services to the contractor in or near the construction of the work or movement and the portion of work which will be done by a subcontractor. If any bid submission fails to specify a subcontractor required by this contract, such bid agrees to perform the work himself.
The successful bidder will be required to furnish a faithful performance bond in an amount equal 100% of the contract price and amount equal to 100% of the cost for a surety or bond company or factory to the City Council or City of Anaheim and shall be proved by the City Attorney form and sufficiency before acceptance.
Plans and specifications must obtained from the City Engineer the City Clerk of the City of Anaheim at the City Hall, Anaheim California for the sum of $100,000.00 if pickup addresses are not less than $50,000.00 and no liability insurance to cover vested use by him whether on or off premises in an amount of $50,000.00 for injuries to any one person $100,000.00 for any one accident.

The successful bidder and any contractor and contractors employed by him in the performance of said work or any part of the work of said public improvement will be required to use only such manufactured articles and supplies as have been mined or procured in the United States substantially all from articles, materials and supplies mined, produced or manufactured, as the case may be, in the United States pursuant to the provisions of Section 4320 to 4308, both inclusive, of the Government Code of the State of California.
Purmant to the provisions of Sections 4320 and 4321 of the Government Code of the State of California, price, fitness and quality being equal, the successful bidder and any subcontractors or contractors employed by him to do any part of the work above described public improvement will be required to prefer supplies grown or produced in the State of California and next to prefer supplies partially grown, manufactured or produced in the State of California.

Friday and 12:00 o'clock midnight Saturday, such work shall be paid for at the minimum rate of one and one-half times the basic or hourly Sundays and holidays such work shall be paid for at the minimum rate of double the basic rate of wages, except as otherwise provided in the September, 1959 revision of the A.G.C. B.C.A., H.B.I., E.G.C.A., and A.F.L.-C.I.O., Southern California Master Labor Agreement.
Holidays as herein referred to shall be deemed to be New Year's Day, Decoration Day, Independence Day, Labor Day, Veterans Day, Thanksgiving Day and Christmas Day. If any of the above mentioned holidays other than Labor Day and Thanksgiving Day falls on Sunday, the follower Monday shall be considered a legal holiday.
