LEGAL NOTICE (Pub. Anaheim Gazette June 4, 1859) ORDINANCE NO. 1348 • AN ORDINANCE OF THE CITY OF ANAHEIM, AMENDING ARTICLE IX, CHAPTER I OF THE ANAHEIM MUNICIPAL CODE RELATING TO THE ESTABLISHMENT OF ZONES IN THE CITY OF ANAHEIM AND THEREIN REGULATING THE USE OF LAND, HEIGHT OF BUILDINGS AND YARD SPACES; ADOPTING A MAP SHOWING THE BOUNDARIES OF SAID ZONES; DEFINING THE TERMS USED THEREIN; PROVIDING FOR ADJUSTMENT, AMENDMENTS AND ENFORCEMENT; PRESCRIBING PENALTIES FOR VIOLATION AND REPEALING ALL SECTIONS OR PARTS OF SECTIONS IN CONFLICT THEREWITH. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: WHEREAS, the City Planning Commission of the City of Anaheim did beforely pass and adopt a resolution declaring its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public hearing therein in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code and did duly hold and conduct such proposed change of zone or zones, and did receive evidence and reports from persons interested therein, and did recommend a change or changes of zones as set forth in Resolution No. 31 — Series 1868-69 of the City Planning Commission; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did fix the 25th day of August, 1868, as the time, and the Council Chamber in the City Hall of the City of Anaheim as the place, for a public hearing upon said proposed change or changes of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon consider the recommendations of the City Planning Commission, and did adopt a resolution declaring that a change or changes of zone should be made as set forth in said resolution. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. Final Article IX, Chapter 2 of the Anaheim Municipal Code establishing zones in the City of Anaheim regulating the use of land, negent or oppining and yard spaces; adopting a map showing the boundaries of said zone; defining the terms used in said Article and Chapter; providing for amendment and enforcement thereof; prescribing penalties for violation and repealing any contract therewith; be, and the same is hereby amended by changing the boundaries of the zones set forth in said Article IX, Chapter 2 by adopting a sectional Zoning Map or Maps showing such change or changes as follows: Anat all of the area situated in the City of Anaheim, County of Orange, State of California, described below with: The East 234,235 feet Lot 24 of Anaheim Investment Company's tract, in the City of Anaheim, County of Orange, State of California, shown on a map thereof recorded in Book 7, pages 24 and 24, Miscellaneous Records of said Orange County, now is Zone R-A, RESIDENTIAL AGRICULTURAL, and that it changes or repeals R-A. NOW, THEREFORE, THE CITY ORCHIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Article IX, Chapter 2 of the Anaheim Municipal Code "establishing zones in the City of Anaheim and therein regulating the use of land, height of buildings and yard spaces, adopting a map showing boundaries of said zone; defining the terms used in said Article and Chapter; providing for amendment and enforcement thereof; prescribing penalties for violation and repealing all sections or parts of sections in conflict therewith" be, and the same is hereby amended by changing the boundaries of the zones set forth in said Article IX, Chapter 2 by adopting a sectional Zoning Map or Maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Lot 1 of Tract No. 228, as shown on amended book lot, Page 15 of Miscellaneous Maps, Records of Orange County, California, now is Zone C-1, NEIGHBORHOOD - COMMERCIAL AND that it be changed to and incorporated in C-2, HEAVY-COMMERCIAL ZONE, upon the following conditions: 1. That the owner of subject property of record standard City of Anaheim C-2 Deed, Restrictions approved by the City Attorney, which restrictions shall limit the C-2 uses of the property to a service station only; 2. That a six-foot wall be erected between Lots 1 and 2 of Tract No. 228. SECTION 2. The City Zoning Map shall be, and the same is hereby amended and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a national zoning map to be added to the City Zoning Map and inserted in the Anaheim Municipal Code showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Gazette, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force. WHEREAS, the City Council of the City of Anaheim did on November 8, 1954, adopt Ordinance No. 235 in reclassification proceedings No. F-53-54-26 changing the property therein described from R-A.
