LEGAL NOTICE NOTICE INVITING SEALED PROPOSAL FOR FURNISHING ALL MATERIALS AND EQUIPMENT AND PERFORMING ALL WORK NECESSARY FOR THE CONSTRUCTION, INSTALLATION AND COMPLETION WITHIN THE CITY OF ANAHEIM, ORANGE COUNTY, CALIFORNIA. IN ACCORDANCE WITH THE SPECIFICATIONS ON FILE IN THE OFFICE OF THE CITY CLERK OF THE CITY OF ANAHEIM, FOLLOWING PUBLIC IMPROvement OR WORK: THE DALE AVENUE SEWER IMPROvement FROM 710 FEET NORTH OF BALL ROAD TO BALL ROAD, JOB NO. 1158. NOTICE IS HEREBY GIVEN that sealed proposals will be received by the City of Anaheim at the office of the City Clerk up to the hour of 2:00 p.m. on the 11th day of June, 1958, and will be expended on said date at the hour of 2:00 p.m. in public, in the City Council Chambers in the City Hall, in the City of Anaheim, State of California, by the City Clerk and the City Engineer, for furnishing the following: All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, performing all work necessary for construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the office of the City Engineer or the City Clerk of the City of Anaheim, the following public improvement, to wit: The Dale Avenue Sewer Improvement, consisting of the construction of an 8-inch C.P. sewer break in Dal Ave., from 710 feet North of Ball Road to Ball Road, including excavation, backfill and flooding, construction of manholes, 4-inch house laterals, and appurtenant work, as indicated on the plans, Job No. 1158, and shall be tabulated by the City Engineer and the result thereof reported to the City Council at its next regular or adjourned regular meeting action thereon by said City Council. PURSUANT to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim has ascertained the general prevailing rate of wages in the locality in Friday and 12:00 o'clock midnight Saturday, such work shall be paid for as the minimum rate of one and one-tenth times the basic rate of wages, except as otherwise provided in the May, 1958, revision of the A.G.C., B.C.A., H.B.L., E.G.C.A., A.F.L.-CLO., Southern California Master Labor Agreement. Holidays as herein referred to shall be deemed to be New Year's Day, Decoration Day, Independence Day, Labor Day, Veteran Day, Thanksgiving Day and Christmas Day. If any of the above mentioned holidays other than Labor Day and Thanksgiving Day falls on Sunday, the following Monday shall be considered a legal holiday. It shall be mandatory upon the contractor to whom the contract is awarded and upon any subcontractor under him to pay not less than the specified rates of wages to all laborers, workers and mechanics employed by them in the execution of the contract. Each bid shall be made out on a form to be obtained at the office of the City Clerk or the City Engineer of the City of Anaheim and shall be accompanied by a certified or cashier's check or bond for ten (10%) per cent of the amount of the bid made payable to the City of Anaheim and delivered to the City Clerk at the City Hall of the City of Anaheim before 2:00 p.m. on the 11th day of June, 1958, at which time sealed proposals will be opened in public by the City Clerk and the City Engineer. Sealed proposals shall be submitted in sealed envelopes and marked in the upper left corner "Sealed proposals for Dalie SEWER IMPROvement NORTH OF BALL RD." TO BALL RD. JOB NO. 1158, together with the name and address of the bidder. The above mentioned check or bond shall be given as a guarantee that the bidder will enter into a contract, if awarded to him, and will be declared forfeited if the successful bid refuses to enter into said contract after being requested to do so by the City of Anaheim. Such contract shall be entered within fifteen (15) days after receipt by said contractor or notice of the awarding of the contract unless such time is extended by the City of Anaheim. Each bid must specify the name and location of the mill, shop or office of each sub-contractor who will work on labor or render service to the contractor in order to construct the work or improve it and the portion of the work which will be done by each sub-contractor. Transportation, including port and water, and performing any necessary for construction at this office or city of Anaheim, follow this procedure: Road sweeper improvement, of the construction of 8 inches by 22-inch V.C.P. sewer in Ball Road from 255 feet Sherrill Street to Miller Street including excavation; backflooding; the construction of holes; 4-inch house interiors; Stanton Avenue, and any work indicated on the No. 1158 and shall be taken by the City Engineer and indicate thereof to the City Council for regular or adjournment action to issue City Council. If any bid submitted fails to satisfy the company satisfaction to the City Council of the City of Anaheim and shall be approved by the City Attorney as to form and sufficiency before acceptance. The successful bidder will be required to furnish a faithful performance bond in an amount equal to 100% of the contract price and a labor and material bond in an amount equal to 100% of the contract price, and bond for surety or bonding company satisfaction to the City Council of the City of Anaheim and shall be approved by the City Attorney as to form and sufficiency before acceptance. The successful bidder will be required to continuously maintain adequate protection of all his work and adjacent property from damage arising from the contract and to furnish a copy of the public liability insurance in an amount not less than $100,000.00 for injuries including accidental death of any one person, $400,000.00 on account of any one accident, and property damage insurance in an amount not less than $50,000.00 and public liability insurance in an amount not off the premises in an amount of $50,000.00 for injuries to any one person or $100,000.00 for any one accident, and property damage in an amount of $100,000.00. Compensation and employer's liability insurance shall be maintained during the title of the contract covering all employees employed by him in the performing all employer's responsibilities that allow subcontractors are protected by such insurance. The rates of per diem wages for each of the various classifications of work shall be the hereinafter set forth prevailing rates of hourly wages multiplied by eight. Eight hours shall constitute a day's work, it being understood that in the event that workers are employed less than eight hours per day this wage shall be that fraction of the per diem wage herein established that the number or hours of employment bears to eight hours. The overtime rule establishing the rates of overtime and holiday work shall be in accordance with the following: Where a single shift is worked, eight hours of continuous employment except for lunch periods, shall constitute a day's work beginning on Monday and continuing through Friday each week.
