(5) LEGAL NOTICE NOTICE INVITING SEALED PROGRAM FOR PURCHISING ALL FRANT, LABOR, SERVICES, MATERIALS AND EQUIPMENT AND PERFORMING ALL WORK NECESSARY FOR THE CONSTRUCTION, INSTALLATION AND COMPLETION WITHIN THE CITY OF ANAHEIM, ORANGE COUNTY, CALIFORNIA, IN ACCORDANCE WITH THE SPECIFICATIONS ON THIS PAGE OF THE CITY CLERK OF THE CITY OF ANAHEIM OF THE FOLLOWING PUBLIC IMPROVEMENT OR WORK: THE IMPROVEMENT OF A SEWER EASEMENT 112 FEET WEST OF BROOKHURST ST. FROM BALL ROAD NORTHERLY TO VANCOUVER DRIVE, JOB NO. 1157. NOTICE IS HEREBY GIVEN that sewerage will be received by the City of Anaheim at the office of the City Clerk up to the hour of 2:00 o'clock P.M. on the 14th day of May, 1958, and will be opened on said date at the hour of 2:00 o'clock P.M., in public, in the City Council Chambers in the City Hall, in the City of Anaheim, State of California, by the City Clerk and the City Engineer, for furnishing the following all plant, building services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the office of the City Endeer or City Clerk of the City of Anaheim, the following public improvement to-wit: The improvement of a sewer cement West of Brookhurst Street, from Ball Road northerly to Vancouver Drive, by excavation, construction of an 8-inch V. PURSUANT to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim has accepted the general prevailing rate of wages in the locality in which this type of work is to be performed for each type of workman required for such type of workman. Health and Welfare payments shall be made in accordance with the Southern California Master Labor Agreement. Apprentices may be employed in conformity with Section 1777.5 of the California Labor Code. The rates of per diem wages for each of the various classifications of work shall be the hereinbefore set forth prevailing rates of hourly wages multiplied by eight. Eight hours shall constitute a day's work, it being understood that in the event that workmen are employed less than eight hours per day the per diem wage shall be that fraction of the per diem wage herein established that the number of hours of employment bears to eight hours. Rates of overtime and holiday work shall be in accordance with the following: Where a single shift is worked, eight hours of continuous employment, except for lunch periods, shall constitute a day's work beginning on Monday and continuing through Friday each week. Where work is required in excess of eight hours in any one day during the interval of time from 6:00 o'clock P.M. Friday and 12:00 o'clock midnight Saturday, such work shall be paid for at the minimum rate of one and one-half times the basic rate of wages, except where provided in the May, 1958, revision of the A.G.C., B.C.A., H.B.I., E.G.C.A., A.F.L.-C.I.O., Southern California Master Labor Agreement. Holidays as herein referred to shall be deemed to be New Year's Day, Decoration Day, Independence Day, Labor Day, Veteran's Day, Thanksgiving Day and Christmas Day. If any of the above mentioned holidays other than Labor Day the following Monday shall be considered a legal holiday. It shall be mandatory upon the contractor to whom the contract is awarded and upon any subcontractor under him to pay not less than the laborers, workers and mechanics employed by them in the execution of the contract. Each bid shall be made out on a form to be obtained at the office of the City Clerk or the City Engineer of the City of Anaheim and shall be accompanied by a certified or cashier's check or bid bond for ten (10) percent of the amount of the bid, made payable to the City of Anaheim, and shall be sealed and delivered to the City Clerk at the City Hall of Anaheim or at the City Engineer. Sealed proposals shall be submitted in sealed envelopes and marked in the upper left hand corner "Sealed proposals for construction of a sewer 212 feet west of Brookhurst Street, from Hall Road to Vancouver Drive. Job No. 1157," together with the name and address of the bidder. The above mentioned check of food or lodges that the bidder will submit into a contract if awarded to him and will be declared formalized if the successful bidder refuses to enter into said contract after being requested to do so by the City of Anaheim. Such contract shall be entered into within fifteen (15) days after receipt by bald contractors of notice of the awarding of the contract unless such time is extended by the City of Anaheim. Each bid must satisfy the name and location of the mill shop services to perform work or labor or render services to the contractor in or about the construction of the work or improvement, and the portion of the work which will be done by each subcontractor. If any bid submitted fails to specify a subcontractor as approved by the contractor submitting such bid agrees to perform the work himself. The successful bids will be required to furnish a faithful performance bond in an amount equal to 100% of the contract price and labor and material bond in an amount equal to 100% of the contract price. Sounds bonds to be secured from a surety company for payment of the City Council of the City Of Anaheim may be approved by the City Attorney; as to form and sufficiency before acceptance. Plans and specifications may be obtained from the City Engineer or City Clerk of the City of Anaheim at the City Hall, Anaheim, California for the sum of Five ($5.00) Dollars if placed on its office or by the City Council of the City Of Anaheim may be approved by mail. The successful bidder will be required to continuously maintain adequate protection of all his work and adjacent property from damage arising out of the performance of the contract and to furnish the City with public liability insurance in an amount not less than $90,000.00 for injuries incurred in dental death of any one person, $300.000.00 on account of any one accident, and property damage insurance in an amount not less than $50,000.00 and public liability insurance to cover vehicles used by him whether on or off the premises in an amount of $50,000.00 for injuries to any one person or $100,000.00 for any amount of $16,000.00. Ball Rd., Anaheim, Calif., was promoted to Navy Lieutenant March 2 at Sausley Field Air Station, Pensacola, Fla. Before entering the Navy in July 1963 he attended the University of Texas.
