Suggested Tips . . . (Continued From Page 1) gift wrapped and has obviously required hours to prepare. Another cause of loss is insufficient or inadequate packaging and wrapping. For example, postal personnel are accustomed to seeing highly fragile articles packed in flimsy hat boxes without any padding or excelsior, or heavy parcels wrapped in tissue paper. Often, mailers will spend many dollars on the gift, but will wrap it in scrap newspapers, torn up paper bags, and so forth. Experience of the Postal Service has shown that this is poor economy, and inviter loss. A good rule is to use only materials of good quality—heavy twine and strong new paper, for example—and use an adequate amount of them to do the packaging job properly. Also, it's a good idea to write both address and return address inside the parcel, on the box containing the gift, or on an inside wrapper. A personal card or a place of stationery containing the mailer's name and address also can be included in the parcel to insure return, if it cannot be delivered. Templeton, manager of Security First National Bank's Anno LAW IN ACTION COMMUNITY PROPERTY California's community property law came to us from Mexican and Spanish law. Under the peace treaty of 1848, the United States agreed that we would respect Mexican property rights. Afterwards California itself adopted the system that man and wife shall share alike all property they earn after marriage. This system differs from the property laws in most other states which grew out of the English common law. What property you own is either "separate" or "community." Community comes with a valid marriage. A person owns separate property before marriage. It is also inherited property, gifts, and after marriage, the income from them. Community property arises cut of a man and wife's earnings, and so separate property does not become community merely when a couple marries. Property from a common law state does not become community property, even though it would have been, had the couple acquired it here. But separate earnings may become community property. For example, if a husband spent much of his time managing and maintaining his sepa- rate property (an apartment house) instead of earning an income in other ways. The husband's time belonged to the "community." If a husband and wife have "commingled" their property so that it cannot be unscrambled, the law assumes it is community. The law presumes that what a married woman gets by a written instrument, (e.g. a deed, bill of sale, note, or registration certificate), or what she earns, is her own separate property. All of these presumptions can be overcome in court by evidence. When we first adopted our system the husband could control or manage the community property as if it were his own. But today if a husband gives away such property without his wife's written consent, she can set aside the gift. Note: California lawyers offer this column so you may know about our laws. The local banker advised local merchants and citizens alike to be particularly watchful of the checks they accept during the busy holiday shopping days that lie ahead. Recommended Rules His recommended rules are: 1. Do not be afraid to ask questions about the check you are asked to cash. After all, it is your money that is being paid out. 2. Never cash a check for a stranger until you have positive identification. Insist on local references and check them carefully. 3. Cards can be forged. Do not rely on lodge cards, social security cards, auto licenses or letters of reference from out of town firms as positive identification. These can be forged or stolen. 4. Do not cash paychecks or any other checks unless during business of banking hours and not on Saturdays or holidays without investigation. 5. Do not issue or cash checks written in pencil as it is very easy to alter such checks. 6. Make sure the endorsement corresponds with the payee's name on the face of the check. 7. Always demand that the person presenting the check endorse it in your presence. Even though the check has already been endorsed, insist that he endorse it again. 8. Out of town firms. Refuse to cash checks of they are on out of town firms or banks, unless you are absolutely certain of the casher's identity. 9. Livingston, Jr., 21, whose parents live at 11732 Dale Street, Anaheim, recently completed eight weeks of advanced infantry training at Fort Carson, Colo. Tilden of Arlington was re-elected to a second term as president of the board of directors of Pure Gold, the state's second largest citrus marketing cooperative. In addition to his varied citrus holdings, Tilden is president of La Verne Cooperative Citrus Association, La Verne. Carl G. Samuelson of Ventura was named first vice president; Russell J. Dr. Smith Keynote Speaker Dr. Paul S. Smith, president of Whittier College and well known for the wit and humor which he employs when speaking, will be keynote speaker, according to co-chairman Urban Beh, representing Associated and Ken Sampson of the Coast Association. Dr. Smith joined the staff at Whittier College in 1922 as Professor of History and Government, and was elected president of the college in 1951. The eminent historian has devoted much time and study to problems of contemporary American government and has written several books on the subject. Most recent of his works is "A New Approach to the American Constitution." Dr. Smith has been heard in lectures on radio and has contributed to the Americana Encyclopedia and other publications on various facets of the American electoral system.
