Plaintiff specifications may be obtained from the City Council of the City of Anaheim at the City Hall, Anaheim, California for the sum of Five and no/100 ($5.00). Dollars if picked up at sold offices, or the sum of Six and no/100 ($6.00). Dollars if forwarded by mail.
The successful bidder will be required to continuously maintain adequate protection of all his work and adjacent property from damage arising out of the performance of the contract and to furnish the City with public liability insurance in an amount greater than $100,000.00 for injuries including any one person, $300,000.00 on account of any one accident, and property damage insurance in an amount not less than $50,000.00 and public liability insurance to cover vehicles used by him whether on or off the project; an amount of $50,000.00 for injuries any one accident and property damage in an amount not less than $100,000.00; compensation and employer's liability insurance shall be maintained during the life of the contract; covering all employees on the contractor shall be responsible that all employees subcontractors are protected by such insurance. Such insurance shall be furnished by companies satisfactory to the City and subject to the approval of the City Attorney as to form and sufficiency.
The successful bidder and any subcontractors employed by him in the performances of said work or any part of the work of said public improvement will be required to use only such manufactured articles, materials and supplies as have been mined or produced in United States, and only such manufactured articles, materials and supplies as have been manufactured in the United States substantially all from articles, materials and supplies mined, produced or manufactured, as the case may be, in the United States pursuant to the provisions of Sections 4320 and 4331 of the Government Code of the State of California.
Pursuant to the provisions of Sections 4320 and 4331 of the Government Code of the State of California, and price, fitness and quality being equal, the successful bidder and any subcontractors or contractors employed by him to do any part of the work described public improvement shall be required to prefer supplies grown, manufactured or produced in the State of California and next to prefer supplies partially grown, manufactured or produced in the State of California.

All foremen, unless separately classified, shall be paid as provided in May, 1956 revision of the A.G.C., B.C.A., H.B.L., E.G.C.A., A.F.L.-C.I.O., Southern California Master Labor Code.
The rates of per diem wages for each-of-the-various classifications of work shall be the heretofore set forth prevailing rates of hourly wages multiplied by eight. Eight hours shall constitute a day's work it being understood that in the event that workmen are employed less than eight hours per day the per diem wage shall be the fraction of the per diem wage herein established that number of hours of employment bears to eight hours.
The overtime rule establishing the rates of overtime and nonway work shall be in accordance with the following: Where a single shift is worked, eight hours or continuous employment, except for lunch periods, shall constitute a day's work beginning on Monday and continuing until the end of the week; work is required in excess of eight hours in any one day or during the interval of time from 5:00 o'clock P.M. Friday and 12:00 o'clock midnight Saturday, such work shall be paid for at the minimum rate of one and one-half times the basic rate of wages, and on Sundays and holidays when working on Monday and continuing until the end of the week; minimum rate of double the basic rate of wages, except as otherwise provided in the May, 1956 revision of the A.G.C., B.C.A., H.B.L., E.G.C.A., A.F.L.-C.I.O., Southern California Master Labor Agreement.
Holidays as herein referred to shall be observed to be New Year's Day, Decoration Day, Independence Day, Labor Day, Armistice Day, Thanksgiving Day and Christmas Day if given special hours unless otherwise specified. Days on Sunday, the following Monday shall be considered a legal holiday.
It shall be mandatory upon the contractor to whom the contract is awarded and upon any subcontractor under him to pay not less than the said specified rates of wages to all workers, workmen and mechanics.

NOTICE IS HEREBY GIVEN that sealed proposals will be received by the City of Anaheim at the office of the City Engineer on the hour of 2:00 o'clock P.M. on the Zard day of October, 1958, and will be opened on said date at the hour of 2:00 o'clock P.M., in public, in the City Council Chambers in the City Hall, in the City of Anaheim, State of California, by the City Clerk and the City Engineer, for furnishing the following:
All plant, labor, services, maintenance, equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete a good and workmanlike manner, in strict accordance with the specifications, plans and drawings thereof on file in the office of the City Engineer or City Clerk of the City of Anaheim, the following public improvement, to-wit:
The Construction of a 14-inch Steel Cylinder Concrete Water Line in Orange Avenue, from Dale Avenue to Stanton Avenue, Class 150, including excavation, trenching and backfill, and including all fixtures and appurtenant materials as indicated on the plans. Work Order No. 1623, and shall be tabulated by the City Engineer and the result thereof reported to the City Council at its next regular or adjourned regular meeting for action thereon by said City Council.
PURSUANT to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim has ascertained the general prevailing rate of wages in the locality in which this type of work is to be provided in the May, 1958 revision of the A.G.C., B.C.A., H.B.L. E.G.C., A.U.C., B.U.C., S.C.O.R., California Master Labor Agreement. Holidays as herein referred to shall be deemed to be New Year's Day, Decoration Day, Independence Day, Labor Day, Armistice Day, Thanksgiving Day and Christmas Day. If any of the above mentioned holidays upper than Labor Day and Thanksgiving Day falls on Sunday, the following Monday shall be considered a legal holiday.
It shall be mandatory upon the contract awarded and upon any subcontractor under him to pay not less than the said specified rates of wages to an employer, workmen and mechanics employed by them in the execution of the contract.
Each bid shall be made out on form if accepted at the office of the City Clerk or the City Engineer of the City of Anaheim and shall be accompanied by a certified or cashier's check or old bond for ten (10%) per cent of the amount of the bid, made payable to the City Clerk at the City Hall of the City of Anaheim, bound zero clock far on the zara day of October, 1958, at which time sealed proposals will be opened in public by the City Clerk and the City Engineer. Sealed proposals shall be submitted in sealed envelopes and marked on the upper left corner "Sealed proposals for construction OR CONCRETE WATER LINE IN ORANGE AVENUE, WORK ORDER NO. 1623" together with the name and address of the biddder. The above mentioned check or bond shall be given as a guarantee that the bidder will enter into a contract, if awarded to him, and will be declared forfeited if the successful bidder refuses to enter info said contract artificially to do so by the City Clerk. Such contract shall be entered into within fifteen (15) days after receipt by said contractor of notice of the awarding of one contract unless such time is extended by the City Clerk.
Each bid must specify the name and location of the mill, shop or office of each subcontractor who will perform work or labor or render services for the contractor or about the construction of the work or improvement and the portion of the work which will be done by each subcontractor. If any bid submitted fails to specify a subcontractor as aforesaid, the contractor submitting such bid agrees to perform the work himself.
The successful bidder will be required to furnish a faithful performance bond in an amount equal to 100% of the contract price and a labor and material bond in an amount equal to 100% of the contract price, said bonds to be secured from a surplus provided in the May, 1958 revision of the A.G.C., B.C.A., H.B.L. E.G.C., A.U.C., B.U.C., S.C.O.R., California Master Labor Agreement. Holidays as herein referred to shall be New Year's Day, Decoration Day, Independence Day, Labor Day, Armistice Day, Thanksgiving Day and Christmas Day. The successful bidder and any subcontractor and contractors employed by him in the performance of said work or part of the work of said public improvement will be required to use only such manufactured articles, materials and supplies as have been mined or produced in the United States, and only such manufactured articles, materials and supplies as have been manufactured in the United States pursuant to the provisions of Sections 4306 to 4305, both inclusive, of the Government Code of the State of California.
Pursuant to the provisions of Sections 4330 and 4331 of the Government Code of the State of California, price, fitness and quality being equal, the successful bidder and any subcontractor employed by him to do any of the work on the above described public improvement shall be required to prefer supplies grown, manufactured or produced in the State of California.
