AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING ARTICLE IX.
CHARACTER II OF THE ANAHEIM MUNICIPAL CODE RELATION TO ESTABLISHMENT OF ZONES IN THE CITY OF ANAHEIM AND THEREIN BEING THE USE OF LAND HEIGHT OF BUILDINGS AND YARD SPACES; ADOPting A MAP SHOWING THE BOUNDARIES OF NAZONES; DEFINING THE TERMS II OF THE NUNDERMENT AND ENFORCEMENT; PRESCRIBING PENSALTIES FOR VIOLATION AND REPEALING ALL SECTIONS OR PARTS OF SECTIONS IN CONFLICT THEREWITH.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS:
WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt to change the land use or zones or zoneshern mentionment and described and did fix a time and place for the holding of a public hearing therein in the manner and as prescribed in Article IX, Chapter II of the Anaheim Municipal Code and did did heretofore conduct said public hearing to consider proposed change of zone or zones,and did receive evidence and reports from persons interested therein,and did recommend a change or changes of past use in Resolution No. 22—Series 1967-68 of the City Planning Commission;and

NOTICE IS HEREBY GIVEN that sealed proposals will be received by the City of Anaheim at the office of the City Clerk up to the hour of 2:00 o'clock P.M. on the 2nd day of October, 1958, and will be opened on said date at the hour of 2:00 o'clock P.M., in public, in the City Council Chambers in the City Hall, in the City of Anaheim, State of California, by the City Clerk and the City Engineer for furnishing the foliage. PURSUANT to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim general prevailing rate of award to any person or one person on account or any one accident, and property damage insurance in an amount not less than $60,000.00, and public liability insurance in an amount not less than $180,000.00 for injuries including death or any one person, $60,000.00 on account or any one accident, and property damage insurance in an amount not less than $60,000.00 for injuries by any one person or any one accident.
Heim, and shall be sealed and delivered to the City Clerk at the City Bldg in the City of Anaheim before 2:00 o'clock P.M. on the second day of October, 1958, at which time sealed proposals will be opened in public by the City Clerk and the City Engineer. Sealed proposals shall be submitted in sealed envelopes and marked in the upper left hand corner "Sealed proposals for construction of THE IMPROVEMENT OF HASTER STREET. JOB NO. 207." together with the same address of the bidder. The above mentioned check or bond shall be given as a guarantee that the bidder will enter into a contract, if awarded to him, and will be declared forefeited if the unsuccessful bidder refuses to enter into said contract affirms being requested to do so by the City Engineer for furnishing the foliage. If any bid submitted fails to specify a subcontractor as aforesaid, the contractor submitting such bid agrees to perform the work himself.
The successful bidder will be required to furnish a faithful performance bond in an amount equal to one contract price and a labor and master price and an amount equal to 100% of the contract price, said bonds to be secured from a surety or bond company satisfactory to the City Council of the City Anaheim and shall be approved by the City Attorney as to form and sufficiency before acceptance.
Plans and specifications may be obtained from the City Engineer or the City Clerk of the City Anaheim for the City Hall Anaheim California for sums of Pty and no/100 ($6.00). Dollars if picked out said offices, or the sum of Six and no/100 ($6.00). Dollars if forwarded by mail.
The successful bidder will be required to continuously maintain adequate protection of all his work and adjacent property from damage arising out of the performance of the contract and to furnish the City with public liability insurance in an amount not less than $180,000.00 for injuries including death or any one person, $60,000.00 on account or any one accident, and property damage insurance in an amount not less than $60,000.00 for injuries by any one person or any one accident.

The successful bidder will be required to continuously maintain adequate quotation protection in his work and adjacent property from areas arising out of the performance of the contract and to furnish the City with public liability insurance in an amount not less than $100,000. for injuries including accidental death or any one person, $300,000 on account of any one accident, and property damage insurance in an amount less than $90,000, and public liability damage in an amount of $10,000,00.
Compensation and employer's liability insurance shall be maintained during the life of the contract covering all employees on the project. The contractor shall be required to use only such manufactured articles, materials and supplies as have been provided by inland United States substantially all from articles, materials and supplies mined, produced or manufactured, as case may be, in the United States pursuant to Section 399 to 4305, both inclusive of Government Code of the State of California.
Pursuant to the provisions of Sections 4830 and 4832 on the Government Code of the State of California and price, fitness and quality being equal, the successful bidder and any subcontractors or contractors employed by him to do any part of the work on above described public improvement shall be required to prefer supplies grown, manufactured or produced in the State of California.
Each bid shall be accompanied by a Non-Collision Affidavit, copies of which may be obtained from the City Clerk.
The successful bidder or bidders shall be required to enter into a contract with the City of Anaheim in the manner and form approved by the City Attorney of the City Anaheim.
The City Council reserves the right to select any and all bids or to waive any informality or to accept permitted by law, and reserves further right to make an award to the lowest responsible bidder found and determined to serve best interests of the City Anaheim.

The rates of per diem wages for each of the various classifications of work shall be the hereinbefore set forth prevailing rates of hourly wages multiplied by eight. Eight hours shall constitute a day's work, it being understood that in the event that an employee is employed less than eight hours a week wage shall be that fraction of the per diem wage herein established that the number of hours of employment bears to eight hours.
The overtime rule establishing the rates of overtime and holiday work shall be in accordance with the following: Where a single shift is worked, eight hours of continuous employment, except for lunch periods shall constitute a day's work beginning on Monday and continuing through Friday each week. Where work is required in excess of eight hours in any one day or during the interval of time from 5:00 o'clock P.M. Friday and 12:00 o'clock midnight Saturday, such work shall be paid for at the minimum rate of one and one-half times the basic rate of wages and on Sundays and holidays such work shall be paid for at the minimum rate of double the basic rate of wages, except as otherwise provided in the May, 1956 revision of the A.G.C., B.C.A., H.B.I., E.G.C.A., A.F.L., C.I.O., Southern California Master Labor Agreement.
Holidays as herein referred to shall be deemed to be New Year's Day, Decoration Day, Independence Day, Labor Day, Armistice Day, Thanksgiving Day and Christmas Day. If any of these holidays are employed holidays other than Labor Day and Thanksgiving Day falls on Sunday, the following Monday shall be considered a legal holiday.
It shall be mandatory upon the contractor to whom the contract is awarded and upon any subcontractor under him to pay not less than the specified rates of wages to all laborers, workers and mechanics employed by them in the execution of the contract.
