UTE Each week and every day we continue to have repercussions from recent Supreme Court decisions which almost with the stroke of a pen destroyed much of the state's rights under the ninth and tenth amendments. One of their decisions practically destroyed the police powers in criminal cases. Practically every state in the Union including our own has had on its statute books for years, criminal sedition acts, later classified as anti-communist legislation. Later the so-called Smith Act was passed by Congress as an over-all piece of legislation to strengthen our fight against com-munism, in areas beyond jurisdiction, such as the District of Columbia, and involving portation of communists, and curb communist activities within the states had failed to act. Smith Act was passed in early 40s and not too many prosecutions were pushed as several states were inforcing own anti-communist laws. There was nothing in the Smith Act which precluded the state from legislating in this field, many prosecutions and co-tions were obtained, including conviction of the ten consortors in California and of them in Pennsylvania. Among these convictions in latter state was that of S. Nelson, also known as Steve Orosh, alias Joe Fleishinger, Louis Evans. He was the Communist Party head in we- Here it is! The Act was passed in the 40s and not too many executions were pushed as the real states were infroncing their anti-communist laws. There was nothing in the Smith which precluded the states on legislating in this field, and prosecutions and convictions were obtained, including the reaction of the ten conspiration in California and of those Pennsylvania. Among these convictions in the state was that of Steve von, also known as Steva Neschh, alias Joe Fleishinger, or Evans. He was the Commist Party head in western Pennsylvania, a member of the National Committee of the Communist Party, and former commislor of red troops in the Spanish revolution. Not in Smith Act The Steve Nelson case was taken to the Supreme Court of the United States, and his conviction under Pennsylvania law was reversed on the grounds that when the Smith Act was passed, the federal government had entered the field of anti-communist and anti-subversion laws, not as supplemental legislation, but as an act pre-empting this field, thus denying the right of any state to legislate in this field and invalidating all existing state laws. This conclusion was reached in spite of the fact that the tenth amendment reserves to the states and to the people all powers not expressly delegated to the fed-eral government, nor prohibited by it to the states. There is no language in the Smith Act which expressly or by implication prohibits the several states from legislating in this field. The Supreme Court in its decision wrote into the law something that simply was not there. This decision practically invalidated the conviction of the ten top communists in California. The legal bulwark against communist activities in this country has always been the police powers of each of the 48 states to enact and to enforce anti-sedition laws. Legislation is now pending in the Congress to invalidate that part of this decision which in effect pre-empts this field of legislation, and which will return to the several states their constitutional right to legislate in this field. Relevant Activity The decision in the Witcass completely destroyed investigative ability of the American Activities Commission on the grounds that 'un-America activity' was a term not clearly defined by the charges. The Un-American Activities Committee, until that date, is amended, as soon it will any witness can refuse to answer any question on the ground that Watkins decision without resorting to the fifth amendment. Certainly communism is American, and therefore any munist affiliation, memorial or activity therein would be avant, even without a clear fined definition of 'un-America activity'. CHOCOLATE CAFE CREME 4 squares unsweetened chocolate ½ cup strong quality coffee 1 cup sugar ½ cup milk 3 egg yolks, slightly boaten 1 teaspoon vanilla 3 egg whites, stiffly boaten ½ cup whipping cream 1 tablespoon sugar ½ teaspoon aromatic bitters Place chocolate and coffee in saucepan. Note: If desired, 1 teaspoon instant coffee dissolved in ½ cup boiling water may be used in place of the strong coffee.
