THE WRIT OF PROBIDITION
You can appeal to a court if you think the legislature has passed an unconstitutional statute or a government decree has acted outside its lawful power. But how do you protest yourself when a court itself goes too far?
"Jurisdiction" is the scope and power of a court to hear and decide a case. Should a court lack jurisdiction and try a case, it cannot properly make a judgment.
The writ of prohibition, a writ of the old English common law, guards us against just such abuse of power by a court. In this writ a higher court orders a lower court to stop acting outside its lawful scope. Thus the courts themselves, like all other branches of the government, must bow to the laws and the constitution.
To keep our court system free of disruption, only a person "beneficially interested," like a party in a law suit may seek a writ of prohibition against the lower court.
Suppose someone sues you in a court which lacks power to hear your case. You may ask a higher court to stop the lower court from acting any further on your case. But if the lower court has already made its final judgment, as a rule, a writ of prohibition will not serve, for you cannot stop it from doing what it has already done. This will aim mainly to prevent, rather than to correct, an action. When a court has already completed an action, you may ask a higher court to connect the wrong in other ways.
What if the judge or any one else to whom the writ is directed misleads so easily? The higher court can enforce its orders and charge him with contempt. His will disdainfulness of public authority punishable at law by fire on imprisonment.
