They returned at 9:30 and again asked leave to raid the temple, and were told to stay away from the place, which was outside of their assigned beat, Casey said. There was some argument with Adams then as Adams said he "wasn't working for Chief Hershey but for the city of Santa Ana". At 10:30 p.m. Grand Jury Foreman Jack Sargent and Vie Walker, chairman of the grand jury's criminal committee, came into headquarters and told Casey, he said, that they had been called, had made their own investigation, and felt that the labor temple should not be raided at that time. The grand jury is now investigating the police department. Later, Adams telephoned, asking transportation be sent to the temple for prisoners, said Casey. Casey reminded him that he had been told not to raid the labor temple. "We did it anyway," Adams reportedly replied. Assistant Chief Harry Fink testified that next day the officers asked him for evidence and permission to obtain a complaint, and were instructed to wait until next day when Chief Hershey, who was ill, would be on duty. They went to the district attorney's office anyway, as private citizens. Another asserted instance of insubordination by Adams was told by Detective LeRoy Walters, Patrolman Gene C. Slavin and Desk Sergeant Charles Leonard. Slavin and Desk Sergeant Charles Leonard. On the morning of Jan. 25, Adams had spotted a stolen car near the YMCA and "staked out" to wait for the thief to return to it. He went to the Y and asked Slavin, who was not on duty, to wait with him. Adams was supposed to go off duty at 7 a.m. Sergeant Leonard said he sent Walters to the scene at 7:50 a.m. to relieve Adams and tell Adams to return to headquarters and make a "pick-up" report. Adams, the witnesses said, refused to leave the stake-out and said he had spotted the car and intended to remain there and get his man. He eventually did so, bringing the prisoner to headquarters at 12:28 p.m. The prosecution, however, stressed that any officer could have done the same, and Adams had disobeyed orders. Patrolman Harvey Dudley, a probationer who joined the force only last Oct. 3, testified that one day shortly before Christmas he was assigned with Pemberton to a prowl car covering the south section of the city. He said that Pemberton, driver of the car, stopped at Officer Hopper's house and remained inside 15 minutes, leaving Dudley in the car. He stopped again at a house on S. Flower st. and remained inside a half hour, with Dudley waiting in the car. Officer Starkey drove by in another car and gave Dudley a "message" for Pemberton, which the witness was not allowed to detail. But when Pemberton got it he went to Starkey's house and went inside for from a half-hour to an hour, Dudley said. On another occasion, Dudley testified Pemberton told him that Chief Hershey was "getting a payoff". Attorneys West and Webb clashed frequently over questions both were asking witnesses. Attorney Lou Blodget, acting as legal advisor for the civil service board, directed the rulings by Chairman Ashen.
