Ordinance No. 94 of the City of Anaheim, entitled, "An Ordinance Concerning the Offenses and Prescribing Penalties Therefor in the City of Anaheim," be amended, by adding a new section thereto, to be numbered Section 14-b, to read as follows: Section 14-b. It shall be unlawful for any person to engage in the business of acting as agent for a principal, who is not within a race track enclosure for the purpose of making a wager within a race track enclosure for such principal, on the result of any horse race held within the State of California, or elsewhere. A person shall be deemed to be engaged in the business of acting as agent who, for any consideration, receives, accepts or offers to receive or accept any money, check or any thing of value for a principal, for the purpose of wagering the same, by means of parimutuel betting, or otherwise, on the results of a horse race, provided, however, that this section shall not apply to a regularly established telephone or telegraph company, which shall forward any money for a customer to a race track enclosure, to be wagered by means of the pari-mutuel system of wagering, where no charge other than the regular toll charge is made by such telephone or telegraph company. The term person, as used in this section, shall mean any person, firm, corporation or association. Any person violating any of the provisions of this section shall be guilty of a misdemeanor, and, upon conviction, shall be punished by a fine of not more than Three Hundred ($300.00) Dollars, or imprisoned in the city jail for a period of not to exceed three (3) months, or by both such fine and imprisonment. SECTION 2. The City Clerk shall cause this ordinance to be published once in the Anaheim Gazette, a weekly newspaper published and circulated in the City of Anaheim, and it shall take effect thirty (30) days after the date of its final passage.
