Deficiency Judgment Abuses Corrected In Edward’s Bill Signed By Governor Rolph Property-Owners of State, Especially Those Victimized by Trust Deed and Mortgage Foreclosures, Will Receive Protection Till 1935 Under Bill Which Combined Several Presented Deficiency judgment abuses, and sales under trust deeds and mortgages between July 1, 1933, and September 1, 1935, will be governed by the property owner relief bill signed by Governor James Rolph late last week. The bill was presented by Senators Nelson T. Edwards of this county, J. W. McKinley of Los Angeles, and Walter Duval of Ventura, and passed in the last session of the legislature. It represents a combination of property relief bills, aimed at reducing abuses developed by trust deed and mortgage foreclosure sales. Governor Rolph, in explaining the merits of the bill, commenced thusly: "Under the new law, notices of trust deed sales must be recorded in every county in which any of the property is located, and notice of default and sale must be mailed to every person who records a request for such notice. This should eliminate the danger of a person's property being sold without his knowledge. Relief Measure "Option is given the debtor at any time before sale or court foreclosure to wipe out the default and reinstate the instrument as though all payments had been made on time. This will enable unfortunate debtors to relieve themselves from default. "The difference between the appraised market value and the amount secured at the foreclosure sale and the debt is made the maximum amount of available deficiency." continued the governor's explanation. "No deficiency judgment can be given on a purchase money trust deed or mortgage on real estate. This should remedy the situation which arises when a person makes a great number of payments on a home and thereafter is unable to keep up the payments. The new law will prevent the creditor from buying the property at bargain rates and suing the debtor for the differ- ence." Default Notice The governor also pointed out that no deficiency judgment can be given if the sale takes place between the date the bill becomes effective and Sept. 1, 1935, unless notice of default is posted a year prior to the sale. This, in effect, means that the debtor cannot be held personally liable for any deficiency unless he has been given a year in which to raise the money. Other bills signed by the governor included: AB 180—Requires that at the top of each group of presidential electors on a ballot there shall be placed the name of the party nominee for president and vice president of that party. AB 311—Requires that misdemeanor charges on complaint against convicted prisoners must be tried within 90 days. AB 337—Requires that rent be received when high school building is used for professional entertainments. AB 408—Imposes same restrictions on prison made goods in other states as California prison-made goods. AB 1154—Restricts purchase by state or political sub-divisions of prison-made goods. AB 971—Amends clothes cleaning establishments act reducing license fee from $12 to $8; removes false advertising as ground for license revocation and requires all cleaners be licensed. History of Anaheim Officially Recorded In Minutes of Anaheim Water Company, Which are Copyrighted, 1932, by Anaheim Gazette, and Printed In Weekly Installments Anaheim Aug. 6, 1870. Meeting of board of trustees called to order by President Zeyn. Minutes of last meeting read and approved. Zanjero reported having given Mr. Schenk the notice sent by board. Treasurer reported having again interviewed the gentlemen adjoining Anaheim and they had promised to meet their obligations, also that he had collected rent from Davis Bros. for City Lot. $30.00. Treasurer reported $149.49 cash on hand, also $426.00 on hand for the original shareholders. Zanjero reported all ditches in good condition, and had built such of the proposed bridges for which he had lumber. Zanjero was instructed to order lumber to complete the bridges ordered in. Regarding complaint about ditch at upper end of lots C and D-1, decided for the whole board to inspect same next Tuesday at 2 p.m. Following bills ordered paid: A. Langenberger, lumber, $78.33; A. Langenberger, sundries, $17.27; zanjero bill for labor, $27.50. Resolved to levy assessment of 25 cents per acre. Secretary instructed to get out notices to that effect also that each city lot using water pay $1.00, any lot on which said amount is not paid by Sept. 10, 1870, shall forfeit the further right to use water from Anaheim Water company. Resolved that standing committee interview Weglein and Polhemus, and charge their time to company. Water sales $12.00. Meeting adjourned. Louis Dorr, Secretary. Anaheim, Aug. 13, 1870. Meeting of board of trustees called to order by President Zeyn. Minutes of last meeting read and approved. Committee reported having inspected ditch at upper end of lots C and D-1 and found same in good condition. Committee interviewed Weglein and Polhemus, and recommended letting that matter rest for a while. Report accepted. Committee composed of Messrs. Zeyn, Dorr, and Schneider reported getting a letter from Gassell & The zanjero was instructed to put following crossings in "first class order" 1st between Bach and Dorr, Rimpau and Strobel, Keller and Boldt. There being no further business meeting adjourned. Water sales $12.00. Louis Dorr, Secretary. Anaheim, Aug. 18, 1870. Special meeting of board of trustees called to order by President. All trustees present. Committee to visit river to determine the highest point from which canal could be constructed to carry water to Anaheim, rejoinmed the following: That the president appoint a committee of three to confer with the Yorbas about a right of way for a canal, then engage a surveyor to lay out a canal to begin below the intake of Yorbas, not above the intake of the Santa Ana Irrigation Co., for the general benefit of Anaheim. The right of way for such canal to two rods wide. The recommendation was adopted, and the president appointed Messrs. Schneider, Strodthoff and Zeyn, said committee to be paid for their time. Mr. Bittner was authorized to confer in Los Angeles with Geo. Hansen, regarding the schoolland warrants, and if he can't get any satisfactory results from him, then to put the matter into the hands of Land Commissioner Mr. Lander, to be brought to some satisfactory adjustment. Mr. Bittner also to search records regarding water rights of the Kraemer ranch, and the part of the same ranch deeded to Don Abel Stearns. Treasurer instructed to give numbers, receipts for installments, and to keep surplus cash of original stockholders for the present. Meeting of board of trustees called to order by President Zeyn. Minutes of Anaheim, Aug. 13, 1870. Meeting of board of trustees called to order by President Zeyn. Minutes of last meeting read and approved. Committee reported having inspected ditch at upper end of lots C and D-1 and found same in good condition. Committee interviewed Weglein and Polhemus, and recommended letting that matter rest for a while. Report accepted. Committee composed of Messrs. Zeyn, Dorr, and Schneider reported getting a letter from Gassell & Chapman advising the Anaheim Water Co. that their water rights would be questioned, by a new company. The above committee went to Los Angeles to consult General Volney E. Howard leaving the matter of protecting the Anaheim Water Co. in his hands. Moved and carried that the board as a committee go to the river next Friday the 18th to thoroughly look over the situation, and select a new intake point for the Anaheim Water Co. canal as far up the river as possible. Secretary instructed to post notice for a general stockholders meeting Sept. 10th, 1870. Bill from zanjero for labor $15.75, allowed. Bill from committee trip to Los Angeles $10, allowed. Zanjero reported all ditches in good condition. Treasurer reported cash on hand $138.39. On hand for original shareholders $406.00. The following formula for receipts of Extension, and 10 acre lots in Anaheim were adopted. $20.00 Anaheim Apr. ... 1870. Received from Mr. Arnold the sum of twenty dollars U. S. Gold coin, for the right of way of water of Lot No. 1, Section G—0 acres in the Environs of Anaheim. Signed Anaheim Water Company, Los Angeles County, Calif. Lot No. 1, Sect. 9—10 acres. Received from Mr. Arnold the sum of dollars on Lot No. 1 in the Environs of Anaheim. The same being an installment of said lot, as called for by resolution of board of trustees, passed Aug. 6th, 1870. Dated Anaheim Signed by Treasurer, Treasurer instructed to give numbers, receipts for installments, and to keep surplus cash of original stockholders for the present. Boege, for hauling $4.75; zanjero labor, $24.00. A bill from V. E. Howard attorney for $100.00 was laid on table to be taken up at a future meeting. Mr. Kuelp was instructed to write Mr. Howard regarding his bill. "Common Council" of Anaheim asked for the use of Anaheim Water company's room for their meetings. Moved and carried that same be granted for 6 months rent free. T. Carrol bought water right of way for lots 32 and 49, 50 acres in the Anaheim Extension, paid first installment $12.50 and give note for $100.00 for 6 months. Dr. D'Assonville paid rent $30.00. Minutes of meeting of 20th and 23rd, read and approved. Committee reported completing the removal of the two bodies from their primary resting place to the new cemetery, committee discharged. Committee to confer with Prudensio Yorba regarding the extension of Anaheim's main canal, that owing to illness of Yorba they had not been able to see him. Zanjero reported ditches and crossings all in good order and bridges over main ditches completed, bill for man at river and labor 45 days, $81.25, ordered paid. Resolved to postpone action on special meeting proceedings for one week. Mr. Zeyn reported being interviewed by committee from Santa Ana Irrigation company, regarding arrangements with Anaheim Water company. Resolved that the board of trustees favored some arrangement, but would leave any action until the regular shareholders meeting, Sept. 10th. Water sales $6.00. Meeting adjourned. Louis Dorr, Secretary. Anaheim, Sept. 3, 1870. Meeting of board of trustees called to order by President Zeyn. Minutes of last meeting read and approved. Committee reported owing to sickness of Don Yorba, same could not be interviewed. Resolved to refer the proposed canal to the general meeting. A petition from Pierce, Mangenburg & Cunningham asking that arrangements might be made where by the Santa Ana Irrigation company might get water out of Anaheim Water company canal, referred to general meeting. Polhemus $1.50 for planter's hoe, ordered paid. Zanjero's bill for labor hereafter of maintaining, repairing and supplying with water said ditch. 4. The management of the said ditch and the control thereof to be left entirely with the Anaheim Water company. 5. That the Anaheim Water company shall always be entitled to preference to the Santa Ana Irrigation company with the amount of water to fill a gate 6 feet by 2 feet dimensions, to be placed at a junction where the Anaheim and Santa Ana Irrigation company ditches separate. 6. Resolved to allow them 8 more days to pay some. The Volney E. Howard bill $100.00 was ordered paid. Common council reported they would rent the zanjero room at $5.00 per month. The adjourned general meeting was called to order by President John P. Zeyn. The following report was read. Report of the committee of the Anaheim Water company appointed to confer with a committee of the Santa Ana Irrigation company. Resolved to have the foregoing report translated into German, Mr. Strobel appointed to do same. After a lengthy discussion between Messrs. Schenk, Lorenz, Kuelp and Scholl for and against accepting the above conditions, Mr. Strobel suggested inserting article 7, to-wit: In case any law suits arise regarding water rights of the Santa Ana river, the Santa Ana Irrigation company to pay half the cost of litigation.
