State Income Tax Headed For Courts Validity of Law Passed By the Legislature Meets With Opposition California's new 4 per cent income tax on banks and corporations is apparently headed for the rocks of litigation, with a possible loss to the state of nearly $1,000,000 in current taxes. A United States Supreme court refusal to grant a rehearing in the case of Macallen company against Massachusetts has brought the situation in this state to a crisis. In the Macallen case the court held that Massachusetts could not "indirectly tax securities of the United States among the earned assets of a company." Under California's new bank and corporation income tax law this state is doing precisely that thing. Just a year ago the state legislature was called into special session to avert somewhat the same problem facing Calfornia today. Litigation had arisen over state taxation of national banks. Although the Macallen case was then pending the tax experts of this state decided to "take a chance" and put through a new law for taxing banks and corporations much like the Massachusetts law which was attacked. As one observer has put it the California experts may have "bet on the wrong horse." The Massachusetts act was declared unconstitutional by the supreme court and now California faces the prospect of having her own act disposed of in the same way. In fairness to the tax experts, it should be explained that leading lights of the nation contend the supreme court reversed itself in the Macallen case. Previous decisions of the high tribunal would indicate that Massachusetts was pursuing an historically charted course in passing the law it did. Even the court itself was divided six to three on the subject. In light of this, California experts had reasonable "odds" in their favor. The next step will be a test case, brought by California for interpretation of its law. Director of Finance A. R. Heron believes that state's law is "sufficiently different" to present a distinct problem to the court. Richard E. Collins, chairman of the state board of equalization, feels the California law is "sufficiently like" that of the discredited Massachusetts law to suffer the same fate. Whatever the result, the question will probably be carried along before a decision is rendered, long enough to supply plenty of political ammunition during the coming gubernatorial election of 1930. On his arraignment before Judge Eldon W. Stark, he was handed a fine of $500 or an alternative sentence of 500 days in the county jail. He was taken to a hospital and it is believed his injuries are serious, but his actual condition was not known at first. Tax Collector Mails Annual Bills More Than Seven Million Dollars To Be Collected By the County Tax Collector J. C. Lamb's office on Monday mailed out 55,000 tax bills of Orange county property owners, and there are still 8,000 in the office that cannot be mailed because the addresses are unknown. These 63,000 property owners will be required to pay a total of $6,305.-683.25 by December 2, or find themselves upon the delinquent tax roll. The sum stated does not include taxes on personal property or securities, known as intangibles, which bring the total tax bill this year to $7,090,634.98. First collections were already rattling into Lamb's cash drawer. A steady pile of mail bags will now start to grow in the office and on December 2 will have reached gigantic proportions. Any property owner who has not received his tax bill by the end of the week, said Lamb, will know that he is one of the 8,000 whose addresses are not known to the tax collector. These taxpayers will be required to apply at Lamb's office for their bill. They should, at such time, bring the legal description of their property, as street numbers are meaningless to the tax department.
