PROCLAMATION AND NOTICE OF SPECIAL ELECTION IN THE MATTER OF THE ISSUANCE OF ONE MILLION, TWO HUNDRED THOUSAND DOLLARS ($1,200,000.00) OF BONDS OF THE COUNTY OF ORANGE, STATE OF CALIFORNIA, FOR THE FURTHER IMPROVEMENT, DEVELOPMENT AND PROTECTION OF NEWPORT HARBOR. STATE OF CALIFORNIA, COUNTY OF ORANGE WHEREAS, there exists in the County of Orange, State of California, at Newport Beach, a harbor, bay, inlet or arm of the sea, commonly called and known as "Newport Harbor," and WHEREAS, under and by virtue of an Act of the Legislature, of the State of California, approved June 17th, 1915, entitled: "AN ACT PROVIDING FOR THE IMPROVEMENT, DEVELOPMENT OR PROTECTION OF ANY HARBOR, BAY, INLET OR OTHER ARM OF THE SEA EXISTING WITHIN ANY COUNTRY TO THE STATE, PROVIDING FOR THE APPOINTMENT OF A HARBOR COMMISSION BY THE BOARD OF SUPERVISORS OF ANY SUCH COUNTY TO HAVE CHARGE AND CONTROL OF THE IMPROVEMENT, DEVELOPMENT OR PROTECTION THEREOF AND THE VOTING, ISSUANCE AND OF THE BONDS OF SUCH COUNTY TO PAY THE COST THEREOF," and all Acts amendatory thereto, the Board of Supervisors of the County of Orange, State of California, have heretofore appointed a Harbor Commission, and WHEREAS, under and by virtue of the provisions of said Act, once in effect of five hundred thousand dollars ($500,000.00) have heretofore been voted by the people of Orange County, and WHEREAS, sald sum of five hundred thousand dollars ($500,000.00) has heretofore been expended under the direction and supervision of said Harbor Commission, and WHEREAS, sald Harbor Commission has filed its final report with the Board of Supervisors, which said report was accepted by sald Board of Supervisors and sald former Harbor Commission was, under the provisions of said Act, automatically discharged and ceased to exist, and WHEREAS, work for the development and protection of sald Newport Harbor has been commenced and accomplished under the above entitled Act, the Board of Supervisors of the County of Orange, State of California, pursuant to the Amendment of said Act, passed and output by the Legislature in the 1924 edition, on the 7th day of October, 1924, at a regular meeting of sald Board, appointing a Harbor Commission consisting of five members, each of whom was and had been for two years prior thereto, a bona fide resident, elector and freeholder of sald County; for the purpose of considering the feasibility of the further development of sald Harbor, and WHEREAS, the members of sald Harbor Commission so appointed by sald County, the sum of one million two hundred thousand dollars ($1,200,000.00), and shall be made the account to be raised by sale of bonds to carry out said plan and system for the further development, improvement and protection of sald harbor is the sum of one million two hundred thousand dollars ($1,200,000.00), and WHEREAS, sald Act hereof referred provides that upon the performance of the several things hereinbefore recited, the Board of Supervisors of sald County, after such steps have been taken, shall without delay, call a special election to determine whether the bonds of such county shall be issued and sold in the amount estimated by the Harbor Commission is called for in the Resolution of the Board of Supervisors, accepting and approving the plans and specifications and report of sald Commission, and WHEREAS, the Board of Supervisors on sald 2nd day of June fixed the 7th day of October 1925, as the day upon which an election should be called for in the county to the voters of Orange County the question of voting bonds as aforesaid for the further development, improvement and protection of Newport Harbor, and WHEREAS, on the 24th day of August 1925, the Board of Supervisors upon a reconsideration of its order requiring the 7th day of October 1925, rescinded sald all of the unanimous vote of sald Board being present and voting, and on sald day by an order duly entered upon the minutes of sald Board, fixed the 7th day of April 1926, as the day for the calling of a special election throughout the county for Orange for the purpose of submitting to sald all of the qualified electors of sald County the question of the issuance of the bonds of the County for the purposes aforesaid, and WHEREAS, the Board of Supervisors on the 2nd day of March 1926, at a regular meeting of sald Board by Resolution rescinded sald all of the qualified electors of sald County the question of issuance of the bonds of the County for the purposes aforesaid, and WHEREAS, sald Harbor Commission in its report recommended the submission of voting bonds to the qualified electors of Orange County in two separate and distinct units: (1) Shall be done by the County of Orange be voted in the sum of six hundred fifty thousand dollars ($650,000.00), for further improvement, development and protection of entrance of Newport Harbor in accordance with the report of Harbor Commission, and (2) Shall be done by the County of Orange issued to the amount of five hundred fifty thousand dollars ($550,000.00), for further development, improvement and protection denomination Of One Hundred Thousand Dollars ($1,000.00), and shall numbered and payable year from date therewith wit: $25,000.00 or saiess shall be payable the date thereof and bond indebtedness amounts of $28,000.00 spectively shall be paid years thereafter until paid. (3) Provided that you to incur a bona fide County to sald County to sald Dollars ($1,200,000.00 forth in said proposition jointly, then and in bonds for said amount shall be divided into bered from one (1) (1200), inclusive, and of the denomination Of One Hundred Thousand Dollars ($1,200,000.00) executive numbered twenty years,and twentieth-(1-2) part and every year until in full. The principal of this interest thereon shall coin the United States Treasurer of this in the City of Santa Clara each of said bonds at the rate of four centum (4½%) per annum annually and evidence pons attached therefor. That noticeofsailed称ledforthe10thdayassetforthintheResolutionAndOnthepurposeofsailednoticeonceaweekforattentiontothesailed electionlipaperpublishedinthetwoit-wit:AnaheimO纸paperisapaperandprintedpublisheverwiththefollowingprecinctsofdesignationofthecounty($1,000.00),andshallnumberedandpayableyearfromdatetherewithwit:$25,000.00or saiess shallbe payablethedate thereofand bondindebtednessamountsof$28,000.00 spectively shall be paid years thereafteruntilpaid. WHEREAS, the members of said Harbor Commission so appointed by said Board of Supervisors, duly qualified in the manner and within the time prescribed by law, and thereafter duly organized in conformity to law, and did proceed with an intelligence to cause a prosecution to be made of that said Harbor, bay inlet or arm of the sea, same being located within the County of Orange and commonly called Newport Harbor, that being the harbor designated to be further improved, developed and protected, and WHEREAS, said Harbor Commission did after a careful survey investigation and identification of said Harbor and report to the Board of Supervisors of said County that said Harbor can be further improved, developed and protected and that the public will be benefitted by such further improvement, development and protection and that the cost thereof will not be disproportionate to the benefits to be delivered therefrom and provide detailed applications for the best and most feasible plan and system for the further improvement, development and protection of said Harbor and estimated the cost thereof and the amount to be raised by the issuance and sale of said bonds of said County. In-wait: for sum of ONE DOLLAR ($1,200,000.00) to do the work of further improvement, development and protection, and did make a full, complete, comprehensive and final report of its investigations and examinations and filed the same, together with said detailed plans and specifications with the Board of Supervisors of said County on the 4th day of April, 1925, at which time said Board of Supervisors, by an order duly made and entered on its minutes, fixed the time for the hearing on said report for the 12th day of May, 1925, at the hour of two o'clock, P.M., at the Chambers of the Board of Supervisors, in the Court House at Santa Ana, which said date was not known but less than twenty days after the filing of said report, and caused notice of the fact that said report has been filed and that the hearing thereof had been set for the 12th day of May, 1925, to be duly published in accordance with law, which publication was duly made, as will more fully appear from the minutes of publication no later than in the office of the Clerk of the Board of Supervisors, and WHEREAS, on the said 12th day of May, 1925, the matter of said report coming on regularly for hearing, pursuant to the Order for the hearing upon said report and the notice thereof duly published as required by law, at which time this protest against the occurrence of said report were heard, and it was ordered by said board, by an order duly made and entered on its minutes on said 12th day of May, 1925, that further hearing of said report be continued to the 19th day of May, 1925, at the same hour and place, and WHEREAS, on the said 19th day of May, 1925, after a further hearing and consideration of said report of said Harbor Commission, the Board of Supervisors, by an order duly made and entered on its minutes on said 19th day of May, 1925, ordered that a further hearing of said report be continued to the 2nd day of June, 1925, at the same hour and place, WHEREAS, on the said 2nd day of June, 1925, after further hearing and consideration of said report of said Harbor Commission and after hearing all the protestants protesting against said report WHEREAS, work for the development and protection of said Newport Harbor has been commenced and accomplished under the above entitled Act, the Board of Supervisors of the County of Orange, State of California, pursuant to the Amendment of said Act, passed and enacted by the Legislature in June 1924, did on the 7th day of October, 1924, at a regular meeting of said Board, appoint a Harbor Commission, consisting of five members, each of whom was and had been for two years prior thereto, a bona fide resident, elector and freeholder of said County, for the purpose of considering its responsibility for the further development of said Harbor and. The question is whether there is any evidence that suggests a need for a fee related to was ordered by said board, by an order duly made and entered on its minutes on said 12th day of May, 1925, that further hearing of said report be continued to the 19th day of May, 1925, at the same hour at place, and WHEREAS, on the said 19th day of May, 1925, after a further hearing and consideration of said report of said Harbor Commission, the Board of Supervisors, by an order duly made and entered on its minutes on said 19th day of May, 1925, ordered that a further hearing of said report be continued to the 2nd day of June, 1925, at the same hour and place, and WHEREAS, on the said 2nd day of June, 1925, after further hearing and consideration of said report of said Harbor Commission and after hearing all the protestants protesting against said report and after further consideration of said report and said plans and specifications, said Board of Supervisors being audited with their compassions and adopted a Resolution accepting and approving said report, plans and specifications for the further improvement, development and protection of said Harbor, and designated said Harbor by the name of "Newport Harbor," same being the name by which said Harbor is commonly called and further resolved that the plan and system to be improved used in the further improvement, development and protection of said Newport Harbor shall consist of the following work, to-wit: (1) Building a jetty on the east side of the entrance to said Harbor, 1500 feet long, in accordance with the detailed plans and specifications of said Harbor Commission with file in Clerk. (2) Regarding the jetty on the westier said of the entrance to said Harbor, in accordance with said plans and specifications. (3) Building the necessary revvements to said jetties, in accordance with the plans and specifications, afforesaid. (4) Dredging an area afloat 300 feet wide and 25 feet deep. (5) Dredging an area at the turn in accordance with the plans and specifications. (6) Dredging the channel across said bay and harbor in accordance with said plans and specifications. (7) Deepening the turning basin already dredged on said harbor in accordance with said plans and specifications. (8) The construction of a wharf and equipment in accordance with said plans and specifications. (9) Dredging an anchorage area of seventy acres in said harbor, in accordance with said planks and specifications. All of the aforesaid work to be done and all of the materials to be furnished therefor to be done and furnished in accordance with the detailed plans and specifications attached to and made a part of the report of the Harbor Commission, now on file with the Board of Supervisors of said Orange County. And said Board further Resolved at said time that the estimated cost of said further improvement, development and protection of said Newport Harbor, according to the plan and system recommended by said Harbor Commission is (1) Shall the bonds of the County of Orange be issued to the amount of $550,000.00 for the further development, improvement and protection of the interior of Newport Harbor, in accordance with the report of the Harbor Commission? That the ballots to be used at special election shall contain the words: "(1) Shall the bonds of the County of Orange be issued to the amount of $550,000.00 for the further development, improvement and protection of the interior of Newport Harbor, in accordance with the report of the Harbor Commission." shall be printed the words: "Bonds yes" "Bonds no," with voting squares to the right of and opposite to said words and the voters shall choose their choice by stamping a cross in the square opposite and to the right of the answer they desire to give, and there shall follow on said ballots the following words and figures, to-wit: "(2) Shall the bonds of the County of Orange be issued to the amount of $550,000.00 for the further development, improvement and protection of the interior of Newport Harbor, in accordance with the report of said Harbor Commission." and to the right of the answer they desire to give to the question: That the bonds for the purpose of the further improvement, development and protection of said Newport Harbor shall be divided as follows, to-wit: (1) Provided that if the electors at sale election shall vote to incur a bond indebtedness of the said County to the amount of $550,000.00 set forth in said voters' proposition to be submitted to said voters' then and in that event, bonds for sale amount of $650,000.00 shall be divided into 650 bonds numbered from one (1) to six hundred fifty (650), inclusive, and each bond shall be of denomination ONE THOUSAND DOLE LARS ($1,000.00) and shall be consecutively numbered and payable within twenty years from date thereof, as follows: to-wit: $33,000.00 of said bond indebtedness shall be payable in one year from the date thereof, and $32,000.00 of said bond indebtedness shall be payable in two years from the date thereof, and sald amounts of $32,000.00 respectively shall be payable in alteration thereafter until all of sald bonds are paid. (2) Provided that the electors at sale election shall vote to incur a bond indebtedness of said County to the amount of $550,000.00 as above set forth in said second proposition to be submitted to said voters' then and in that event sald bonds for sale amount of $650,000.00 shall be divided into 550 bonds numbered from one (1) to five hundred fifty (650), inclusive, and each bond shall be of the ANAHEIM GAZETTE re-printed and re-admitted denomination of One Thousand Dollars numbered and payable within twenty years from date thereof, as follows: wit: $28,000.00 of said bonded indebtedness shall be payable in one year from the date thereof and $27,000.00 of said bonded indebtedness shall be payable in two years from the date thereof and $27,000.00, respectively, shall be payable in alternate years thereafter until all of said bonds are paid. (3) Provided that the electors shall vote to incur a bonded indebtedness of said County to the amount of ONE HUNDRED THOUSAND DOLLARS ($1,200,000.00), as above set forth in said propositions one and two jointly, then and in that event, said bonds for said amount of $1,200,000.00 shall be divided into 1200 bonds numbered from one (1) to twelve hundred (1200), inclusive, and each of the denominations of ONE HUNDRED THOUSAND DOLLARS ($1,200,000.00), and shall be consecutively numbered and payable within twenty years, and shall be payable on twentythree (1-20) part of said bonds each and every year until all of said bonds are paid. The principal of sald bonds and the interest thereon shall be payable in gold coin of the United States at the office of the Treasurer of the County of Orange, in the City of Santa Ana, California, and each of sald bonds shall draw interest at the rate of four and one-half per centum (4½%) per annum, payable semiannually and evidenced by interest coupons attached thereto. That statement is practicable, in conformity with the general election laws of the State of California, and none but qualified voters of the said County of Orange shall be permitted to vote thereat, and at special election the polls must be opened at six o'clock in the morning of the day after save o'clock in the afternoon of said day, when the polls shall be closed.
