NO DINERO FOR STANTON
New Town Will Get No Drawdown From Road Funds
The new town of Stanton will not get any money from any road fund of this county. This is the decision of County Auditor Lester, based upon an opinion given him by Deputy District Attorney Koepsel.
The new town, formed in order to defeat the plans of Anaheim to establish a sewer farm at Magnolia, southward of Anaheim, started out with money in the treasury put there by subscription, of which amount the most came from P. A. Stanton, property owner there, last summer a candidate for the republican nomination for governor.
The trustees of Stanton counted on getting a goodly sum from the county. As they understood the law, that section of the country placed inside the incorporation would get its pro rata, according to assessment of whatever road funds existed at the time of incorporation attached to any road district from which territory was drawn by the new town. That was also the understanding of the Board of Supervisors, which on Thursday ordered that warrants be drawn in favor of the town and against the road districts as follows: Anaheim $99.26, Buena Park $78.45, Garden Grove $611.39, Westminster $116.36; total $907.46.

COURTHOUSE NOTES
In the superior court on Friday a judgment by stipulation was entered for $375 in favor of the plaintiff in the suit of J. H. Lawrence against Leonard Poston. Lawrence sued for commission on a real estate deal.
George W. Angle, appointed by the board of supervisors to expert the county books, began his work the first of the week. The experting will take between six and eight weeks.
Certificates were filed with the county clerk this week showing that the Southern California Edison Co. has changed its principal place of business from Chino to 120 E. Fourth street, Los Angeles. The company probably established its principal place of business at Chino originally to avoid payment of the heavy corporation tax formerly levied in Los Angeles.
UNION OIL'S BIG MORTGAGE
One of the biggest documents ever recorded in this county was put on record the past week. The document is a first lien trust indenture from the Union Oil Co. of California to the Equitable Trust Co. of New York and the Los Angeles Trust and Savings bank. The recording fee was $114.50. The document comprises 193 printed pages...
The indenture was signed January 2, 1911. It is given as surety of $20,000,000 first lien, five per cent, twenty-year sinking fund bonds. The trust deed is for a long list of property, mostly in California, and includes the Union Oil Co. holdings in the Fullerton field in this county, a small part of the Union Oil Co. holdings in the state.
The entire document must be copied in the office of Recorder Peters.

Auditor Lester was not certain that the right construction had been placed on the law. He believed that the new town had no right to any road money except its pro rata of the general road fund of the county. The auditor asked the district attorney's office for an opinion as to the legality of the payment of the warrants ordered by the supervisors, and Deputy Koepsel looked up the law and gave the auditor an opinion that means that Stanton will get no money from any road fund. The law is that, the pro rata must be made from the general road fund only, and since Orange county has no general road fund no pro rata can be made.
Koepsel's opinion as delivered to the auditor, and sent by the auditor to the trustees of Stanton, notifying them of the invalidity of the warrants for $907.46, follows:
On the 6th of July, 1911, the board of supervisors of Orange county passed a resolution directing the auditor to draw warrants on the Buena Park road fund, the Garden Grove road fund, the Westminster road fund and the Anaheim road fund, to be paid to the city of Stanton as their pro rata of road funds due at the time the said city of Stanton was incorporated; thereafter the county clerk issued his warrants therefor, and these will be presented to you in due course of business.
Section 2651 of the Political Code provides: "The board of supervisors may, at the meeting at which they are required to levy the proper tax for road purposes, establish a general road fund and order to be apportioned thereto an amount not exceeding 35 per cent of the aggregate road tax collected from all sources."
Section 2656 of the Political Code provides: "Whenever any territory included in a city, or incorporated town, or city and county, either at the original incorporation of such city, incorporated town or city and county, or by annexation thereto subsequently, and such territory shall have constituted a road district, it shall be the duty of the county board of supervisors as soon as practicable after such incorporation or annexation to ascertain how much of the unexpended money in the general road fund or of the highway taxes of all kinds then levied and in the course of collection, is derived from property situate or persons residing in such territory; and they shall cause the amount so ascertained to be paid to the proper officers of said city, incor-

MODENA LODGED IN JAIL

Constable Nabbed Him
Jose Modena has learned that hanging around the county jail is dangerous. He tried it Friday night about 7 o'clock, and landed in jail, and once landed in jail he found himself confronted with a charge of burglary. Deputy Sheriff Boynton caught Modena trying to talk to a prisoner through a jail window, and made short work of getting Modena behind the bars.
Francisco Garcia, a Mexican, was placed in jail Thursday on a charge of having stolen a gold watch from Ray Richards, a roomer at the Allerton hotel in Santa Ana, on June 18. Garcia was celebrating the Fourth in Los Angeles and was arrested. The watch was found in his pocket, and the Orange county sheriff was informed.
Garcia declared he was innocent of theft. He said he bought the watch of Jose Modena for $15.
Friday night Deputy Sheriff Boynton was leaving the jail to walk to Fourth street when he started to make a journey around the jail. At the northwest corner he espied a man evidently talking to someone in the jail. The man saw Boynton almost as soon as Boynton saw him, and he started south on Broadway. Boynton ran south on Sycamore, and when he reached Sixth he cut through back of the library, and caught the Mexican. The fellow declared his name was Rodriguez, and he protested loudly when the officer led him back to jail.
Boynton had a "hunch" that the man was Modena, and he took him before Garcia. The latter immediately identified him as the man who sold the watch, and then the fellow says the Santa Ana Register, admitted his name was Modena. Garcia said that Modena had called to him from the outside of the jail, telling him not to give him (Modena) away as having sold the watch.

quently, and such territory shall have constituted a road district, it shall be the duty of the county board of supervisors as soon as practicable after such incorporation or annexation to ascertain how much of the unexpended money in the general road fund or of the highway taxes of all kinds then levied and in the course of collection, is derived from property situate or persons residing in such territory; and they shall cause the amount so ascertained to be paid to the proper officers of said city, incorporated town, or city and county, as soon as practicable after it shall have come into the general road fund. The sum or sums so paid over to such city, incorporated town, or city and county, shall become part of the general fund of such city, incorporated town, or city and county."
As I am informed that last year there was no general road fund created by the board of supervisors, and that there is not now any highway taxes of any kind levied and in the course of collection for said fund in said incorporated town. The law only allows the board of supervisors to pay to the incorporation the money which are available in the general road fund and not out of the particular road funds of these road districts, which were previously included in the incorporation.

FULLERTON IS GROWING
Postal Receipts Assure Free City Mail Delivery Next Year
Official figures for the fiscal year ending July 1, 1911, show that the Fullerton city postoffice has entered the rank of free mail delivery cities, the total receipts for the year just ended being $10,069.34. The total receipts for the year ending July 1, 1910 were $9168.40. Postmaster Edwards is confident that Fullerton will have free mail delivery by the first of April or May of next year. There has been a notable increase in the receipts in the past few months owing to the increased business brought in by new companies operating in the oil fields of the Fullerton district.
The assessed valuation of the city of Fullerton for 1911 is $1,563,995, an increase of $242,995 over the valuation of 1910. The increase is due to advance in property values all over

Local beet growers have commenced harvesting their crop and the Los Alamitos company opened their scales on Tuesday for the purpose of handling and shipping the beets from the Park.

the city, but the next twelve months is certain to bring about a much higher assessed valuation, especially for the hill property adjacent to the oil fields.
Another excellent showing for the city is the increase in bank deposits in the two local institutions, the First National and Farmers & Merchants, which have gained from 25 to 52 percent over 1910. The First National is spending a large sum of money in improving their bank building.
The city trustees have issued the final call for the issuance of $150,000 of bonds for the construction of oil macadam roads in the city and the building of several concrete bridges. The date set for the election is August 19th.

Beet harvest began yesterday, the steam has been turned on at the sugar works and the army of men required in field and factory are lining up for work. Everything is in readiness for the sugar making campaign. Delivery of beets at Buena Park begins the eleventh, and at the factory by cars and team on the twelfth. Slicing will begin the fifteenth, and twenty-four hours thereafter white sugar will be pouring into the sacks in a never ending stream to last until all the beets are harvested from the thirteen thousand acres under contract. The larger proportion of these will be delivered by team within a radius of a few miles from all directions, shipments by rail being six carloads daily from Buena Park and Smeltzer.
Following the stream of money to be expended for labor and raw material, there will be directed in to the channels of trade many thousands of dollars which, passing from hand to hand will contribute to the prosperity of all the people.
As only native labor is employed, contrast this with the benefits this country is able to receive from the money sent to the tropics for cane sugars and it needs no argument to show the importance of patronizing the home industry which eventually will keep the two hundred million dollars annually expended for sugar circulating amongst our own people.
S. H. Smith is remodeling and making additions to the house he recently purchased from F. L. Norton, which he and his family will soon occupy. The J. L. Elam house, which he vacates, has been purchased by S. D. Sutton.

The California National Bank of Santa Ana purchased last week $1800 bonds of the Delhi school district. The bid of the bank, of $5.50 premium, was the only one received by the board of supervisors.
Under a state law which makes the appointment of a matron at the county jail mandatory, the board of supervisors made an appointment, naming Mrs. E. W. Boynton, wife of the deputy sheriff in charge of the jail. Her salary will be $1.50 a day.
