INCORPORATION FIGHT (Contined from Page Two) "In California the sewage of a number of communities is being successfully treated by broad irrigation both on municipally owned and on privately owned acres. At some places, notably Fresno, considerable competition in securing rights to the use of different quantities of sewage for irrigation has developed on the part of private land owners." Dr. Wills voluntarily corresponded with Dr. N. K. Foster of Oakland, the highest medical authority in the State, on the question of sewage disposal, and who was for seven years the Secretary of the State Board of Health and its Executive Officer, and received from Dr. Foster the following communication with permission to give it the utmost publicity: Oakland, Cal., April 2, 1911. My Dear Doctor Wills: I received your letter last night and it seemed good to hear from you again. I will hasten this morning to give all the information I can. The first year I was in the board of health, they put in a tank at the Ukiah State Hospital. They changed their plan to suit us and five years later it was working perfectly with almost no odor. The year before I left Dr. Regensburger and wife with a medical friend of his and wife, my wife and myself were there. I arranged to take them to ride saying I wished to show them a "mineral spring." Of course Dr. R. knew, but the others thought nothing of it; saw the water, clear and almost odorless, coming from the "springhouse," and it looked all right; no one could discern an odor a rod away. At the Glenn Ellen Feeble Minded Home, the results are not as good, because they would follow the advice of a man who didn't know, against the advice of our board. Still it is within a few rods of the farm house and gives no great trouble. At the Southern California State Hospital a small one was installed perhaps 200 representations to the contrary were made to him at the time the opinion was sought, and there and then declared his intention of refusing to consummate the deal. Recently, when the second payment became due and the money was tendered to Mr. Gilbert, he refused to accept it and stands manfully by this decision to protect his neighbors to prevent the perpetration of this outrage in the very heart of one of the choicest and rapidly developing sections of Orange County. Anaheim well knew it could not obtain a site for this sewer farm if it declared its intention as to what use it would make of the property sought to be purchased, so it had to resort to subterfuge to obtain the site. Anaheim did not evidence any consideration for the welfare of the population of the district which now intends to oppose the consummation of the deal and purpose that would forever destroy the pecuniary and physical value of both property and person. Vigorous Effort Will Defeat Anaheim Prominent attorneys advise that there is no question but that the Mayhew option can be defeated in the courts. But when this is accomplished, what is the result? Anaheim wants a site for a sewer farm. Under the laws of this State it has the right of "eminent domain;" that is, the right to condemn property for any municipal use. If defeated in its attempt to secure the Gilbert site, it can, through the courts condemn any land which it finds to suit its purposes, and it is in this possibility that the danger lies. It is not the intention of the people so threatened to permit this nuisance to be established near their homes, without a concerted vigorous effort to prevent it, and if each voter within the proposed limits of the territory will avail himself of his rights under the law, the attempt to foist this menace to the public health and welfare upon our community will fall, and this should be fought for with all the persistency and tenacity possible to command. Under our directions one was put in at the County Hospital in San Diego and while close up to the building gave no trouble. I am not informed how well the Reform School's tank at Whittier works. You can easily find out. Where there is porous soil to care for the water it is an ideal way to dispose of sewage. The putresible matter is almost entirely used up and the water left tolerably clear. At Ukiiah where we put in two tanks, it was clear and stock preferred to drink it rather than well water. The effluent should not be allowed to stand in pools in the sun, any more than other water should. Personally I would not object to having a septic tank close up to my residence and the outfall on the ranch, providing it was properly built and managed. As I remember the conditions of soil at Anaheim it is an ideal place for this system. They never have been a nuisance where properly handled and never will. The only criticism I had from the State institutions was from the S. California State Hospital where they said the effluent was full of bacteria. Funny, isn't it, that the effluent of a tank where bacteria destroy the organic matter should be full of them. It simply shows how little even some educated men know of what they are talking. They are now, and have been, in the employ of the State and have not been employed or paid for the opinions given; but their advice and counsel has been along the line of their official duties with but one object in view: The public health and general welfare of all the people. We have also consulted with Mr. H. Clay Kellogg, himself an owner of property in the vicinity of the proposed town, who has concurred with above authorities on the question. An opportunity and vehicle for averting this outrage and calamity to the prescribed territory is to be found in the election called for Tuesday, May 23, 1911, when the voters within the boundaries of the proposed town shall vote on the question of incorporating for the protection and preservation of their homes and health, and every voter should look to his interests in this particular. Now is the time to act. It will be too late if favorable action is not had on the date named. It's our only hope to guard our interests and insure the future of our homes and people. Don't be misled by any statement of those who will be benefited by making our community the dumping ground of all their sewage and filth. Our interests are as paramount as those of the people of Anaheim. The decrease in value of your holdings will be much more vital to your prosperity than any expense that the support of municipal control will devolve. By voting incorporation, you forever safeguard your health and wealth. By failing to do so our community interests are continually at the mercy of the other incorporated citizens of the county. If Not the Gilbert Site, Then Where? Every foot of land within the proposed City of Stanton is lower in elevation than Anaheim, and sewage from that city could be turned upon any and every acre within such proposed bounds. Therefore, none of us are secure from this pest, unless we do incorporate. No one can foretell the next step to be taken by the City of Anaheim. It is impossible to state what direction that city may turn to establish a sewer farm. The property of the individual that may be remote from such a nuisance today may be brought in close relationship when Anaheim seeks other sites. The only protection for the territory now being menaced is to adopt that of incorporation. The man who today lives sufficient distance from the Gilbert site to warrant active opposition may be seeking the assistance of his more fortunate neighbor to keep such a pestilence as a sewer farm from his home at a later date, when the Gilbert property is abandoned for the purpose, and it surely will be. Take no chances. Put your stamp of opposition and disapproval upon this outrage by voting incorporation—the one sure means of safeguarding your interests. Anaheim's Subterfuge In the latter part of January, 1911, the people living within the territory embraced within the lines of the proposed town of Stanton were astounded to learn that by cleverly veiled negotiations the City of Anaheim had obtained an option upon the property of J. M. Gilbert, in Section 19, Township 4 South, Range 10 West, and intended to purchase the same and use it for sewer-farm purposes. Investigation showed that one J. P. Mayhew had obtained this option in his own name from Mr. Gilbert. When Mr. Gilbert was waited upon by a committee of citizens from the territory that would be affected by the establishment of such a public nuisance in their midst, he declared he had no idea that the land was wanted for any such purpose when he gave the option referred to. In fact, he (Mr. Gilbert) stated that Take no chances. Put your stamp of opposition and disapproval upon this outrage by voting incorporation—the one sure means of safeguarding your interests. If you are indifferent as to the welfare of your neighbor and your own health, vote against incorporation. If you believe in reciprocity and the greatest good to the greatest number, put your fighting clothes on and work and vote for incorporation. The sewer farm will never be located on the Gilbert property. Where will it go? Yes, where? If you do not care where it goes, and would be willing to have it as a neighbor, vote against incorporation. If you want to insure yourself against it and assure the health and happiness and possibly the lives of your loved ones—vote for incorporation. People's Rights Under Constitution The Constitution of California gives every community the right to govern itself, subject only to the limitations prescribed by the constitution and the laws of our state. This right is given us for the reason that different conditions surround practically every community, which cannot be regulated by laws enacted by the legislature. The framers of our constitution very wisely permitted local self government, and the laws of our state bestowed upon these communities the right to frame laws for their own government. Hence, by forming a municipality of our own, we have the right to regulate our own community, mipose ouon ourselves such regulation as we see fit to make, and prevent outsiders or distant law making bodies to regulate our own community fir us, or trespass upon our inallenable rights as citizens. The Santa Fe is capitalized at $53,000 per mile of line, while in England the average capital is $274,000 per mile, in Germany $111,000 per mile, in France $140,000 per mile, in Canada $69,500 per mile, in the United States $58,000 per mile. During the year ended June 30th, 1910, the Santa Fe gross earnings were $107,543,250, and its expenses were as follows: Operating Expenses... $71,082,238.00 from the department of Colorado and form part of the department of California. Montana and Wyoming go from the department of Dakota to the department of Columbia. The headquarters of the grand divisions will be at Governor's Island, New York, for the Eastern division; Chicago for the central division, and San Francisco for the Western division. The State of Louisiana is transferred from the department of the gulf to the department of Texas. North and South Dakota, formerly included in the department of Dakota, and Missouri are transferred to the department of the lakes. New Mexico, Arizona and Utah are detached.
