BOMBSHELL EXPLODES IN WESTSIDERS' RANKS WHO THREW THIS BRICK AT TOWN INCORPORATION Error in Published Notice of Call for Hearing by Supervisors Sets Over Matter for a Month—Magnolia Improvement Association Seeking to Discover Whose Fault It Is—Text of Petition and Names of Signers—Error Pointed Out Consternation stalked rampant among forces of West Side incorporators this week when it became known that error had crept into their proceedings, and that their hearing before the supervisors had thereby been deferred a month. Time is precious to the incorporators, for a spirit of rebellion to the new town is manifesting itself, and a month's more time will give the latter opportunity for gathering strength in their effort to keep out of the proposed town. So when it became known that all proceedings had to be gone over again, the effect was like unto a forty-pound torpedo exploding in the midst of the incorporators. A meeting of the Magnolia improvement association was called for Monday, when the matter was discussed in detail. It is as yet impossible to say where responsibility for the error lies, but that the West Siders will probe the matter to its depths is altogether undisputed. Error occurred in the published call of the supervisors, fixing date for hearing application for incorporation as "Tuesday, April 5." A reference to the calendar shows there is no such date. If such support for the forestry measure was solely on this cooperative and friendly basis the west built better than it knew. As a matter of fact the passage of this measure establishes a principle of great importance to California as well to every region drained by navigable rivers. This principle recognizes the propriety of purchase by the federal government of any forested (or deforested) watershed, the control of which may be necessary to preserve the flow of any navigable stream, or its tributaries, in any portion of the United States. Both of the California senators voted for the bill and of them at least it can be said that they fully recognized its possibilities as applying to California. Senator Flint in a private conversation stated that he favored the measure both from a national standpoint and because it established a principle of great importance to Southern California although this did not as yet go far enough to cover the necessities of this section of the country. Purchase under the Appalachian act is limited to the forested areas on the headwaters of navigable rivers. But the rivers of Southern California on the Pacific slope are not navigable and yet on the headwaters of these streams there are many areas, some of them entirely surrounded by national forests, which are in private ownership and liable to be denuded and deforested with great resulting harm to the water supplies. The federal government not having as yet established the policy of buying lands for the purpose of putting them into national forests has been unable to acquire these lands and they are likely to remain in private ownership subject to destruction by timber cutting unless some way can be found for them to be purchased by the government. The Appalachian national forest bill was a great step forward in that direction but it does not go far enough. The next and final step, however mentioned by Senator Flint as army engineers, the geological survey, the reclamation service, the forest service, etc. It will be reintroduced by Senator Newlands and immediately upon the convening of the new congress will be aggressively supported by the national irrigation association which was an active factor in the campaign that resulted in the passage of the national irrigation law in 1902. Senator Perkins' support of the Appalachian bill was in accord with his well-known friendliness to all sound water and forestry legislation, and in this instance he was assisting legislation directly in the interest of northern California. The Appalachian bill has a very wide and far-reaching influence in its application to everything in California north of the Tehachapi mountains and lying on the westerly slope of the Sierra Nevada mountains. The entire interior valley and the watersheds of the Sacramento and San Joaquin rivers and all their tributaries, including Kings river, are on the headwaters of navigable streams, and for that reason the Appalachian bill is applicable to them. Of course the fund created by that bill would not be large enough to permit of a great deal being done in this section of the country under that particular measure but it is a tremendous advance in the declaration of an entirely new policy. As Senator Burton said in his speech in opposition to the bill, if the government is to enter upon a policy of preserving forests to protect the waters of the navigable rivers, it should also protect from floods, and that point brings in the whole Sacramento and San Joaquin valleys and all the overflowed lands in those valleys. The Newlands bill provides all the machinery and all the money that is necessary for a complete solution of that problem.
