The penalty for burglary in the first degree, that means burglary during the hours of night, is not less than one year nor more than fifteen. For second degree burglary, which means daylight burglary, the penalty is not less than one year nor more than five years. Judge West said that because of a doubt in his mind as to the exact hour the burglary was committed, he would make the sentence the maximum for second degree burglary. Keene asked permission to say something in his own behalf and when his request was granted he begged for a "chance," saying he had just arrived in California when the crime was committed, and that he had to steal to make a living.
