Ordinance No. 205
An ordinance providing for the licensing and regulating of the business of selling liquors in the City of Anaheim, and repealing all ordinances in conflict with the provisions of this ordinance.
The Board of Trustees of the City of Anaheim do ordain as follows:
Section 1. For the purpose of this ordinance a wholesale liquor establishment is declared to be a place where spirituous, vinous, malt or mixed intoxicating liquors are sold, served or given away in quantities of not less than one-fifth of a gallon, and where such liquors are sold, served or given away not to be drunk on the premises where so sold, served or given away; and any person who, as owner, agent, or otherwise conducts or carries on, or assists in conducting or carrying on any such a place or establishment, the same being conducted or carried on either exclusively or in connection with, or as a part, department or branch of any other business or occupation, is for the purpose of this ordinance declared to be carrying on the business of a wholesale liquor dealer; provided, however, that the definitions herein given shall not apply to the sale by druggists for medicinal purposes only, upon prescription in writing given by any regularly licensed physician, of any of the articles herein enumerated, nor to any drug store licensed to sell liquors in the quantities and manner herein after provided.
Section 2. For the purpose of this ordinance, a retail liquor establishment is defined to be: First, any place where spirituous, vinous, malt or mixed intoxicating liquors are sold, served or given away by the drink or glass. Second, any place where spirituous, vinous, malt or mixed intoxicating liquors are sold, served or given away in any quantity to be drunk, either upon the premises or elsewhere, or any such place where such liquors are sold, served or given away in quantities of less than one-fifth of a gallon; provided, however, that the definitions in this section given shall not apply to any restaurant or eating place where liquors are sold; served or given away as a part of any bona fide meal, in regular sealed packages, containing not less than one pint as hereinafter provided for, such restaurant, being duly licensed thereto; the term "bona fide meal" for the purposes of this ordinance is defined to be such a quantity and class of food as is ordin-
Section 9. The owner, proprietor, man or other person having charge or control of any saloon, tippling house, sample room, cery, or other place where spirituous, malt or mixed intoxicating liquors are given away, either at wholesale or recepting restaurants or drug stores, securely close and lock all entrances and from any such place, or cause the same so closed and locked, and to keep the such condition against the entry or expersons other than the owner, proper manager thereof, or the servants employed in and about the same, between hours of 12 o'clock, midnight, on Saturday and 5 o'clock A.M. of the following Monday and between the hours of 12 o'clock night, and 5 o'clock A.M. of each day of the week other than Sunday.
It shall be unlawful for the owner, tor, manager, or other person having control of any saloon, tippling house ple room, grocery, or other place where spirituous, vinous, malt or mixed intoxicating liquors are sold or given away, excepting restaurants or drug stores, to permit any person, other the servants regularly employed in and the same, to enter, remain or be there between the hours and during the times before mentioned.
It shall be unlawful for any person than the owner, proprietor, man other person having charge or control saloon, tippling house sample room, or other place where spirituous, vinous or mixed intoxicating liquors are given away either at wholesale or receptive restaurants or drug stores, to remain or be in any of such enquiries between the hours and durings hereinbefore mentioned.
Section 10. No retail liquor dealer's shall be granted for the sale of spirituous, malt or mixed intoxicating liquors other than in a room situate on the floor and fronting on a public street front doors of such room shall have transparent window glass, beginning more than four feet from the level of walk in front thereof and rising to a foot not less than seven feet above them such sidewalk, and such window glass be so placed in said doors as to permit and unobstructed view of the whole room in said room when looking through glass from the outside of said doors.
Between the hours of 12 o'clock, midnight it shall be unlawful to place ed to be placed, or permit to be placed maintained, any screen, blind, shuttain partition device or obstruction ever in said room, or on or in front doors which shall interfere with or in any manner the view through the said doors of the said room and therein. The bar or bars in such room be so placed therein that an unobvious view of such bar or bars, and the whole of can be had by looking through these said doors.
Section 11. No retail liquor dealer's shall be granted for an establishment conducted outside of the following
vinous, malt or mixed intoxicating liquors are sold, served or given away by the drink or glass. Second, any place where spirituous, vinous, malt or mixed intoxicating liquors are sold, served or given away in any quantity to be drunk, either upon the premises or elsewhere, or any such place where such liquors are sold, served or given away in quantities of less than one-fifth of a gallon; provided, however, that the definitions in this section given shall not apply to any restaurant or eating place where liquors are sold, served or given away as a part of any bona fide meal, in regular sealed packages, containing not less than one pint as hereinafter provided for, such restaurant, being duly licensed thereto; the term "bona fide meal" for the purposes of this ordinance is defined to be such a quantity and class of food as is ordinarily served for consumption in establishments maintained for the purpose of selling or serving meals; and, provided further, that neither of the definitions herein given shall apply to the sale by druggists, for medicinal purposes only, upon a prescription in writing given by any regularly licensed physician, of any of the articles herein enumerated nor to any drug store licensed to sell liquors in the quantities and manner as hereinafter provided.
Any person or persons, firm or corporation, who, either as owner, agent, lessee or otherwise, conducts or carries on, or assists in conducting or carrying on, a retail liquor establishment as herein defined, is for the purpose of this ordinance declared to be carrying on the business of a retail liquor dealer.
Section 3. That the rate of license for engaging in the business of a wholesale liquor dealer in the City of Anaheim is hereby fixed at Ten Dollars per month.
That the rate of license for engaging in the business of carrying on a restaurant or eating place in the City of Anaheim, where spirituous, vinous, malt or mixed intoxicating liquors are sold, served or given away in original sealed packages, containing not less than one pint, with bona fide meals as hereinbefore defined, shall be a special license of Four Dollars per month, which shall be paid in addition to the regular restaurant license required by the ordinances of the City of Anaheim.
That the rate of license for engaging in the business of carrying on and conducting a drug store in the City of Anaheim, where spirituous, vinous, malt or mixed intoxicating liquors are sold or given away for medicinal purposes only, not to be consumed upon the premises where sold or given away, in sealed packages and in quantities of not less than five ounces and not to exceed one-fifth of a gallon, shall be Four Dollars per month.
Section 4. That no license to keep, maintain or carry on any wholesale or retail liquor establishment, or any restaurant or eating place, where spirituous, vinous, malt or mixed intoxicating liquors are sold, served or given away, or any drug store where such liquors are sold or given away, as in this ordinance provided, shall be issued to any person except upon order of the Board of Trustees of said City, which order shall specify the particular class of liquor license to be issued; and said Board of Trustees may revoke any of such liquor licenses at any time.
Section 5. The licenses in this ordinance provided for shall be due and payable to the City of Anaheim at the office of the City Tax and License Collector on the first day of each month in advance.
Section 6. That the licenses to be issued hereunder shall be classified as follows, to wit:
Wholesale Liquor Dealer's License.
Retail Liquor Dealer's License.
Restaurant Liquor License,
Drug Store Liquor License.
Each class of said licenses to be applicable only to the particular class of liquor business, as hereinbefore specified, for which the same

Section 11. No retail liquor dealer's license shall be granted for an establishment conducted outside of the following city: the City of Anaheim, towit: First: sides of Center street, from a point on red feet westerly of Clementina street; intersection of Center and Claudina Street; On both sides of Los Angeles from the south side of Center street south side of Chartres street.
No wholesale liquor dealer's license granted for an establishment to be located outside of the limits aforesaid, except fide wineries or breweries.
Section 12. No retail liquor dealer's license nor retail liquor dealer's license shall be granted where such businesses posed to be conducted in a room or place joining and communicating with a restroom or in the same room in which a restroom conducted; provided, however, that this position not apply to bona fide housing not less than ten sleeping rooms guests.
Section 14. Whenever any person, owner, proprietor, manager, agent, or otherwise, shall have been violating any of the provisions of this ordinance or of any other ordinance of the Anaheim regulating the sale of intoxications or the closing of wholesale establishments, saloons, bar rooms, places where such liquors are sold, given away, the license of the owner prior to such wholesale liquor equipment, saloon, bar room or other place; such violation was committed, shall upon be immediately revoked by said Trustees.
Section 15. Any violation of this ordinance or any of the provisions thereof shall constitute a misdemeanor, and shall be punished by a fine of not to exceed Two Hundred dollars; or by imprisonment in the City said City of Anaheim for a period ninety days; or by both such fine prisonment; and any owner or proprietor any wholesale or retail liquor establishment saloon, bar room or other place; restaurant or drug store, upon the premises occupied by such person or person used as a wholesale or retail liquor equipment; saloon, bar room or other place; restaurant or drug store, shall be punished if a misdemeanor and shall be punished hereinbefore specified, and his licence be revoked.
Section 16. Ordinance No. 140 entitles ordinance providing for the licensing regulating of the business of selling in the City of Anaheim. And repealing dinances and parts of ordinances therewith; and Ordinance No. 168. "An ordinance amending Section 140 and adding two new thereto", are hereby repealed; and all ordinances or parts of ordinances thereof this ordinance are hereby repealed.
Section 17. The City Clerk shall order the passage of this ordinance and so same to be published once in the Ames Journal.
Section 5. The licenses in this ordinance provided for shall be due and payable to the City of Anaheim at the office of the City Tax and License Collector on the first day of each month in advance.
Section 6. That the licenses to be issued hereunder shall be classified as follows, to wit:
Wholesale Liquor Dealer's License.
Retail Liquor Dealer's License.
Restaurant Liquor License, and Drug Store Liquor License.
Each class of said licenses to be applicable only to the particular class of liquor business, as hereinbefore specified, for which the same is issued; it shall be the duty of the City Clerk of said City of Anaheim to issue licenses under this ordinance according to and under the classification specified in the order of the Board of Trustees of said City authorizing the issue of such license. He shall then deliver the license to the City Tax and License Collector for collection on or before the first day of each month, taking his receipt for the amount thereof.
Section 7. It shall be unlawful for any person or persons to conduct or carry on within the corporate limits of the City of Anaheim, either in their own names or as agents for any other person or persons, or body corporate, or otherwise, to assist in so conducting or carrying on the business of a wholesale liquor dealer or retail liquor dealer, as defined in this ordinance, or the business of carrying on a restaurant or other eating place where spirituous, vinous, malt or mixed intoxicating liquors are sold, served or given away with regular or bona fide meals, as hereinbefore defined, or the business of carrying on or conducting a drug store where spirituous, vinous, malt or other intoxicating liquors are sold or given away, as in this ordinance provided, without first procuring from said City a license so to do; and the carrying on of any business or occupation in this ordinance specified, on any day or fractional part of a day, without such license, and contrary to the provisions of this ordinance, shall constitute a separate offense for every such day or fractional part of a day that such business is so conducted or carried on, and shall be deemed a separate violation of the provisions of this ordinance.
Section 8. It shall be unlawful to sell or give away any spirituous, vinous, malt or mixed intoxicating liquors in any saloon, tippling house, sample room, bar room, grocery, brewery, winery, drug store, restaurant or in any drinking place or places where such articles are sold, served or given away, either at wholesale or retail, between the hours of 12 o'clock, midnight, on Saturday and 5 o'clock A.M. the following Monday, and between the hours of 12 o'clock, midnight and 5 o'clock A.M. of each and every day of the week other than Sunday; provided, however, that the foregoing provisions shall not apply to the sale by druggists of such liquors upon prescription in writing given by any regularly licensed physician, for medicinal purposes only.

That no factor in the problem of conserving the land, water and forest resources of this nation equals that which Nature has provided in the feathered wild life of the continent is the opinion expressed by leading ornithologist in this country today. Following the conference of governors in Washington, officers of the national association of Audubon societies have decided to offer the cooperation of their organization in this great work, in pushing which the association has been the pioneer and only active organization ever since its incorporation. Although the workers for bird preservation were not represented at the gubernatorial conclave at the White House, government authorities have assured them that the protection of the insect eaters that insure life to crops, woods and waterways should be one of the first practical means to the general end.

Uniform laws for bird protection, if adopted by the states, would go far to ward off these growing inroads of insects and other pests, they say, and this might well be the first step to be taken following the deliberations of the house of governors.
While the value of the birds to the farmer, orchardist and planter has for years been recognized, it is believed by the authorities that their importance in preserving the forests is not generally known. According to a recent report of the government, insects alone cause an annual loss to the trees of the country estimated at over a hundred million dollars. On the oak alone four hundred species of insects which are sought and consumed by the birds of the forest, prey constantly, the experts of the biological survey have discovered. On the willow 186 such species constantly attempt its destruction, on the pine 165, on the hickory 170, on the birch 105 and on the elm 90. Careful analysis of the stomachs of thousands of woodpeckers, titmice, creepers, kinglets, wood warblers, wrens, flycatchers, swallows, nut hatches and other birds of the woods show that their constant labor is to consume
