SCHEME TO EVADE TAXES
Proposed Constitutional Amendment Would, if Adopted, Give Railroads Immunity from All Local Bonded Indebtedness. It Should Be Defeated
Some weeks ago we published the text of the proposed constitutional amendment relative to taxation of corporations, which will be voted upon in November. While we offered no opinion upon it, one way or the other, yet we warned our readers that it emanated from a legislature notoriously under domination of the Southern Pacific railway, and that if it were not favorable to the interests of that corporation it would never have passed either the senate or assembly.
The purpose of the proposed law now stands revealed: It is nothing more nor less than to permit the railroads still further to evade taxation. Recently the statement has been made that the Southern Pacific railroad has during the last twenty years evaded taxation in this state to the extent of $14,-500,000. It seems the corporation wants more of this kind of nursing.
There is one feature of the proposed Constitutional Amendment exempting public service corporations from all local taxation (Senate Constitutional Amendment No. 1 to be voted on next November (which of itself should condemn the amendment). This amendment provides that the various public service corporations, including banks, shall annually pay from one to four per cent (according to the nature of the corporations) of their gross receipts to the state of California as taxes, and having paid these per cents, shall not

This amendment provides that the various public service corporations, including banks, shall annually pay from one to four percent (according to the nature of the corporations) of their gross receipts to the state of California as taxes, and having paid these per cents, shall not be liable to any further state taxation, or to any county or city taxation whatsoever. In support of this provision it is claimed that the public service corporations will pay more state taxes than they now pay in both state and local taxes combined, and that these corporation taxes will probably be enough to meet all the state’s expenses so that the city and county governments will recoup themselves for the loss of all local taxes from the public service corporations, by the fact that all other local property will probably be exempt from all state taxation.
This claim may be true under existing conditions, but it does not follow that it will be true under the conditions that will confront us in the immediate future. The per cents provided in this constitutional amendment to be paid by the corporations as taxes to the state may be such, (we grant it for the sake of argument) as to make their future state taxes equal to their present state and present local taxes; but such local taxes, according to a signed statement made by George H. Dunlap on Pacific Municipalities, are immediately going to be greatly increased in various important localities, by reason of special needs, and from this increase of all local taxation the public service corporations will be entirely exempt if this constitutional amendment is adopted.
Thus for example, San Francisco expects to issue $35,000,000 of bonds to repair the streets, sewers, public buildings, etc., damaged by the earthquake and fire. From this unusual burden of taxation that this great bond issue will involve, the public service corporations of San Francisco will be entirely exempt if this constitutional amendment carries. The per cents of taxation therein provided to be paid by the corporations, were based upon the ratio of state to local taxation prior to April...

The percents of taxation therein provided to be paid by the corporations, were based upon the ratio of state to local taxation prior to April 18, 1906.
Another illustration: Los Angeles expects to issue $25,000,000 of bonds to secure the Owens river water as a domestic supply. This proposed constitutional amendment (its framers not having in mind any such unusual expense as this) will excuse the public service corporations of Los Angeles from paying one cent on this great public improvement. Various other localities in the state also face increased local taxation in the immediate future by reason of their various local needs. Wouldn't it be fine for the public service corporations to escape all this increased local taxation by a constitutional provision that permanently fixes their tax rates upon the basis of conditions as they used to be, ignoring conditions as they now exist?
A number of weeks ago in a short conversation with Professor Carl Plehn of Berkeley University, the author of this constitutional amendment, I asked him if the above criticism did not legitimately lie against the amendment. He asked me to restate the criticism, which I did, and he then said he would think it over and write me later. I have not heard from him yet, but I think the people of the

FOR ANAHEIM PUBLIC LIBRARY
Sealed proposals will be received by the Board of Trustees of the Anaheim Public Library, at the office of E. Kate Rea, the secretary of said Board, No. 224 East Broadway. Anaheim, Cal., until 7 o'clock p.m. of June 11, 1908, for the construction of a brick Library building on the lot at the northwest corner of Los Angeles and Broadway streets, in the city of Anaheim, at which time bids for the construction of said building will be opened.
The plans and specifications for such building are on file at my residence and an inspection of the same may be obtained by applying to the undersigned, at 224 East Broadway. Anaheim, Cal.
The bids must be accompanied by a certified check payable to the Board of Trustees of the Anaheim Public Library, for five per cent of the amount of bid, as a guarantee that the bidder will enter into the proposed contract if awarded to him! unless such check is enclosed bids will not be considered.
Bidders are requested to state the difference in price which they will make between a clay tile and a galvanized iron tile roof, and they will also please state in their proposals the time in which they will fully complete the work, and this statement will be taken into consideration in awarding the contract, and the time mentioned for completion will be made an essence of the contract.
The Board of Trustees reserves the right to reject any or all bids.
