GIRL'S STORY DISPROVED Jury Finds August Thomas Guilty of Battery—Suit for Damages in Prospect It required a jury in Judge Howard's court on Tuesday only five minutes to bring in a verdict of guilty against August Thomas, charged with battery upon Gus Schifferdecker on the evening of April 7th. Schifferdecker was severely beaten and had his left arm broken by Thomas as he was riding to the home of John W. Peacock, by whom he was employed, and who resides at the corner of Citron and South streets. Schifferdecker testified that as he was passing the Thomas place, he was rendered unconscious by a blow upon the head by some one following him in the rear. He did not know his assailant, and swore on the stand that he could not identify Thomas as his assailant. Had it not been for the interposition of William Berdrow, who ran between the two men, telling Thomas not to strike his victim again, Schifferdecker might have been killed. Schifferdecker on regaining consciousness ran for his life, leaving his broken down on cross-examination told of his whereabouts during having been with friends from in the morning until 6:30 in ing, when he left the Commer to go home. He was found on Citron street and taken to the office of Dr. Beebe, who set the broken arm and otherwise attended to his wounds. Defendant testified as to his being informed by his wife and daughter of the alleged felony and of his pursuit of Schifferdecker. The story of the battery was not brought out, and Thomas made no denial of the charge. Witnesses in rebuttal were introduced as follows: Fred Dyckman, Wm. Dyckman, Mrs. Fred Dyckman, Mrs. John Zeigler, George Huntington, Ed Marion, Arthur McAuley, John W. Peacock, and others.
