WEED BILL WILL PASS Assemblyman Bishop Sends Copy of Proposed Enactment. An act before the legislature in which Orange county officials have taken considerable interest is the one declaring that the person who allows noxious weeds to grow upon the street in front of his property is guilty of maintaining a nuisance. The Gazette has this concerning the bill from Assemblyman Clyde Bishop at Sacramento: Sacramento, Cal., Jan. 26, 1907. Editor Gazette:—I enclose herein bill No. 371, which will be passed, in relation to weeds on city streets. My committee reported it today, and recommended that it pass. Yours truly, CLYDE BISHOP. The text of the bill follows: AN ACT Authorizing municipalities to declare noxious weeds growing upon public streets to be a nuisance, providing a means for the abatement of such nuisance, and creating a lien upon property fronting upon streets upon which such nuisance exists for the cost of abating the same. The people of the State of California, represented in senate and assembly, do enact as follows: Section 1. The municipalities of the state are hereby authorized to declare all noxious weeds growing upon any public street in such municipalities to be a public nuisance, to abate such nuisance in the manner herein provided performing the duties of vision, to give the notice of the section succeeding Section 3. Upon the resolution, the superintendent shall cause to be imminent along the line of streets named in such resolution stantially in following notice to DESTROY The legislative body town) of—— having been declared by reason noxious weeds growing in said city (or town) assurance, and having commitment of the same: Notice is hereby given of property fronting within ten (10) days of this notice, by the noxious weeds. Upon failure to abate herein required, such will be removed by the authorities of said city; the cost of such removal a lien upon the property portion of such street for weeds have been removed. Dater this——day Superintendent (or town) of The above notices along the line of therein at intervals of 100 feet, and shall be ten (10) days prior to therein at the time at abate such nuisance with municipal authorities therein the same. The legislative body of the city (or town) of—— having on the—— day—— declared by resolution that all serious weeds growing on—— street said city (or town) are a public nuisance, and having commanded the abate out of the same: Notice is hereby given to all owners property fronting upon the above named street, in front of which property such nuisance exists, to abate the time within ten (10) days from the date this notice, by the removal of such serious weeds. Upon failure to abate the same as herein required, such noxious weeds shall be removed by the municipal authorities of said city (or town), and cost of such removal will be made upon the property fronting the action of such street from which such weeds have been removed. After this—— day of—— Superintendent of streets city (or town) of…… the above notices shall be posted along the line of the street named herein at intervals of not less than feet, and shall be kept posted for (10) days prior to the time stated herein at the time at which failure to rate such nuisance will give the municipal authorities the right to abate same. Section 4. If, upon the expiration of separate lot or parcel of land fronting such street, particularly specifying the cost of abatement to be charged against each such separate lot or parcel of land He shall file such statement or account with the legislative body of the city (or town), and such legislative shall pay such cost out of the general fund of such municipality. Any and all sums so paid shall be and become a lien upon the lot or parcel of land in front of which such nuisance was removed or abated, in pursuance of this act. A notice of such lien shall be filed in the office of the municipal official in whose possession is the assessment roll of such city, and the amount of such lien shall be entered in such assessment roll opposite the assessment of property charged therewith. An action to foreclose such lien may be commenced within 30 days after the time at which the tax levied against such property by such municipality shall be delinquent, which action shall be brought in the proper court by the city attorney of the municipality, in the name and for the benefit of the municipality, making such payment or payments, and when the property is sold, enough of the proceeds of such sale shall be paid into the municipal treasury of such municipality as to satisfy the lien and costs; and the surplus, in any there be, shall be paid to the owner of the property, if he be know, and it not, in- to the court for his use when ascertained.
