Whereas, an application has been filed with the Board of Trustees of the City of Anaheim, California, for a franchise for a term of fifty years, to erect, maintain and operate poles and wires with all the necessary and auxiliary fixtures thereon, over and along the streets, alleys, lanes, highways and public places of the said City of Anaheim; to transmit sounds, signals, conversation and intelligence through and over said wires by means of electricity; together with the right to construct, operate and maintain all necessary feeders, service wires, house connections and other apparatus and appliances in connection therewith as may be necessary for the purpose of sufficiently operating and maintaining said poles, wires and fixtures, and carrying on a general telephone and telegraph business by means thereof. Notice is hereby given that said Board of Trustees propose to grant the same, and that sealed bids for such franchise will be received at the office of said Board of Trustees of said City until Thursday, July 26th, 1906, at 8 o'clock p.m., at which time the Board will, in open session, at their office in the City Hall, Anaheim, California, open and read such bids, and said franchise will then be struck off, sold and awarded to the person, firm or corporation who shall make the highest cash bid therefor; provided only, that at the time of opening said bids any responsible firm or corporation present, or represented, may bid for said franchise a sum not less than ten per cent. above the highest sealed bid therefor, and said bid, so made, may be raised ten per cent. by any other responsible bidder, and said bidding may so continue until finally said franchise shall be struck off, sold and awarded by said Board of Trustees, to the highest bidder in gold coin of the United States. Said successful bidder shall deposit with the clerk of said City of Anaheim at least ten per cent. of the amount of his bid before the franchise shall be struck off to him, and shall deposit with said clerk, within twenty-four hours after the acceptance of his bid the remaining ninety per cent. of the amount thereof, together with all necessary expenses connected with the sale of such franchise, and in case he, or it, shall fail to do so then the said deposit therefor shall be forfeited and the said award of said franchise shall be void and said franchise shall again be offered for sale to the highest bidder therefor in the same manner and under the same restrictions as hereinbefore provided. Each bid shall be accompanied with cash, or a certified check, payable to the Treasurer of said City of Anaheim, for the full amount of said bid; and in addition thereto, the successful bidder will be required, within five days after an order granting said franchise, to file a written acceptance of said franchise, together with a bond in the penal sum of five hundred dollars, with at least two good and sufficient sureties, to be approved by said Board of Trustees, conditioned that such bidder shall well and truly observe, fulfill and perform each and every term and condition of such franchise, and that in case of any breach of any condition of such bond, the whole amount of the penal sum therein named shall be taken and deemed to be liquidated damages, and shall be recoverable from the principal and sureties upon said bond.
