the system upon which the letters patent are based was well known and had been extensively used for several years prior to the issuance of the letters patent.
As conclusion from the foregoing facts the court finds:
First. That the patent is void for want of patentable novelty and invention.
Second. That the defendant is entitled to judgment and for costs incurred.
The decision of the court affects every county and almost all of the cities of California as well as in a great many other states. The sum of money involved, which the company would have collected as damages for the infringement of the alleged patent can scarcely be estimated.
For every mile of road improved by the use of oil the company would have been entitled to a license of $15 per mile.
Drying preparations simply develop dry catarrh; they dry up the secretions, which adhere to the membrane and decompose, causing a far more serious trouble than the ordinary form of catarrh. Avoid all drying inhalants, fumes, smokes and snuffs and use that which cleanses, soothes and heals. Ely's Cream Balm is such a remedy and will cure catarrh or cold in the head easily and pleasantly. A trial size will be mailed for 10 cents. All druggists sell the 50c. size. Ely Brothers, 56 Warren St., N.Y.
The Balm cures without pain, does not irritate or cause sneezing. It spreads itself over an irritated and angry surface, relieving immediately the painful inflammation.
With Ely's Cream Balm you are armed against Nasal Catarrh and Hay Fever.

European Market
The new rate of $1 for each 100 pounds upon citrus fruits shipped from Southern California direct to Europe has become effective. The experiment will be nursed for several weeks by the railway interests affected as well as by shippers. The outcome is conceded to mean a great deal to Southern California.
Edw. Chambers, assistant freight traffic manager of the Santa Fe, says he believes the new rate will open markets whose value will continue to grow, making it, perhaps, impossible to keep pace with the demands.
“What is wanted in Europe,” remarked Mr. Chambers, “is the large naval orange, which is never seen there. A contrery situation exists on this side, where the small fruit evidently has the preference.
“Under the new conditions shippers will have a right to divert consignments to the European market in the event there is a congestion in the city where consignments have been originally. This will apply to all terminals in the east.”
All the railroads will be legitimate evidence that a market is being sought. The new rate to Europe is $1, as against $1.25 a hundred pounds to the Atlantic seaboard.
Mr. Chambers says that the present orange season will break all records in volume of shipments, as well as in prices that will rule. The holiday trade is on, and from this time until a few days before Christmas shipments from Los Angeles will average about sixty cars a day.
Because Vinol is not a patsecret medicine, it contains no
drugs to react upon the systle you know just what you are

Since we first put Vinol on
