ties to the suit, each parcel thereof carrying with it its reasonable use of the water flowing in the ditch. A proceeding in partition is a special proceeding and only the matters designated by the law of partition can be adjudicated in such proceeding. Any matter sought to be thus determined that is outside of the legitimate matters in the partition suit would be coram non judicé and void. The decree in partition does not, however, seek to settle any question whatever of the easement of the ditch nor its capacity nor the reasonable use of each parcel of land to the water flowing in the ditch, and this is a double reason why the decree offered in evidence does not cut any figure in the controversy. A third reason why this decree cannot affect the issues in this case arises from the fact that all of the parties hereto, claiming water through said ditch, have, since the making of said decree in partition, continued to use the water to the same extent and in the same manner as the same was used prior to said decree. Their rights have therefore become prescriptive. Judgment will be in accordance with this opinion and defendants are entitled to costs.

In accordance with their policy of retrenchment to meet the exigency of a depleted city treasury, the City Trustees Monday night put through its first reading an ordinance raising the water rate to all consumers. The new rate was left blank, to be filled in at the next board meeting, but it is said the raise will be from $1 to $1.50 per month. A resolution was also adopted cutting out all incandescent street lights for ninety days, commencing June 1.
