REPORT OF
GRAND JURY
Santa Ana, Cal., Dec. 19, 1904.
To the Honorable Z. B. West, Judge of the Superior Court of Orange County, State of California:
We, the Grand Jury duly impaneled and charged by your Court on November 28, 1904, do now respectfully submit our final report. The different committees duly appointed by the foreman have carefully examined all books, vouchers and records of the various city and county officials as well as the condition of all county property, and would report as follows:
A careful and thorough examination has been made of the records in the Clerk's and Recorder's offices and all books were found to be neatly kept and the accounts balanced. We found the receipts in the Recorder's office to be for the year ending November 30, 1904, $6946.65. We would call the attention of the Supervisors to the worn condition of many of the books in the Recorder's office, and would recommend that they be recovered without being removed from the office.
We have examined the books and records in the Tax Collector's office and the books and maps in the Assessor's office, and found them correct and kept in a neat and business-like manner and in the Assessor's office we recommend the office work of the Assessor and the system he has adopted in the use of property maps.

The books of the County Auditor were found to be correct and nearly kept. We find his work is increasing every year, so that he has little time to entertain visitors.
We have examined, and verified the Treasurer's books, and with the assistance of the District Attorney, Auditor, Treasurer, and Foreman counted the money in the Treasurer's office and on special deposit in the First National bank of Santa Ana, and for the amount to correspond with the Treasurer's books, amounting to $102,438.83.
For the information of One tax payers in Buena Park and Centralia districts we found had many deep rut holes where no oil had been used. The oiled roads were in good condition.
The Newport road from Myers' warehouse to Newport bridge is in very bad conditions. The railroad crossing at Harper's switch on Newport road is in dangerous condition on account of the railroad grade being so much higher than the wagon road. There is nearly a foot drop.
From Anaheim to Olinda the road is in good condition. Brea Canon and La Habra road is in fairly good condition. Road from Fullerton to Anaheim in good condition, as are most oiled roads. We found roads 2½ to 3 miles north from Garden Grove in very bad condition.
On the Fairview avenue road in West Anaheim road district we found a water ditch of the Anaheim Union Water Company in the road, and recommend the removal of the ditch and grading of said road from the northwest corner of Section 21-4-10 to the intersection of Los Angeles street.
Buena Park and Orangethorpe avail Santa Ana road. enue road in fair condition. The road from Anaheim to Orange is in good condition. Road to County Park in good condition.
Visited County Park and would recommend that the Board of Supervisors have the park cleaned up. The keeper of the park states that he had no instructions from any one when he took charge as to his duties, which probably accounts for the condition of the park at this time.
We recommend that the lower part of the pavilion be included by a board and wire netting. To prevent leaves and other debris from drifting under said pavilion, thus causing danger of fire on account of the accumulation of leaves, etc., now under the building.
The road from County Park four miles west is in poor condition. Balance of road to Olive in good condition.
On the road from El Modena to County Park, in place of fence that is now being constructed along the gully, we would recommend that the said gully—which is 60 to 80 rods long—be filled with piles of brush and rock about 400 feet apart to assist parts of the county, and that it county strictly enforce the pro- law in regard to dumping refuse.
On examination of the books papers of the Board of Supervice we find as follows:
On warrant No. 254, allowed by board January, 1904, $1 underpaid.
Demand No. 1699, in favor of J. Long, allowed $10 in excess of bill proved by Supervisor, district N.
Demand No. 424 in favor of A. Johnson, allowed $3 in excess of approved by Supervisor, district N.
Demand in favor of W. G. Mitte underpaid $4, same district.
We also found two other warrants No. 1756 and 2794—for small amends showing that too much care can be taken in examining bills.
Otherwise the accounts were correct.
There are many things in this filing and prosperous county of our should be carefully looked into by Honorable Board of Supervisors handle the largest portion of the payers' money, and our particular tention has been called to the fact there are large sums of money dead in the treasurer's vault thus out the year, amounting to from 000 to $100,000, which takes just much money out of circulation time of year when the taxpayer usually short of funds, which, opinion of many taxpayers below the taxpayers of the county, seems an unjust taxation to have a large surplus on hand that does not seem to be used for any purpose if such are the facts people to know why they are taxed so have such a large accumulation hand every year when the Grand Jury meets.
If any one can answer these questions satisfactorily it will relieve minds of hundreds of tax payers this county, and also relieve every Grand Jury from trying to questions beyond their comprehension.
If left to the Grand Jury to means to relieve the treasury surplus accumulations it would easy recommendation for this offer, and while this Grand Jury not in position to take the matter at this time, we might offer a statement to the Assessors to be more

For the information of the tax payers of Orange county we will state that the money is kept in the safe deposit vault and kept locked throughout the day, and is at the call of the County Treasurer at any moment during business hours. As the County Treasurer has on hand at different times during the year from $50,000 to $200,000 we would consider it unsafe to have that large amount in the county vault, and in case the Treasurer was compelled to keep the county funds in the county vault it would be impossible for him to find bondsmen who would be willing to take such risk under present existing conditions.
We consider this a better plan than to put the county to needless expense to hire a special vault for the county money, as they were compelled to do in Los Angeles county, at an expense of $100 per month.
We have carefully examined the books, records and accounts in the Sheriff's office, and have found all correct and the accounts balanced.
Recognizing the value of the system of photographing all prisoners as inaugurated by the Sheriffs of some other counties, we recommend that the system be adopted in order that prisoners be more easily identified and the county saved a great expense. And we also suggest that the Supervisors appropriate money for that purpose and for keeping an index album, to be known as the "Rogues Gallery," as upon investigation we are convinced that the expense will not exceed $200.
We have been working under difficulty in examining the county roads, for the reason that we have been working without a map showing the roads belonging to the county, also the locations of the culverts and bridges. As we understand the law the Supervisors have no right to expend money on a public road unless it has been acquired by the county and accepted by the action of the Supervisors spreading the same on the minute book. If such be the case, we would suggest that the County Surveyor make a map of each supervisorial district showing the county roads, also the culverts and bridges, numbered in such a manner as to be of information to the Supervisors, the taxpayers of the county and the Grand Jury, and that said maps be corrected from time to time as new roads are added.
On the road from El Modena to County Park, in place of fence that is now being constructed along the gully, we would recommend that the said gully—which is 60 to 80 rods long—be filled with piles of brush and rock about 400 feet apart to assist nature in filling up the gully. The surplus brush in the park can be used greatly to the benefit of the park for this purpose.
We have examined all public school buildings of the country and find them in good condition except as noted below.
Newport Beach school house is very much in need of repairs, and the sanitary conditions are such as to need immediate attention.
Fairview school house is in need of some repairs and the water drainage should be changed from main entrance of building.
El Toro school house sanitary conditions are not good. Placentia school house—we find the sanitary conditions very bad and an inadequate supply of water, no drainage to outhouses and in very bad condition. We were surprised to find such conditions existing in one of the largest and richest county districts.
La Habra school house—sanitary conditions fairly good, but there should be water drainage pipe put in to carry off waste water. At least 20 feet would be required. General condition of the building not good—many repairs are needed.
El Modena school house—condition fair, but would recommend new plumbing and sanitary closets.
Cypress school building in good condition, but badly kept and the grounds are very uneven. Grading and filling in are much needed.
We recommend that the trustees of each school district place the name of each school house in a prominent place on said house.
Have examined bridges and culverts of the county and find as follows:
The first bridge north of the railroad on Main street on the road to Newport Beach needs immediate attention. Posts under the bridge being badly rotted and some gone entirely.
The fifth street bridge across Santa Ana river is now in very bad condition, and should be replaced by a new bridge as soon as funds will permit.
Found the floor of Olive bridge across Santa Ana river unsafe for heavy traffic. It should be attended to at once, and would recommend the opening of a channel above and below said bridge, in order to carry the water nearer to center of said bridge, to protect western approach.
Bridge between Anaheim and Eulipa pavilion, thus causing danger of fire on account of the accumulation of leaves, etc., now under the building.
The road from County Park four miles west is in poor condition. Balance of road to Olive in good condition.
If left to the Grand Jury to mean to relieve the treasury surplus accumulations it would easy recommendation for this offer, and while this Grand Jury not in position to take the matter at this time, we might offer a motion to the Assessors to be more ful in the future so as not to damage the property in the county so that it will take $50,000 or more of the taxpayers than is required by payment of the county bill if it is done in the future, as been in the past, divide the among the taxpayers would be only solution we could offer session.
We find park keeper paid out rent expense fund instead of fund. We only find two demands out of park fund.
We also find that road owner put in bills in their own for other parties working on this. We recommend that all bills be in the name of the party who does work.
We recommend that a map pared showing all county road bridges, and that the said map stantly kept up to date. We recommend that all county named, and all county bridges culvers be numbered, in order for a means of ready reference.
We fail to find the allowance footed up as they should be.
We have examined careful county property, including parks, bridges, ditches, etc. We acknowledge that on account dry year it has been especially cult to keep the roads in good condition. We are nevertheless, of this that with the amount of money pended on the roads, they shall in much better condition. We would recommend the oiling roads where possible as it would great benefit and saving to this ty, and we would urge that all over one mile in length on this be done by contract, instead work, as we find in many rickets a difference of from 50-$2 per day in the pay of man and

We found balance of road to Alamitos in fair condition; road from Santa Ana to Westminster, fair.
Would call attention of Supervisor of District No. 2 to the trees and brush in the road along side of ranch of Mills' estate, as it is now dangerous to travel on account of obstructions in the road.
The road from Santa Ana to Bolsa is in fair condition. Road running north from Bolsa Chico Gun Club would suggest that it be not extended south beyond Gun Club grounds, and county should not grade said road as it is not used by the general public. Also recommend that the road running west from Smeltzer Station be not graded further than it is at present as it will only benefit private parties.
We recommend that the road from one mile south of Ocean View school house to Huntington Beach be graded and oiled, if possible, provided the Beach Company will assist in said work. The road at the present time is in very bad condition.
The road from Santa Ana via Tustin to Capistrano is in good condition from Capistrano to San Juan by-the-Sea. Over mountain and sea coast road to Arch Beach and Laguna is in fair condition. Road from Santa Ana via Orange to Yorba and county line is in good condition.

Bridge between Anaheim and Fullerton—we found two of the spans on the north side weakened and lowered. They should be strengthened by temporary supports. We consider said bridge unsafe for heavy traffic.
We find no bridge over Coyote creek on the West Anaheim road. This crossing is not passable when water is standing in the road except for light rigs. A bridge is very much needed in that locality.
At the McPherson bridge across Santiago creek the first jetty above the bridge is calculated to throw the water against the bank and destroy the same instead of turning it away from the bridge-pilling, thus making no protection to the bridge. This matter should be remedied.
We recommend that the drainage ditch on the north side of the river leading west from Fifth street bridge be cleared of brush and debris.
We would especially call the attention of the Supervisors to the recommendations of former Grand Juries pertaining to sign boards on all prominent cross roads of the county, as it would be a great convenience to the public, and the benefit would more than balance the cost. We trust that this matter may be taken up by the present Board of Supervisors.
We would recommend to the Board of Supervisors the necessity of passing a law to prevent the dumping of refuse in the rivers and creeks and also on the sides of roads, as we find this is quite a general practice.

J. C. Conklin, a well-known paperman, representing the Santa Blade, was in town during the interest of that religious job.
Mrs. Adolph Egge, sister Zeus, and daughter, Miss Maud of Grand Island, Neb., arrive yesterday on a visit to relate may decide to remain permanent.
A movement is on foot to organize of the Fraternal Order at this place. Worthy State President H. L. Leavitt has Anaheim for the past week interest of this order. Mr. L meeting with very encouraging having secured something or signatures of parties who affiliate with this benevolent meeting will be held on Friday at Back's hall at which Mr. will make an address.

The following officers for the M. E. Sunday school for 1905 were chosen Mon. evening at a meeting: J. L. Farrar Supt.; J. T. Shaffer, assistant; H. E. Ward, secretary; J. H. Edwards, treasurer; Neillie A. Baker organist; James Yoe, librarian; Florence Hare, assistant librarian; Mrs. Shaffer, chorister.
The present teachers in the school were all re-appointed, with the addition of Mr. and Mrs. Wm. Morrill, Addie Petrie, Mrs. C. E. Hammond and J. H. Edwards.
For officers of Sunday school missionary society—Nellie Hare, president; Mrs. Hammond, vice-president; Miss Grace Young, secretary; Irtis L. Ward, treasurer.
Rev. and Mrs. J. W. Millar have returned from Los Angeles where they attended a reception given by the members of the First Presbyterian church of that city to Rev. DeWitt Talmage, their pastor.
The case of Antonio Ortiz vs. Manuel Crespin, for damages alleged to have been sustained, was on trial before Recorder Howard this week.
Ortiz was awarded damages in the sum of $71.
He had been occupying a house leaving his furniture therein.
He turned the key over to Crespin.
The latter thereupon set Ortiz's belongings out of the house.
For this Ortiz began suit and was awarded damages in the sum of $71.
Mr. Crespin states the reason he moved the furniture out was to make room for another tenant, and that he was of opinion Ortiz would not return.
He also avers Ortiz has made untruthful statements concerning him and desires that his good name which he has upheld in this community for so many years be not disturbed as the result of his first appearance in court.

AN ORDINANCE REGULATING THE PLANTing of trees on streets in the City of Anaheim.
The Board of Trustees of the City of Anaheim do ordain as follows:
Section I. It shall be unlawful for any person to plant trees on the streets of the City of Anaheim other than those described as tolls, to keep and every taxpayer throughout the county.
We desire to extend our thanks to any one can answer these questions satisfactorily it will relieve the bills of hundreds of taxpayers of county, and also relieve each and every Grand Jury from trying to solve situations beyond their comprehension.
We find park keeper paid out of current expense fund instead of park fund. We only find two demands paid for park fund.
We also find that road overseers put in bills in their own names other parties working on the roads. We recommend that all bills be put in the name of the party who does the work.
We have examined carefully the county property, including roads, parks, bridges, ditches, etc. We must knowledge that on account of the year it has been especially difficult to keep the roads in good repair. We are, nevertheless, of the opinion that with the amount of money extended on the roads, they should be much better condition, and we would recommend the olling of all roads where possible as it would be a great benefit and saving to the county and we would urge that all grading done by contract, instead of day work, as we find in many road districts a difference of from 50 cents to per day in the pay of man and team.
In closing our report if we use language that seems to the taxpayers toplain we will say that we are of opinion that it is about time that such language should be used to aid that our laws may be enforced and tax rate reduced, and that the suggestions and recommendations herein agreed, which we have carefully considered, may prove to be a benefit to both and every taxpayer throughout the county.

ORDINANCE No. 166,
AN ORDINANCE REGULATING THE PLANTing of trees on streets in the City of Anaheim.
The Board of Trustees of the City of Anaheim do ordain as follows:
Section 1. It shall be unlawful for any person to plant trees on the streets of the City of Anaheim other than those described as follows, to wit: Cocus plumosa (palm), Cocus flexuosa (palm), Phoenix reclinata (palm), Chamaecrops excelsa (palm), Brahnen robusta Washingtonia (palm), Iracena Indiola, Sterculia diversiflora, Acacia melanoxylon, Laurus camphora (camphor tree), Pittisporum undulatum, Quercus robur (English oak), Quercus palustris (pin oak), Prunus ileifolia (holly-leaved plum), Magnolia grandiflora, Laccaria mimosofoila, Jacaranda, Mella osadamich (Texas umbrella tree), Ginkg's biloba (maiden hair tree).
Provided, however, that any person desiring to plant trees on said streets not included in the foregoing list of varieties, may make written application to the Board of Trustees of said city, stating the variety of tree or trees which such person desires to plant, and the place where it is desired to plant them, and said Board of Trustees may, in their discretion, issue to such applicant a special permit to plant such trees.
Sec. 2. On all streets have been or may hereafter be constructed, with parking space, trees when planted shall be placed within said parking space.
On streets where cement sidewalks have not been constructed, trees when planted shall be placed at such distance from the property line as shall be designated by the Superintendent of Streets of said city.
Sec. 3. It shall be unlawful for any person to tie any animal to any tree planted on any of the streets of said city, or to cut, girdle, mutilate or in any manner damage or injure any such tree.
Sec. 4. Any person who shall violate any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not less than five dollars nor more than twenty dollars, or by imprisonment in the city jail of said City of Anaheim for not less than two days nor more than ten days, or by both such fine and imprisonment.
Sec. 5. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
Sec. 6. The City Clerk shall certify to the passage of this ordinance and cause the same to be published once in the Anaheim Gazette, and thereupon and thereafter the same shall be in full force and effect.
