A WHITEWASH REPORT CONCERNING MILES DITCH
An Interesting Story About a Fudge in the Section Line. Which Is Referred to the County Surveyor
The water board met in regular session on Saturday afternoon; present Sherwood, Crowther, Bradford, Hale, Smith, Sheppard and Zeyn.
The ditch committee made the following report:
To the Directors of the Anaheim Union Water Company.
GENTLEMEN: We, your ditch committee, beg leave to make the following report:
1. After having examined the water shed above Robinson & Anderson's fill, we have decided to make another opening in said fill.
2. We call your attention to the deplorable condition of the North Branch ditch, and recommend that the same be cemented as soon as possible.
3. We recommend that the Anaheim Union Water company pay two-thirds cost of pipe for the Catholic church, as per request, said church agreeing to pay all the expense of teaming, laying and backfill for said work.

The matter of the fill above the reservoir the board referred back to the committee with power to act. The proposed pipe line in front of the Catholic church met with approval, and recommendation of the committee was adopted. The cementing of the North Branch ditch was referred back to the committee with instructions to ascertain what assistance irrigators along line of the ditch will render toward cementing it, together with an estimate of cost of the work.
Mr. Sherwood submitted the following report upon the Miles ditch, administering to himself a beautiful coat of whitewash for placing a cement ditch in disputed territory.

Board of Directors Anaheim Union Water Company.
GENTLEMEN: In the matter of the disputed location of the Miles ditch, in section 34, we find the facts to be as follows:
The description of the property sold by Miles is as follows from the recorded deed: "Beginning at the northeast corner of section 34, T. 3 S., R. 10 W."
verbally agreed with Tuffree to recommend the adoption of the contract.
Sheppard—Why should we build ditches across Tuffree's ranch which will add $150 per acre to it, and then agree to deliver him water free? He is laying out a townsite, and asks us to furnish him with free water for a reservoir which he contemplates building. What's to hinder him from making it large enough to furnish water for the whole ranch? If we agree to this we will have to furnish free water for the whole tract.
Sherwood—Those matters do not concern Col. Tuffree now.
Sheppard—No, but they concern the company.
Hale—What are we dealing with Tuffree for? Mrs. Tuffree is the owner of the ranch, and Tuffree has only a life interest as a tenant. I am sick and tired of the whole business, and the sooner we condemn the reservoir and have a final settlement, the better. I shall fight this agreement as long as life lasts.
On motion of Hale, seconded by Sheppard, the matter was referred back to the committee for further consideration.
The president and secretary were empowered to borrow $1000 to pay current demands.
An assessment of $2 per share was levied.
Superintendent Porter announced that water would be out of the upper ditch for four days to permit new cement work.
The throwing up of a dyke on the Olinda ranch, stopping the natural flow of water, was referred to the superintendent and engineer.
Sherwood said that it would be in order for the board to discuss the matter of making more improvements in the main ditch.
Sheppard—How are you going to do it if you haven't got any money?
At this point the bulky form of Col. Tuffree appeared at the door. Going to Secretary Krick's desk, he served upon him the following communication, which was read to the board:

Anaheim, Cal.—Gentlemen: Without waiving the notice which I have herefore given you terminating the contract between J. K. Tuffree and myself on the one part and your company on the other part, and by way of compromise and to avoid litigation I make you the following proposition:
If you will fulfill the agreement above referred to in every respect on or before the 1st of January, 1903, and will enter into an agreement to pay me rent at the rate of one hundred and twenty dollars yearly for the period of

GENTLEMEN: In the matter of the disputed location of the Miles ditch, in section 34, we find the facts to be as follows:
The description of the property sold by Miles is as follows from the recorded deed: "Beginning at the northeast corner of section 34, T. S., R. 10 W., running thence west 120 rods; thence south 160 rods; thence east 120 rods; thence north 160 rods to place of beginning; excepting therefrom the east half of the northeast half of the northeast half of said section 34," the evident intention being convey lots 1, 2, 3, 14, 15 and 16, as shown on the old plat of Miles Bros.' subdivision, each containing twenty acres, a copy of which accompanies this report. Recent surveys show the distance between the east and west section lines on Commonwealth avenue is long, the excess being about 11 feet. As the reservation in the deed is described as the east half of the northeast half of the northeast half instead of lot 1, Mr. Miles can therefore probably claim the proportional part of the excess of 11 feet, which would be 1½ feet.
The cement ditch is located on the line between lots 1 and 2. Therefore, even if the above conclusion is accepted, the ditch is but little more than one foot off the line, and is on the 8- or 10 foot right of way which the company usually exacts in such cases. We therefore conclude that Mr. Miles has no cause for complaint on this score, and should give the company a deed for right of way as agreed.

Mr. Miles contends the ditch cuts off a wedge-shaped piece of his land and refuses to give a deed to it.
Mr. Sheppard said that Miles was anxious that Surveyor Finley resurvey the ditch before going further with it. Miles does not, he said, desire to give a deed to it until Finley again ran his lines over it.
Sherwood said that Finley's survey was right, and that the only difference between them was caused by audge of eleven feet in the section lines.
The board decided to lay the matter over until Finley could investigate.
Sherwood reported progress upon investigation of La Habra reservoir site, adding that some of the conditions had been found to be not altogether satisfactory. He also reported progress in the matter of the new agreement with Col. Tuffree. Surveyor Finley had surveyed the additional area covered by the enlarged reservoir, he said, and the committee would probably recommend paying an increased rental therefor.
Mr. Hale said the company had in his opinion vacated more land in the abandonment of the old ditch than it took up in the new. He thought the committee should consider these things carefully before agreeing to increased rental.
Mr. Crowther was of opinion the only way to settle the reservoir was to condemn it.
Mr. Sheppard said he thought so too.
ANAHEIM UNION WATER COMPANY,
Anaheim, Cal.-Gentlemen: Without waiving the notice which I have herefore given you terminating the contract between J. K. Tuffree and myself on the one part and your company on the other part, and by way of compromise and to avoid litigation I make you the following proposition:
If you will fulfill the agreement above referred to in every respect on or before the lst of January, 1903, and will enter into an agreement to pay me rent at the rate of one hundred and twenty dollars yearly for the period of five years from January 1, 1903, for the use of the reservoir, payable half yearly in advance, commencing with the lst of January, 1902, rent in arrears at the same rate, and be paid on or before the lst of January, I will concede the use of the additional area of ground which you have taken possession of by the extension of your reservoir on my land; this proposed agreement to continue, if made, so long as you continue to fulfill the terms of the contract, not exceeding five years, and keep said reservoir in the condition that it shall be in after being thoroughly cleaned out, according to the original contract.
I decline to entertain any proposition about additional roads over the property. Very respectfully,

Hale arose from his chair impatiently, and moving the communication be referred to the committee, which was carried on the second of Sheppard, he procured his hat and left the hall. The meeting adjourned.
Asparagus Rust
Max Nebelung, horticultural commissioner, is in receipt of a circular letter from State Board of Horticulture, informing him of the fact that the executive committee of the board have ordered that asparagus roots and seeds raised in any place outside the boundaries of California are prohibited from being planted or offered for sale, gift or distribution within the limits of this state. Such plants are afflicted with asparagus rust, and are doing great damage in the east.
A. F. Woods, pathologist and physiologist of the Bureau of Plant Industry, United States Department of Agriculture, in a letter, has the following on asparagus rust:
"Asparagus rust is a native of Europe, and was introduced into New Jersey in 1896, and in the succeeding four years spread over the whole eastern and central United States, doing an immense amount of damage. It occurs as far west as Nebraska and the Dakotas, and it is probable that it occurs nearly everywhere east of the Rocky Mountains. It will be a difficult task to keep the rust out of California. The greatest danger lies in the introduction of the rust in young plants from the east, and to make any quarantine effective the importation of asparagus roots or plants from east of the Rocky Mountains would have to be entirely prohibited. If the California growers now purchase any plants from the Eastern States it will be practically impossible to avoid the introduction of the disease in the near future. It will be impossible to determine from an examination of roots of young plants, whether or not they are affected by rust, as the fungus lives inside the tissues of the plants and does not appear on the outside of the plant until it is nearly grown, when it bursts through the stem and leaves in the same way that the grain rusts do. No distincion appeared at the door. Going to Secretary Krick's desk, he served upon him following communication, which was read to the board:

Asparagus Rust

Mr. Hale said the company had in his opinion vacated more land in the abandonment of the old ditch than it took up in the/new. He thought the committee should consider these things carefully before agreeing to increased rental.
Mr. Crowther was of opinion the only way to settle the reservoir was to condemn it.
Mr. Sheppard said he thought so too.
Crowther reported on disputed lines at Durkee's. He had not had time to investigate, however, having been too busy talking politics. Further time was granted.
A communication was received from Mrs. E. W. Brewer, asking for the construction of a pipe crossing and the necessary connection with the Wagner ditch for the irrigation of land recently purchased by her in the Tuffree tract. To the Superintendent.
Secretary Krick read a communication from W. D. Wise & Co. of Los Angeles, in answer to one from the company inquiring relative to a rebate of $100 on two carloads of Alsen cement shipped to Horseshoe Bend at the time of making the improvements on the ditch some months ago. They wrote they did not pay the freight on the shipment, and that if the water company paid it it should look to the railroad company for the rebate.
Krick explained the company had not paid the freight, inasmuch as the railroad company had offered to haul the cement free. But the purchase, he said, was an injudicious one, for the cement cost the company 30 cents per barrel more than it ought.
A communication was received from F. C. Austin, attorney for Col. Tuffree, setting forth the fact that inasmuch as a verbal agreement had been entered into between the company and himself relative to the new contract between them, the draft of same be signed by the company and returned to him. Col. Tuffree, he said, had a number of leases awaiting the arrival of the contract, and he hoped the same would be returned promptly.
Hale asked in surprise who had made agreement on the part of the company relative to the new contract, which asks among other things increased rental for the reservoir site and other privileges which the board does not seem to be in favor of granting.
Sherwood replied the committee had introduced of the rust in young plants from the east, and to make any quarantine effective the importation of asparagus roots or plants from east of the Rocky Mountains would have to be entirely prohibited. If the California growers now purchase any plants from the Eastern States it will be practically impossible to avoid the introduction of the disease in the near future. It will be impossible to determine, from an examination of roots of young plants, whether or not they are affected by rust, as the fungus lives inside the tissues of the plants and does not appear on the outside of the plant until it is nearly grown, when it bursts through the stem and leaves in the same way that the grain rusts do. No distinction can be made between healthy and diseased plants, as far as importations into California are concerned.
"The importation of asparagus seed will also be attended with considerable risk. It is not probable that the rust fungus exists inside the seed, but in the process of gathering and cleaning, the seed will come into contact with the rusty branches and get covered with the spores of the fungus."

A letter has been received from S.G.Wilson by a friend in the setting forth the sad news that Wilson is very low with blood pilling at his home in Fillmore,Vicinity and is scarcely expected to cover.He has been in bed five days off he officiated at a surgical open and sustained a cut which brought the malady.
