The Southern Pacific Railroad Company have filed a petition with the Secretary of the Anaheim Irrigation District, praying that their property situated in the district be excluded therefrom. The property includes 7.75 miles of roadbed, telegraph lines, lands, etc., assessed last year at a total valuation of $75,835, and taxed for $379.18. The tax, however, has not been paid. The petition will be heard at the meeting of the board to be held on June 2d next. The petition will be found printed en extenso in our advertising columns.
This very serious complication of our district's affairs deserves the careful consideration of every taxpayer in this community. The law, however, is very plain upon this point, and the Board of Directors may in their discretion refuse to grant the petition. Chapter 21 of the Wright Act provides for the exclusion of lands from irrigation districts. Let us look at it closely, and see how the railroad stands.
Section 1 of that chapter refers to the changing of boundaries of any district, and for the exclusion of lands therefrom, and continues:
"but neither such change of the boundaries, nor such exclusion of lands from the district, shall impair or affect its organization, or its right in or to property, or any of its rights or privileges, of whatever kind or nature, nor shall it affect, impair or discharge any contract, obligation, lien or charge for or upon which it was or might become liable or chargeable had such change of its boundaries not been made, or had not any land been excluded from the district."
Section 2 reads as follows:
Sec. 2. The owner or owners in fee of one or more tracts of land which constitute a portion of an irrigation district, may file with the Board of Directors of the district a petition, praying that such tracts and any other tracts contiguous thereto, may be excluded and taken from said district. The petition shall describe the boundaries of the land which the petitioners desire to have excluded from the district, and the land of each of such petitions, which are included within such boundaries; but the description of such lands need not be more particular or certain than is required when the lands are entered in the assessment book by the County Assessor. Such petition must be acknowledged in the same manner and form as is required in case of a conveyance of land.
"The intimation of Marquis Rudini that the telegram in question was delivered in strict confidence, is a total error. His telegram expressed the demand of the Italian government; it was impossible Marquis Rudini could transmit it in strict confidence. As I already stated, it was communicated to me in person by Baron Fava, written in English in his own handwriting, with a suggestion of privacy, and the telegram itself has not a single mark or point upon it denoting confidential character. I have caused a number of copies of the telegram to be forwarded you to day, in fac-simile. The usual mark for italic printing was used by me under four lines, and they appear in the copies. You will use the fac-simile in such a manner as will most effectually prove the error into which Marquis Rudini has fallen.

Blaine is embitteredly and at all times correct in this whole business, and the people of the United States are with him every time. We are the people.
For his zealous advocacy of the removal of the irrigation office to Fullerton, Director Crowther will probably find that he has come out at the little end of the horn. Two of his tenants in town have given notice of their intention forthwith to move out of his houses, taking this emphatic means of showing their disapportionment of his course. We doubt very much if Mr. Crowther voices the sentiments of the majority of the people of Placentia in advocating the removal of the office to Fullerton. We think the majority of them favor Anaheim as the meeting place. Great things were promised us from the Placentia Director at the time of his election, but his course has sparcely been distinguished by any great degree of brilliancy—on the contrary, quite the reverse. New that he has the vigorous protests of his tenants in town flapping about his ears and pocket nerves, doubledless he wishes that he had remained, like Cinchinatus, at his plow and not left it to mingle with men in public affairs. On the whole, we think that Anaheim will hereafter be found quite good enough for Mr. Crowther, and that in future he will be found voting pretty much that way.

Section 2 reads as follows:
Sec. 2. Such petition must be acknowledged in the same manner and form as is required in case of a conveyance of land, and the acknowledgment shall have the same force and effect as evidence as the acknowledgement of such conveyance.
Section 3 relates to the publication of the petition praying for the exclusion of lands from the district, and the time for hearing the same. "The notice shall state the filing of such petition; the names of the petitioners; a description of the lands mentioned in said petition, and the prayer of said petition; and it shall notify all persons interested in or that may be affected by such change of the boundaries of the district, to appear at the office of said board at a time named in said notice, and show cause why the change of the boundaries of said district, as proposed in said petition, should not be made. The time to be specified in the notice at which they shall be required to show cause shall be the regular meeting of the board, next after the expiration of the time for the publication of the notice."
Sections 4 and 5 are as follows:
Sec. 4. The Board of Directors, at the time and place mentioned in the notice, or at the time or times to which the hearing of said petition may be adjourned, shall proceed to hear the petition and all objections thereto presented in writing by any person showing cause as aforesaid to the prayer of said petition should not be granted. The failure of any person interested in hearing this protest in writing laying out tract or tracts of land against said petition should not be excluded from said district, shall be deemed and taken as an assent by him to the exclusion of such tract or tracts of land, or any part thereof, from said district; and the filing of such petition with such board, as aforesaid, shall be deemed and taken as an assent by each and all of such petitioners to the exclusion from such district of the lands mentioned in the notice or any part thereof.
Sec. 5. The Board of Directors, if they deem it not for the best interest of the district that the lands mentioned in the petition, or some portion thereof, should be excluded from said district, shall order that said petition be denied; but if they deem it for the best interests of the district that the lands mentioned in the petition, or some portion thereof, be excluded from the district, an officer who was interested in the discussion in writing why the possession should not be excluded from the district, or if having shown cause, withdraws the same, and also, if there be no outstanding bonds of the district, then the board may order that the lands mentioned in the petition, or some defined portion thereof, be excluded from the district.
Sections 6 to 12 relates to exclusion of lands from districts having a bonded indebtedness. As our district has no such indebtedness, the sections have no reference to our case, and we may pass over them.
Section 13 reads:
Sec. 13. In case of the exclusion of any lands under the provisions of this Act, there shall be refunded to any and all persons who have paid assessments to such district, on any lands so excluded, any sums or sums so paid. Such payments shall be made in the same manner as other claims against such district, and from such fund or funds as the Board of Directors may designate.
Section 14 provides for the taking effect of the Act, which dates from and after its passage. The Act was approved February 16, 1889.
The trip mapped out for the Editorial Association in July, to Flagstaff, Arizona, and the Grand Canyon of the Colorado, while splendidly captivating as it must be to everyone, is nevertheless destined to be of such length that we doubt if many editors of our section may look forward with any reasonable expectation of attending. We learn that a stage trip of some sixty-five miles must be made from Flagstaff to the canyon, and this in itself will act as a bar to many. It will require no less than five days to make the trip to the canyon and back again, and what with sightseeing and the necessary business to be transacted, more than a week will be necessary for the journey. This is more time than many of us can spare from business requirements. The Association has cordial invitations from Fresno and the Coronado Hotel Company, either one of which, we submit, will be more agreeable at this time to a majority of the members. We hope the Executive Committee, at its meeting on the 26th instant, will decide to defer the Flagstaff visit, with thanks to the liberal-spirited Santa Fe Railroad Company, and accept either one of their others.
Frank Dyer has been sentenced to three months' imprisonment for shooting James Taylor for persecuting his wife. Dyer withdraw his plea of not guilty to the charge of assault to murder, and was given the privilege of pleading guilty to a charge of assault with a deadly weapon. Had he stood trial on the former charge, it is probable he would have been honorably acquitted. Dyer is a clever, gentlemanly fellow, and is to be commiserated in his misfortune.
The body of Louis Munson, late editor of the Banning Herald, whose untimely death was mentioned in these columns last week, was cremated at Los Angeles on Saturday. The last sad rites were attended by his relatives and friends. The Herald will be continued by the enterprising citizens of Banning.

In answer to Di Rudini's letter, printed on the first page this morning, Secretary Blaine transmitted to Minister Porter on Monday the following very pointed reply:
"A series of statements addressed to Marquis Imperiali by Marquis Rudini were telegrammed from Rome yesterday, and published by the Associated Press in the United States today. The only part of Rudini's communication which this government desires to notice is the one here quoted, namely:
I have now before me a note addressed to you by Secretary Blaine, April 14th. Its personal produces a most painful impression upon me. I will not stop to lay stress upon the lack of conformity to usages displayed in making use, as Blaine did not hesitate to do, of a portion of a telegram of milie communicated to him in strict confidence in order to get rid of the question clearly defined in our official documents, which alone possess diplomatic value.
"The telegram of March 14th, concerning whose public use Marquis Rudini complains, is the following, which is quoted in full in my note of April 14th, to Marquis Imperiali at Washington:
Rome, Mareh 24th.
Italian Minister, Washington: Our requests of the Federal Government are very simple. Some talian would have been honorably acquitted. Dyer is a clever, gentlemanly fellow, and is to be commiserated in his misfortune.

Through the Weary Hours Of many a night, made doubly long by its protracted agony, the rheumatic sufferer tosses to and fro on his sleepless couch, vainly praying for that rest which only comes by fits and starts. Like all sterling remedies, however, it deserves a practical, systematic trial, and should not be abandoned because not at once remedial. It is equally efficacious in dyspepsia, indigestion and kindred diseases.

Stockholders' Meeting.
AT A CONFERENCE OF BOARDS OF DIRECTORS of the Anaheim Union Water Company and of the Anaheim Irrigation District, held Saturday, April 18, 1891, the following was agreed upon as a basis of settlement:
That when the Anaheim Irrigation District shall have expended the sum of one hundred thousand dollars ($100,000) in improvements in accordance with the plans of the engineer now on file, then the Anaheim Union Water Company will accept one hundred and fifty thousand ($150,000) dollars in cash or its equivalent in bonds, subject to the approval of the stockholders provided the Anaheim Irrigation District proceed to carry out its agreement within one year from the date of ratification by the stockholders.
In accordance with the above and a resolution of the Board of Directors of the Anaheim Union Water Company, adopted at a regular meeting of said board on the 18th day of April, A.D. 1891, a meeting of the stockholders is hereby called to convene in the office of the company in Anaheim on
