The Weekly Gazette. ISSUE D EVERY THURSDAY. Henry Kuchel, Charles Kuchel, Editors and Producers. THURSDAY NOVEMBER 21, 1829 ATTORNEY SHINN informs us that, in the matter of the opinion filed by Messrs. Houghton, Campbell & Silent in the tax levy matter of the Anaheim Irrigation District, his opinion and that of the other lawyers were exactly similar, only that they had pursued their investigations further and consequently gone into the subject more elaborately. This has not been understood to be the fact of the case. In the matter of the neglect to post notices of the hearing of the petition to sell bonds by the district, he informs us further that his duties ceased when he filed the order of the court. Moreover, he asserts that some expense has been entailed upon him in his capacity as attorney for the district and that his salary demand of $200 is extremely reasonable. As stated last week, these matters should be before the public. The people's money is what pays for the running expenses of the district, and they have a right to be informed fully as to the state of affairs. There is no disposition to prejudice the gentleman, but the fact remains that our district is paying too much for its law. In conversation with members of the Board of Directors it appears that Mr. Shinn's statement, that his opinion connected with that of Mr. Houghton, is not apprehensibly correct. In fact, the absence of any definite policy in Mr. Shinn's opinion was the cause of seeking additional aid. If Mr. Houghton's opinion is similar to that of Mr. Shinn, and both of them agreed upon the method of the tax levy if there was no real necessity for employing an additional firm of lawyers to solve the matter—then the Board of Directors have unwarrantly contracted a debt of $50, which the people's money is bound to settle for. If it was necessary to employ another attorney when we incline to believe was the case, no one can foretell how soon the same presbusiness may arise again, and to what extent outlay the board may find themselves compelled to go in order to satisfy themselves in intricate points of law where Mr. Shinn may improperly handle in the development of her grant resources. The Empire represents the last of all the political institutions planted by Europe in South America. All the others have been changed to republica. Even Marx could not tolerate the rule of Spain. The most striking fact is the thorough spreading of political institutions formed on European models in North and South America. NEWS IN BRIEF. Clear weather is reported for Southern California by the signal service. Humboldt county will have to import potatoes on cocoon of a light crop. Richard Gird of the Chino ranch, it is said, owns a full brother to Sunol. El Cajon valley has shipped forty-one carloads of rainside the present season. One branch of a Japanese perennial tree in Riverside has 200 ripe permimums. Riverside markets showed a twenty seven and a half pound potato and a forty pound turkey last week. Spanish postage stamps are to bear the image of the baby king. No other kid in the world will get so many lickings. A band of 1,000 sheep were turned into a seventy-six vineyard near Woodland last week to harvest the first and second crops of grapes. The Elk Grove Flour Mill, owned by Hill & Baner, at Elk Grove, in Sacramento county, was totally destroyed by fire last week. Lions over $10,000; insurance, about $4,000. The tire was started by tramps. A cowota came to the side of the road in Ojai Valley, in Santa Barbara county, last Thursday evening just as the stage was passing. The animal howled and the driver throw out the express-box and mail bags and held up his horse. The Orland Irrigation District opened bids for the sale of $50,000 in bonds a few days since and had plenty of offers to take the bonds at ninety cents, but they sensibly declined to sell them for less than par. The Secretary of the Navy has advertised for proposition to build the hull and machinery of two steel gunboats of one thousand tons each and a steel practice vessel of eight hundred tons. The proposals are to be received until January 23d. A petition was filed to-day asking for the formation of the Kirkwood irrigation district, which includes all the lands of the Elmore colony in Tehama county, 42,000 acres in all. Water will be obtained by storage reservoirs from Thames creek. The petition will be heard December 5th. The Pomona Wine Company has now 35,000 gallons of wine on board a ship bound It was to have been expected that a meeting brought with such importance as that of Monday afternoon, when the stockholders of the Anaheim Water company were to devise means for the immediate transfer of their property to the irrigation district, would have been attended by a quorum of those interested. Notwithstanding this fact, no such quorum was present, and while those present at the meeting were agreed upon the formulation of a plan of action in the matter, no steps could be taken because of the absence of too many shareholders. This is not as it should be, and at the next meeting to be held on Saturday, every shareholder in the old company should be present. The old company should transfer its property to the new with a happy depatch, and this can only be accomplished by having a quorum of stockholders present. Is future officers of this county in pursuit of criminals will be allowed per diem consideration, when it is necessary for them to go outside the limits of the county to effect a capture. Herefore it has been customary in some cases to charge a mileage fee, which practice was not allowed in the case of Marshal Landell, who went to Bakersfield for the horse thief Melendrez. Only his expenses were liquidated by the county, we understand, and he intends to bring suit to recover the balance of his claims. In cases like this, where an officer becomes instrumental in breaking up a gang of horse thieves, we think a mileage fee should by all means be allowed. Of course the statutes may be abused, as in the case of the Lancaster Constable who entered extensively into the business of tramp catching and robbing the county at one and the same time. At present it is optional with the Board of Supervisors whether they pay mileage outside the county or not, and the character solely of each individual case should influence their action. Some officers may deserve it while others may not. The journey will consume about five months, and it is expected the wine will be unloaded in New York next February. The water freight on the wine will be 5 cents a gallon. Next Saturday the steamer Mariposa will sail for Australia. As part of her freight she will carry 1,500 boxes of raisins, put up in Fresno county. It is believed that it is the beginning of a trade which will prove almost incalculable benefit to the raisin industry and to the whole State. The Grand Jury of San Bernardino has cited Governor Waterman, H. G. Otis of the Los Angeles Times, editor Munsen of the Banning Herald, Seth Marshall, and several others, to appear before them and testify regarding the charges of bribery made against the commission in selecting a site for the Southern California Insane Asylum. Riverside raisins to the amount of 3,069,-550 pounds, or over 153 carloads had been shipped up to Wednesday last, since which time a train of twelve cars has gone out, bringing the total to 166 carloads. The fruit is now being packed so rapidly that it has been found necessary to run a raisin special three times a week, instead of twice as heretofore. Nellie Bly, a well-known New York newspaper woman, started on Saturday on a rapid trip around the world and will attempt to make the journey in seventy-five days, due to arrive in San Francisco January 22d. She left New York City on the fastest Atlantic liner, is due at Queenstown to morrow, and skips thence through the Suez canal into the depths of the Old World. Good luck to Nellie. An irrigation district under the Wright law, embracing 200,000 acres surrounding the towns of Selma and Kingsbury, near Fresno, has been formed. The district includes the land through which flow the Fowler switch, Centerville, Kingsbury, Emigrant and Laberty canals. Bonds to the amount of $200,000 will be issued. The canals in operation will be bought and other water rights acquired. Jim S. Callen, Assistant City Attorney of San Diego, was recently called to Arizona to defend his father on a charge of murder, the latter having killed a man in self-defense. In his plea before the court he said: "If every mountain-side from where yonder scaffold in the Courthouse stands to the relator's home in Kansas, tar away, where his wife and children await our Christmas coming home, unconscious of this hearing going on, were covered with scaffolds, and hungering for his body, and if every valley in between were yearning to giveit a burial place, I still should say that he would have been coward and unworthy of the love I bear him were he to have left me fatherless by doing less than what he was so unfortunately compelled to do." The father was discharged. A dispatch from Rio de Janeiro dated Saturday reports a republic has been proclaimed with Renahora da Fonseca as President. ROADMASTER PORTER appeared before the board of Supervisors on Monday to demand full payment for services rendered by his men recently at work on county roads. He contracted to pay the usual $2 per diem and is responsible to his men for that amount. The board cut the demand down to $1 50 per day, at which Mr. Porter very justly interposes an objection. His work has always been of the beat, and he is known as one of the best roadmasters in the county. Two dollars per day is the usual compensation for work such as has been performed by the men—difficult grading in canyons and exceedingly rough places in which to work—and the pay should be allowed. Orange county does not desire an individual roadmaster to pay out of his private purse for work performed for the people—which Mr. Porter will be compelled to do in this case if his claim is not allowed. The demand is made on behalf of laboring men, and we look for its speedily payment by the Supervisors. This continent of South America, with the exception of Brazil, is under nominal republic rule. Those republics are on the whole in a prosperous condition. The Argentine Confederation, although deeply in debt, has a vast deal of natural wealth. Chili is a prosperous republic. The States united in the Colombian federation are increasing in wealth and population. The Central American States are seeking a closer union. The Imperial Ministers are arrested and kept in close confinement. The provisional government has guaranteed protection to the members of the imperial family. The Emperor is at his summer palace at Petropolis, twenty-five miles of Rio de Janeiro. All the business in the city is suspended, but there is no danger to life or property. Emperor Dom Pedro was ordered to leave the republic in twenty-four hours. He acknowledged the receipt of this order and sailed with his family to Lisbon on board the packet Alagoa. Barbosa, the new Minister of Finance, announces that all contracts entered into by the late Imperial Government will be maintained. An allowance will be paid the Emperor during his exile in Europe. Viscount Curo-Portin, former Minister of the Interior, and Senior Maywhick, one of the leading bankers of Rio, have been arrested and thrown in prison. Dom Pedro was treated with the utmost courtesy. Bahia is opposed to the new regime, but most of the other provinces recognize the republic. The government corvette Bartholomew Diaz has been dispatched to Rio Janeiro. The new government has announced that it will firmly maintain order. It is preparing a circular to foreign governments relative to the overthrow of the Emperor, which will be telegraphed to them through the Brazilian representatives abroad. The province of Bahia has signified its adherence to the republic, and the news from other provinces shows that they are also in favor of a republican form of government. The overthrow of the empire was accomplished without the morris of a single life, and the new Provisional Government is proceeding with its work as authoritatively and peacefully as though it had been in existence for years. Dom Pedro was offered $2,000,000 in cash and provision for the rest of his life in the form of an annual pension of $460,000, to be provided for in the civil list of the new republic. Helpgroup accepted the offer and went to Rio de Janeiro with his family, to embark for Lisbon. Dom Pedro and family go into perpetual mills their advantage being regarded by the leaders of the S. S.
