The erudition displayed by the legal advisor of this county (our friend Judge DePay) is most remarkable, we may say any phenomenal. His decision on the question recently referred to him by the Board of Supervisors in relation to the formation of our water district reminds us of the famous opinion of Jack Banshy in Dombey & Son. When asked if he thought Walter was beat, Indian oracular manner and proceeding slowly he thus expressed himself: "Do I believe that this here son and heir's gone down, my lad? Mahap. Do I say so? Which? If a skipper stands out by Sin George's channel, making for the Downs, what's right ahead of him? The Goodwins. He isn't forced to ryn upon the Goodwins, but he may. The hearings of this observation lay in the application on it. That isn't no part of my duty. It was no part of the Judge's duty to defeat our water district. The hearings of his decision rests "on the application on it."
An article upon the solar eclipse of Tuesday night, written by Professor George Davidson, is a feature of this week's issue. The eclipse is one of transcendent importance to science. Given a fair day for observation the result of the eclipse will rebound greater to the cause of learning than any event, probably, in all time. Professor Davidson is a scientist of renown and a thinker acknowledged the world over. His article will be found of great interest.

THE TAX ON MORTGAGES
An Interesting Question Unleashed by a Levy Company.
The German Saving society of San Francisco have raised an important question regarding to the system of assessments upon real property in this State. As is generally known the owner of mortgaged real estate is entitled to an exemption of the face of his mortgage from his assessment. It is also known that in many cases the valuation of the real property as shown by the assessment, is less than the face of the mortgage. The rule heretofore applied, however, compels the mortgage to pay upon the face of the mortgage regardless of the valuation of the installed property. This is the case on property, mortgaged to the San Francisco loan company above named, and they have tendered to the City Treasurer of Los Angeles the amount of tax represented by the valuation of the real estate against which they hold liens. The City Treasurer demanded that tax upon the face of this mortgage be refused to accept the same offered. The treasurer communicated the facts to the City Council on Monday and the matter was referred to the City Attorney for a legal opinion upon the subject. To illustrate suppose a piece of real estate to be worth $6,000. A loan of $2,500 is made by the San Francisco or any other company. The property is listed upon the tax assessor's book at $2,000. The owner of the real estate claims his exemption and pays no tax. The mortgage pays 2% or 3 per cent, upon the 22 lee if the nana custom prevails. The German Saving society tender 2% or 3 per cent, upon $2,000, the assessed value of the real estate, and the treasurer refuses to accept it. This is the question which the City Attorney will be called upon to pass an opinion. If his opinion maintains the City Treasurer that fee will probably being suit for the tax and so the subject will be taken to the court.

His daughter, who is a high spirited and intelligent girl, decided to make her father a present of a library. To that end she began newspaper work, and she has devoted all her energies to making good the loss occasioned by her son's death. She is a canoeist, aviable, and independent young woman, and is meeting with success in newspaper work. Senator Lingua's is a poor man, despite his extended term of office. It seems odd that a man occupying the place of virtual Vice President of the United States should receive no more than eight thousand dollars a year from the government.
The grand ship of state, "the French Republic," appears to be drifting hopelessly on a lee shore, where wreck and ruin will be her fate unless some capable commander can secure the helm and steer her safely through the rocks and breakora that loosen her. The present Government inspires neither conscience nor enthusiasm, and the people are merely seeking for the man of the future. "Jack the Ripper," is, of course, a person of considerable note in London at present. To that end, we unreely hope that he may soon recover from his serious financial embarrassment. The question now arises, what part will this office take in the settlement of the gentleman's affair, in the event of their being thrown into the hands of an assignee. Perhaps his liability of ninety cents (90 cents) would not cut much figure in the final settlement in bankruptcy. But on the other hand, perhaps we might be the largest loser of all Mr. Campbell's creditors.
In this latter event Mr.C. is sincerely to be commemorated upon his extreme poverty. But following in the line of the axiom that it's an ill wind that blows nobody good, the gentleman must be congratulated upon the fact that, if his liability of 90 cents is too large for his purse to meet at the present writing, the amount will be found to be more easily overcome than a larger sum when he pulls himself together and tickles that porse with the wherewithal of a stake.
