WEEKLY GAZETTE SATURDAY...JAN. 20, 1883 Kleinigkeiten. What a miserably little debt-ridden section Orange county would be! A recent arrival from Illinois is seriously thinking of going back there to get warmed up again. Mr. George Hansler has sold his Westminster place to Win. Haag and has removed to Cucamonga. Miss Selbert advertises that she is prepared to teach a limited number of scholars in music. This has been a splendid year for farmers. So far, they have not had to quit work on account of the rain. Representative Head has introduced a bill in the Assembly providing for Local Option, by precincts, wards and counties. A lady's gold pin was found on the steps of Kroger's Hall by Mr. C. E. Brown. It has been left at this office, awaiting a claimant. If the person who stole the cultivator from Fred Harting's vineyard will return it he will be spared the humiliation of an arrest by the Sheriff. He is known. The very handsome pole in front of Mr. Frank Ey's tonsorial parlor is much admired. Missionary Meeting. On Thursday last ladies representing different churches in Los Angeles Presbytery met in the Presbyterian church for the purpose of organizing a Woman's Presbyterial Home and Foreign Missionary Society. In the afternoon delegates from Los Angeles, East Los Angeles, Riverside, Santa Monica, Santa Ana, Orange, Westminster and Anaheim, thirty in all, adopted a constitution and by laws and elected officers. The ladies then adjourned to the residence of the pastor of the church and refreshments were served by the ladies of Anaheim and Westminster churches. A popular meeting was held in the evening. The large audience present was deeply interested in an address by Mrs. Condit, of Riverside, who has been long engaged in missionary work among the Chinese in San Francisco, Oakland and Los Angeles. She read a paper giving an interesting account of the work done by the women of the church during the last ten years, and afterward exhibited some Chinese curiosities. Mrs J.H. Clark of Santa Ana followed in a thrilling personal appeal for missionary workers. Reports from various missionary societies in the Presbytery were given. During the evening several choice musical selections were rendered by Prof. Packard, assisted by Miss Vanderlip of Santa Ana. The pastor gave some interesting figures showing the success of the Woman's work. The gathering as a whole was a remarkable success in every particular, and all feel encouraged for further effort. A month or so ago there was quite an exodus of sheep-men from this vicinity. They and their flocks started forth in search of pastures green. But they are returning again, one by one, having found that the grass is more plentiful here than in other parts of the State. Their case is parallel. The sausage and other delicacies made by Koop & Co., are finding a good sale. They are experienced in the manufacture of these articles. A crumb of comfort. Last season the rainfall to present date was 2/3 of an inch less than we have had thus far. Yet the season closed with 7/8 inches. Our clubbing arrangement with the American Agricultural Society is taking well. It is a magnificent journal the best of its kind published in America. A sample copy can be seen at this office. Mr. John Hauna reports having made the following sales of real estate: Murdock Henry to Frank Moore, 40 acres west of town; Bank of Anaheim to Mr. Cosquette, 28 acres adjoining Sheldon's orange orchard. It is now said that dried leaves of the blue gum tree, smoked in a new clay pipe, will cure a cold. It is not stated whether the cure is effected by the death of the smoker. Mr. Wm R Harker, the new saddler, has a fine stock of harness, saddles, etc., in his store. He is a good workman, has come here to stay, and hopes to be liberally patronized. The Anaheim Gymnastics and Minstrel Club, composed of young men of pronounced athletic and musical talent, propose to give an entertainment on the 28th instant. The programme will be published next week. We are indebted to Mr. George Gannaway for several copies of Gall's News Letter, and other papers published at Kingston, Jamaica. The numbers before us contain detailed accounts of the great fire which almost obliterated that city in December. A lecture on music was given on Tuesday evening by Prof. Le Port Van Sant to a large audience. At its conclusion a singing class of thirty-six members was organized, and the number has since increased to over forty. The first lesson will be given this evening. A month or so ago there was quite an exodus of sheep-men from this vicinity. They and their flocks started forth in search of pastures green. But they are returning again, one by one, having found that the grass is more plentiful here than in other parts of the State. Their case is parallel with that of the Massachusetts man who announced his determination to emigrate to some Republican State if Ben Butler was elected Governor of the Commonwealth. On the morning after the election he began preparations for his removal in accordance with his resolve, but happened to glance at the election returns in the telegraphic columns of the newspaper. As the nature of the returns dawned upon him, he said to his wife with a sigh: "We'll have to stay here, Jennima; there's no place to go to." So although it is undemnable that grass is short here, the sheep owner must grin and bear it, as there is no place for him to go. On list Tuesday the following notice was posted on the bank of the Santa Ana river at the point where the old Anaheim ditch has its connection with said river: "Water Notice—Notice is hereby given that we, the undersigned, B. Dreytus, A. Langenberger and F. A. Korn do hereby take up, claim, locate and appropriate all the waters flowing in the bed of the Santa Ana river, opposite the point where this notice is posted, to the extent of four thousand inches under a four inch pressure. We claim said waters for the purposes of irrigation, manufacturing and domestic use, and the place of intended use thereof is the Rancho San Juan Capon de Santa Ana. The means by which we intend to divert said waters so claimed as aforesaid is a water ditch, and the size of the ditch by which we intend to divert it will be twelve by three feet. The Anaheim Social Club met on Thursday evening to discuss the question of giving a Masquerade Ball. The Club were unanimously in favor of such a ball, but in order that all might have an opportunity to be present it was decided to postpone until after Lent. March 22d is the date fixed for the event. The Anaheim Public Schools reopened on Monday with 180 pupils in attendance—an increase of 30 over the attendance before the vacation. In Mrs. Alward's Department there are 63; in Miss Crenshaw's, 49; in Miss King's, 36, and in the Principal's room, 32. As there are other pupils yet to enter, additional facilities for seating must be provided. Mr. S. B. Smith, the agent for the California Windmill, has just put up a mill for Mr. Langenberger. Among the mills recently put up by Mr. Smith is one for Mr. Louis Schorn, one for Mr. C. R. Brown, and one for Kramer Brothers. The California is becoming more popular as it becomes better known. Mr. Smith made a contract yesterday to put up a mill for Mr. A. McDermont. We have heard a report that Mr. B. F. Seibert intends to return to this town, and resume the banking business, backed by responsible parties. The report, which is said to have come direct, is to the effect that Seibert will pay off all the small depositors in full and make satisfactory arrangements with the larger ones. —Santa Ana Herald. Mr. Seibert informs us that it is a fact that negotiations are now pending which may result in his resuming the banking business in Santa Ana. And to Provide for its Organization. The People of the State of California, represented in Senate and Assembly, do enact as follows: SECTION 1. There shall be formed out of the southeast part of Los Angeles county, a new county, to be called Orange. SEC. 2. The boundaries of Orange county shall be as follows: Beginning at a point in the Pacific Ocean three miles southwest of the center of the mouth of Coyote Creek, proceeding up said creek in a northeasterly direction to the northeast corner of section four, township three south, range ten west; thence in an easterly direction along the township line between townships 2 and 3 south of the San Bernardino Base line until it intercepts the boundary line between San Bernardino and Los Angeles counties; thence along said boundary line southeasterly until it intersects the boundary line of San Diego county; thence along said boundary line southwesterly until it reaches the Pacific Coast; thence in the same direction to a point three miles in said Pacific Ocean; thence in a northwesterly line parallel to said coast to the point of beginning. SEC. 3. The county seat of the county of Orange shall be chosen as hereinafter provided. SEC. 4. The Governor shall, when this Act takes effect, appoint five persons, residents and electors of the county of Orange, who shall be and constitute a Board of Commissioners to perfect the organization of the said county, a majority of whom shall constitute a quorum. Said Commissioners shall meet in the town of Santa Ana within twenty days after their appointment, and after being duly sworn to faithfully discharge their duties as prescribed by this Act, shall or further, that in all criminal cases where the offense was committed within the present limits of Orange County, upon the application of the District Attorney of Orange County, said cases shall be removed to Orange fair evidence of the qualification of electors. The County Clerk of Los Angeles county is hereby directed to furnish the Commissioners of Orange county the additional names of voters on the great register of Los Angeles county, registered to reside in the territory forming the county of Orange since the last great register of Los Angeles county was printed. SEC. 7. It shall be the duty of the Board of Supervisors of Orange county, whose election is by this Act provided for, to meet at the county seat on the first Monday of the month subsequent to their election and qualification, the member representing District number one being Chairman. They shall then allow such remuneration to the Commissioners and officers of election as they may think just and proper, and such allowance shall be paid by a warrant drawn in favor of each by the proper officers. Said Board, or a majority of them, shall then appoint two freeholders, residents of Orange county, to act as a Board of Commissioners, whose duty it shall be to meet a like number of Commissioners, appointed by the Board of Supervisors of Los Angeles county, at a time and place agreed on. Such joint Commissioners shall then organize by appointing from their number a President and Secretary, and shall immediately proceed to determine the indebtedness of said county at the time this Act takes effect; said Commissioners shall have power to compel the attendance of such persons and the production of such books and papers before them as they may require in the duties imposed by this Act; and it shall be the duty of the Sheriffs of Los Angeles and Orange Counties to execute all lawful orders of said Commissioners in their respective counties, and for any services performed the Sheriffs shall be allowed the same fees as are allowed for like services in civil cases, and all witnesses attending before these Commissioners by their order shall be entitled to the same compensation and mileage as is allowed to witnesses Orange County bonds as shall be redeemed by such payment. Said bonds shall then be canceled, and on their face countersigned by the Chairman of the Board of Supervisors, and filed in the Clerk's office. Said Board of Supervisors shall exercise such other powers and duties as are conferred by the general laws on Boards of Supervisors in the counties of the State. The levy of taxes and elections held for the first year shall be effective as if levied or held at the time provided in the general laws, being regulated, however, by the general laws as far as practicable. SEC. 8. The Board of Supervisors of Orange County are hereby authorized to provide suitable books and contract with some competent person for transcribing from the records of Los Angeles County such parts thereof as relate to property situated in Orange County; and said records, when so transcribed and certified, shall have the same force and effect as such original records. The person so employed shall have access to said records of Los Angeles County for said purposes of transcribing the same. The compensation for said service shall be fixed and allowed by the Board of Supervisors of Orange County, not to exceed, for transcribing, fifteen cents per folio. The Recorder of Los Angeles County shall examine said transcript and certify to the correctness of each deed, mortgage, and other instrument, and affix his seal to the same, for which service he shall receive a sum not to exceed twenty-five cents for each instrument examined, certified, and sealed. For each instrument found to be incorrectly transcribed, he shall receive a fee of fifty cents, to be deducted from the pay of the party who transcribed the same. SEC. 9. All actions or special proceedings whether original or upon appeal, civil or criminal, which shall be pending in the Superior Court in the County of Los Angeles at the time of the organization of Orange County, in which the defendants are residents of Orange County, shall be removed for trial and final determination to the Superior Court of Orange County, on motion of any party interested; provided that all actions commenced for the collection of taxes or licenses, shall not be removed from the Courts of Los Angeles County; provided further, that in all criminal cases where the offense was committed within the present limits of Orange County, upon the application of the District Attorney of Orange County, said cases should be removed to Orange SEC. 3. They shall also establish election precincts in said county. They shall give thirty days' notice, by publication in one or more newspapers published in the county, of the precincts established, and shall designate the name and boundaries of each Supervisor's district. Said Commissioners, their President and Secretary, are hereby authorized and required to discharge the same duties as are now required by law of Boards of Supervisors and County Clerks in the counties of this State, so far as the same applies to holding elections, canvass returns, and issuing certificates of election. They shall keep a full record of all their proceedings, transmitting to the Secretary of State a certified copy thereof, filing the originals with the original election returns in the County Clerk's office as soon as he shall have been qualified, and thereupon the powers and duties of said Commissioners shall cease and terminate. SEC. 5. Within sixty days from the time of the first meeting of the Commissioners heretotene provided for, said Commissioners shall order an election to be held in said county of Orange, which shall be held in the manner, so far as practicable, as required by the Political Code, sections one thousand and forty-one to one thousand two hundred and ninety-seven, inclusive; provided that said Board of Commissioners shall continue to hold their meetings in the town of Santa Ana until they have completed the canvass of the returns of the election and issue the certificates of election required by this Act. There shall be chosen at said election by the qualified electors of said county, one Superior Judge, one District Attorney, one County Clerk, who shall be ex officio Clerk of the Superior Court, and Clerk of the Board of Supervisors, one Recorder, who shall be ex officio Auditor, one Sheriff, who shall be ex officio Tax Collector, one County Treasurer, one County Assessor, one County Superintendent of Public Schools, one County Surveyor, one County Coroner, who shall be ex officio Public Administrator. There shall be chosen at said election one Supervisor for each county. SEC. 6. The missionary work is conducted according to the instructions given by the local authorities. SEC. 7. The Superintendent of Public Schools of the County with a certified copy of the last school census list of the different school districts in the territory set apart to form Orange County, and draw his warrant on the Treasurer of Los Angeles County, in favor of the Superintendent of Schools of Orange County, for all money that is or may be due by apportionment, or otherwise, to the different school districts of Orange County; and the Auditor of Los Angeles County shall in like manner draw his warrant in favor of the Auditor of Orange County for all money that is or may be due by apportionment, or otherwise, to the different road district funds in the territory set apart to form Orange County, and said money shall be paid into the treasury of Orange County, and be properly credited to the respective districts in said county. SEC. 13. This Act shall take effect and be in force from and after the date of its passage and approval. Protest Against Division. Following is a copy of a protest which is being numerously signed: The undersigned, residents of the proposed new county of Orange, respectfully petition your honorable body not to pass the bill creating new county. We deny that any considerable number of people in the proposed new county are in favor of division; but most decidedly affirm that two-thirds of them are opposed to it. We deny that any good and sufficient reasons exist for county division. We affirm that in the proposed new county the amount of assesable property will be so small that the annual tax levy will be onerous and oppressive; that by reason of this burdensome tax land buyers and home-seekers will be driven away and the settlement of this section restored. For any fractional part of five books and papers before them as they may require in the duties imposed by this Act; and it shall be the duty of the Sheriffs of Los Angeles and Orange Counties to execute all lawful orders of said Commissioners in their respective counties, and for any services performed the Sheriffs shall be allowed the same fees as are allowed for like services in civil cases, and all witnesses attending before these Commissioners by their order shall be entitled to the same compensation and mileage as is allowed to witnesses in civil cases; provided not witnesses shall be excused from attendance at the time and place mentioned in said order or subpoena by reason of the failure of the officer making service thereof to tender his fees in advance. Should any vacancy occur in said Commission, by death, resignation, or otherwise, the Board of Supervisors of the county in which such vacancy shall occur shall have power to nil vacancy by appointment. Should the Commissioners before designated be unable to agree in the discharge of duties imposed by the provisions of this Act, they are hereby required and empowered to appoint a fifth Commissioner, which Commissioner so appointed shall be a member of said Board of Commissioners from and after his appointment. There shall be chosen at said election one Supervisor for each Supervisor's District in said county; provided that all duly elected and qualified Supervisors of Los Angeles county who, at the taking effect of this Act, are residents of Orange county, shall hold their offices for the terms provided by law, upon having duly qualified as Supervisors of Orange county for the respective districts in which they reside, as said districts are organized by the action of the Board of Commissioners provided for in this Act. There shall be chosen at said election one Justice of the Peace and one Constable for each township; provided that all Justices of the Peace and Constables acting as such at the time of the passage of this Act, residents of Orange county, shall hold their offices for the time provided by law, upon having duly qualified as Justices of the Peace and Constables of Orange county for the respective townships in which they severally reside, as said townships are organized by the action of the Board of Commissioners provided for by this Act. All the officers elected at said election, or who qualify under the provisions of this Act, shall enter immediately after their qualification upon the discharge of the duties of their respective offices, and shall hold such offices until the time provided by general law for the election and qualification of county officers in this State, and until their successors are elected and qualified. At said election shall also be submitted to the qualified electors the location of the county seat of said Orange county, and the place receiving the highest number of votes therefor shall be declared by the Commissioners the county seat of said county. Sec. 6. All qualified electors of this State who have been residents and electors of said territory of Orange county for ninety days preceding the election provided for in section five of this Act, shall be qualified to vote at said election. The great register of Los Angeles county used at the general election held in the year eighteen hundred and eighty-two in the territory of the new created county of Orange, shall be prima The property of new county shall have the same pay as Supervisors. The Board of Supervisors of Orange County shall then cause to be issued the bonds of Orange County, of five hundred dollars each, signed by the President and Clerk of the Board of Supervisors and counterigned by the Treasurer, payable in ten years from their date to the County of Los Angeles, for such sums as the Commissioners certify to be due, bearing interest at the same rate, and due upon the same days as each of the different classes of bonds of Los Angeles County which constitute the net indebtedness of said Los Angeles County, or upon such date as the Supervisors of the two Counties of Los Angeles and Orange may agree. For any fractional part of five hundred dollars, if there be such, the Auditor of Orange County shall draw his warrant in favor of Los Angeles County on the Treasurer of Orange County, to be paid with the first money collected for the sinking fund. The Board of Supervisors shall procure and provide a suitable building or buildings, to be used as a Court House and Jail, and for the accommodation of the various county officers; and for such purposes they are hereby authorized to rent, or purchase, or construct suitable buildings. And, in case of purchase, or construction, said Board are authorized to issue bonds of said county, not exceeding the sum of twenty thousand dollars, bearing not to exceed seven per cent. per annum, and payable within such times as the Board may direct, not exceeding ten years from the date of issue thereof; and provided that said bonds shall not be disposed of, or sold on behalf of said county for a less sum than ninety cents on the par value thereof. No bonds in addition to the above shall be issued; provided however, that an issue of twenty bonds of five hundred dollars, having five years to run, with interest at seven per cent. per annum, may be issued, to be known as the Organization Bonds, said bonds to be used by the Board of Supervisors to meet the expenses incurred before the taxes can be collected. It shall be the duty of the Clerk of the Board of Supervisors and County Treasurer each to keep a correct record of all bonds issued under the provisions of this Act, showing number, date of each bond, and to whom issued. The Board shall, in accordance with the general laws, levy State and county taxes; provided that for no year shall the levy exceed two per cent., or two hundred cents on the one hundred dollars taxable property.
