S. Mund, of San Luis Rey, is THE TRAGIC END OF AN OUTLAW.
About five o’clock on Monday last pistol shots, coming from the direction of Centre Street, momentarily disturbed the quiet of a sultry summer’s afternoon. Upon arriving at the spot the actors were found to be Constable Davies and a half-breed Indian, called Jose Moreno. The facts of the case, at gathered from eye-witnesses to the difficulty, are these: During the early part of the afternoon Mrs. Eldridge, who it will be remembered was the victim of a brutal robbery some two or three months ago, recognized among a party of three or four Mexicans, who were engaged in conversation across the way from her residence, the face of the man who had been the principal in the assault and robbery. Wishing to be assured of his identity beyond the possibility of mistake, she refrained from acting upon her first conviction, and critically examined the countenance, which was indelibly impressed upon her memory. After a while the man made preparations to ride away; and she, convinced by careful inspection that he was the individual, hastened to obtain the assistance of one of the officers of the law. Constable Davies was first found by her messenger and responded promptly to her request. As soon as informed of the facts, he addressed himself to the task of placing the criminal in the hands of justice. Accosting the man, he told him to come with him to the office of Justice Clark. Moreno, taken off his guard, at first made no resistance and proceeded quietly a short distance. He then stopped and demurred to being taken without his companion. Constable Davies told him that he must come along with him. He then objected to being held by the arm and said that he was “un caballero” and would make no resistance. Davies unthinkingly released him, when in an instant he found himself confronting a Colt’s dragoon pistol, cocked and in the hands of a desperado, who knew his guilt, and apprehended the consequences, which might summarily follow a general knowledge of the same. Davies promptly drew his repeater and warned him to desist. His only answer, however, was to seize the pistol of the Constable with his left hand, and to attempt with his disengaged right hand to cover his adversary with his murderous weapon. At this moment, the few spectators, who were looking upon the scene with bated breath, describe the situation as most critical for Con-

Capt. Borowe, agent at Los Angeles for the Babcock Fire Extinguisher, has been engaged during the past week, canvassing Anaheim in the interests of his employers. Vivian, the celebrated protean actor, and author of the song, "Ten thousand miles away," gave a performance at Enterprise Hall last night assisted by Madame Reifflarth, an accomplished soprano, and Madame A. A petition has been sent to the Los Angeles and San Bernardino Land Office in No. 8, Downey Block.
He found himself confronting a Colt's dragoon pistol, cocked and in the hands of a desperado, who knew his guilt, and apprehended the consequences, which summarily follow a general knowledge of the same. Davies promptly drew his repeater and warned him to desist. His only answer, however, was to seize the pistol of the Constable with his left hand, and to attempt with his disengaged right hand to cover his adversary with his murderous weapon. At this moment, the few spectators, who were looking upon the scene with bated breath, describe the situation as most critical for Constable Davies. In the grasp of a burly rufflan who superior in size, and seeming ly in strength, had obtained every advantage, it appeared almost a certainty that his life would be forfeited in the discharge of his duty. Just then two shots were fired, so close together that it required the assistance of the eye, as well as ear, to distinguish the two reports, and still in the smoke of the fire the two figures could be dimly seen, swaying to and fro in deadly struggle. Then after a momentary cessation Moreno turned, and as he ran Constable Davies' second shot brought him to the ground. He was promptly carried to a room in Mrs. Metz's building on Los Angeles street, where he was attended by Doctors Taylor and Hardin, who examined him and pronounced his wounds mortal. On Tuesday morning he was conveyed to a room in Fontana's boarding-house, where he could be made more comfortable, and every attention was rendered him until his death on Wednesday morning. Moreno received two wounds; one, entering the left side immediately below the ribs, and passing through the stomach and bowels, ranging downward; the other, striking the spine, between the shoulders.
Jose Moreno, whose life of crime has thus been ended in an attempt to defy that law, which he has before successfully violated, is reputed to be an illegitimate son of Don — Moreno, a prominent official of the provincial government of Upper California, and now a resident of Mexico. His mother was a squaw of the San Luis Rey tribe of Indians, among whom much of his life has been passed. We understand he has but recently been released from San Quentin, from which place he returned to this section only to engage in deeper and more desperate shades of crime. That he was the principal in the attack upon Mrs. Eldridge there can exist no doubt. That lady, visited the dying man, and after a most careful scrutiny solemnly identified him as the barbarous criminal. It was noticeable too that in her presence he closed his eyes and feigned unconsciousness, whilst immediately after her departure he would re-open his eyes and give utterance to an expression of the agonizing pain, in which his vitality was slowly, though surely being consumed. Whilst it is a source of regret that he brought upon himself by his violent and murderous action that death, which his crimes so richly deserved, still it must create a feeling of relief that the community is freed from the presence of Anaheim Coopership Centre Street - LOA

A petition has been sent to the Los Angeles and San Bernardino Land Company by the purchasers of the Gleeson tract, a history of which was given in our columns two weeks ago. The petitioners after reciting the facts ask the Company to give them the privilege of purchasing the land at a reasonable figure. The petition received the endorsement of W. R. Olden, agent of the Company, and we have little doubt but that the Company will deal leniently with the petitioners.
