Southern Californian. SATURDAY, MAY 4, 1872. American Epigrams. Franklin said many things that have passed into maxims, but nothing that is better known and remembered than, "He paid dear, very dear for his whistle." Washington made but very few epigrammatic speeches. Here is one: "To be prepared for war is the most effectual means of preserving peace." Did you ever hear of old John Dickinson? Well, he wrote of Americans, in 1768. "By uniting we stand, by dividing we fall." Patrick Henry, as every schoolboy knows, gave us: "Give me liberty or give me death," and "If this be treason, make the most of it." Thomas Paine had many quotable epigrammatic sentences. "Rose like a rooket, fell like a stick;" "One step from the sublime to the ridiculous;" "Times that try men's souls," etc. Jefferson's writings are so be sprinkled that it is difficult to select. In despair we jump at "Few die and none resign," certainly as applicable now to office-holders as in Jefferson's time. Henry Lee gave Washington his immortal title, "First in war, first in peace and first in the hearts of his countrymen." Charles Coteworth Pickney declared in favor of "Millions for defense, but not one cent for tribute." "Peaceably if we can, forcibly if we must," is from Josiah Quincy, 1811. John Adams did not say "Live or die, survive or perish. I'm for the Constitution," but Daniel Webster said it for him. The revolutionary age alone would fill our article with more real purpose, and when the appropriate or successor in interest ceases to use it for such purpose the right ceases. Sec. 1412. The person entitled to the use may change the place of diversion if others are not injured by such change, and may extend the ditch, fidme, pipe or aqueduct by which the diversion is made to places beyond that where the water was made. Sec. 1413. The water appropriated may be turned into the channel of another stream and mingled with its water and then reclaimed, but in reclaiming it the water already appropriated by another must not be diminished. Sec. 1414. As between appropriators, the one first in time is the first in right. Sec. 1415. A person desiring to appropriate water must post a notice, in writing, in a conscientious place at the point of intended diversion, stating therein: 1. That he claims the water there flowing to the extent of (giving the number) inches, measured under four-inch pressure; 2. The purpose for which he claims it and the place of intending use; 3. The means by which he intend to divert it, and the size of the flume ditch, pipe, or aqueduct in which he intends to divert it; A copy of the notice must, within ten days after it is posted, be recorded in the office of the Records of the county in which it is posted. Sec. 1416. Within sixty days after the notice is posted the claimant must commence the excavation or construction of the work in which he intends to divert the water, and must prosecute the work diligently and uninterruptedly to completion, unless temporarily interrupted by snow or rain. Sec. 1417. By "completion" meant conducting the waters to Charles Coteworth Pickney declared in favor of "Millions for defense, but not one cent for tribute." Davy Crockett was the illustrator author of "Be sure you are right, then go ahead." Andrew Jackson gave us "The Union—it must be preserved." Benton almost lost his original identity in "Old Billion," from his "hard money doctrines." Scott's "basty plate of soup" lasted his life time. Taylor's battle order. "A little more grape, Capt. Bragg," will be quoted after he is forgotten by "All the world and the rest of mankind." Seward is known for the "irrepressible conflict," wherever the English language is spoken. Rufus Choate gives us "glittering generalities." Tom Corwin's "Welcome with bloody hands to hospitable graves" gave him more unenviable criticism than any other saying of his life. Calhoun gave us "State rights" as a most permissive and absurd equivalent for national supremacy under the Constitution. Stringfellow was the original "Border ruffian." Douglas applied a "squatter sovereign," though it is probable that Cass invented it and Calhoun named it. War times gave us no end of epigrammatic utterances. Those of Lincoln alone would fill a volume; chiefest of all this that noble, godlike sentiment. "With charity for all and malice toward none." McClellan's chief exploit was to make us acquainted with the phrase, "Change of base." Grant gave "fight it out on this line;" "Unconditional surrender," "I propose to move immediately upon your works;" "Bottled," and a hundred others. It seems to have as caped notice that Grant is responsible for more of those characterizing elementary crystalizations of thought than any military leader of ten days after it is posted, be recorded in the office of the Recorder of the county, in which it is posted. Sec. 1416. By a compliance with the above rules the claimant's right to the use of the water relates back to the time the notice was posted. Sec. 1419. A failure to comply with such rules deprives the claimants of the right to the use of water against a subsequent claimant who complies therewith. Sec. 1420. Persons who have heretofore claimed the right to water, and who have not construed works in which to divert it, who have not diversified nor applied it to some useful purpose, may after this Title take effect, and will in twenty days thereafter proceed as in this Title provided, or the right ceases. Sec. 1421. The Recorder of each county must keep a book in which he must record the notices provided for in this Title. Sec. 1422. The rights of riparian proprietors are not affected by provisions of this Title — News. Cool — Railway Official — You better not smoke, sir. Traveler — That is exactly what my friends say. Railway Official — But you must not smoke, sir. Traveler — So my doctor tells me Railway Official (indignantly). But you shan't smoke, sir. Traveler — Ah! just what wife says. Miscellaneous. ART NOTICE BEING NOW PREPARED TO BUILD a style of picture which can be surpassed on the Pacific Coast, out of San Francisco. I would respectfully the attention of my friends, and the life generally, to the very valuable acquisitions, recently made, of the latest provenence in Photographic Art. I also pleased to announce that I have cured the services of an EMINENT AIST, late of Bradley & Balolson's Gall at San Francisco. A large number of MeChellan's chief exploit was to make us acquainted with the phrase, "Change of base." Grant gave "fight it out on this time;" "Unconditional surrender," "I propose to move immediately upon your works;" "Bottled," and a hundred others. It seems to have escaped notice that Grant is responsible for more of those characterizing elementary crystalizations of thought than any military leader of modern times. Sherman once gave utterance to the great truth, showing at once statesmanship and military sagacity. "The Confederacy is a shell," and he had the felicity of practically demonstrating his own theorem by the "March to the Sea." Sheridan's character and his style of fighting are best expressed by silent them whirling up the valley. Pope's unfortunate orders from "Head quarters in the saddle" gave General Leo opportunity for the solitary joke of his life-time. "What can you expect of a General who puts his headquarters where his hind quarters ought to be?" Cutler, more incisive with the pen, with the sword, cut through one of the knottiest problems, of the war with the name "Contraband." Water Rights For the benefit of our readers we publish the full text of the law concerning water rights, as laid down in the New Code. The law becomes effective May 1st: Sec. 1410. The right to the use of running water flowing in a river or stream or down a canyon or ravine may be acquired by appropriation. Sec. 1411.
