The Right of Trial by Jury.
No stronger bulwark of human liberty has ever been erected than that which secures to every citizen the right of trial by a jury of his peers. Guarding him alike from the power of a despotic master, or the dangerous caprice of a corrupt judge, it leaves the fate of the accused in the hands of those who are most likely to judge him in the full measure of human charity—with those who, in the ordinary affairs of life, are similarly circumstanced, and who probably reflect that a slight-degree of accident or misfortune might reverse the relations existing between themselves and the prisoner at the bar. In another feature, it still more strongly recommends itself to the favor of the defendant in a criminal action; the jury must be unanimous in their verdict, or a conviction cannot be had. Twelve men must agree upon the guilt of the prisoner, instead of the one that would suffice, if the case were left to the decision of the bench. There are thus substantially twelve chances for acquittal to one for conviction. Any man in the jury may completely block the wheels of justice and thwart the honest endeavors of his companions, by simply declining to agree with them in a verdict. It matters not what may be the motives of the dissenter, good, bad or indifferent, he may honestly believe the prisoner innocent, or he may have received a bribe to acquit him—his

It matters not what may be the motives of the dissenter, good, bad or indifferent, he may honestly believe the prisoner innocent, or he may have received a bribe to acquit him—his reasons are within his own breast, and he is not required to divulge them. And what an opportunity of escaping the toils of justice is afforded the prisoner in the selection of a jury. If one single defective individual can be wormed in among the number who compose that august Twelve, the efforts of the prosecution will be completely battled. Again, a jury will very often bring in a verdict of acquittal, when they know the defendant to be guilty; but when, from some friendly or local feeling, some false sense of honor of chivalry or gallantry, they do not wish to see him punished in that particular instance. Now these feelings are commendable in themselves, but they should not be allowed to supersede the sense of duty that ought to be paramount to every other consideration. Under our present constitutional rights, the laws of the land cannot be enforced, unless jurors will convict upon sufficient evidence of the guilt of the accused. He who fails to convict, when he believes the prisoner guilty, is a public enemy, for he nullifies the laws of his country, renders useless the efforts of public officers, and induces a reign of lawless violence, of vigilance committees and lynch law hanging, to restore the equilibrium of outraged justice. It is an ancient, a time honored right, that comes down to us with the dust of many centuries gathered upon its wings; hallowed by many a blessed memory of the past; endearred by recollections of the gallant deeds of countless generations, to perpetuate it to themselves and their posterity forever. Rough Sea. — Last Monday old "Neptune" succeeded in kicking up a pretty big muss in the Pacific; at least we should judge so, as several of our friends inform us that they vomited all they had eaten since last Christmas Supper was started three times on the Taber, before the gastronomic feat could be accomplished.
