General O'Ryan then resumed his trial examination of Pobes.
"Did you have an altercation with Mortimer on Labor Day, 1924?" O'Ryan asked.
"I don't recall," Forbes replied.
"Did you have any altercation about that time?"
"Yes sir, I had a few words with him."
"Was this about Mrs. Mortimer?"
"It may have been."
"Don't it a fact that Mortimer came into his apartment at the Wartman Park hotel and found you there with Mrs. Mortimer?"
"Yes, and the doors were wide open."
"How long were you there?"
"About two minutes."
"Was this altercation during the time when you suspected Mortimer of representing the Southernland Construction Co?"
"It was during the period I suspected him of bootlegging activities," replied Forbes, as the crowd of spectators smashed.
Forbes said he had employed George D. Tullidge, a brother-in-law of Mortimer, at $3,500 a year, as a mechanical engineer.
"You knew he was only 21 years of age and had been driving a truck for Williams," General O'Ryan said.
(Williams is a Philadelphia milk dealer.)
"I did not," Forbes replied.
"He was in charge of the mechanical equipment for Williams."
On his wedding trip, he went to the Pacific coast at the expense of the government, O'Ryan continued.
"He went to the coast after he left the bureau."
"Do you swear you did not appoint him to please Mrs. Mortimer?" asked General O'Ryan.
"I swear."
"You sent men around the country and abroad at the expense of the government," said O'Ryan.

lief he never told me that," replied Forbes.
The inquiry took a dramatic turn when O'Ryan suddenly went into Forbes private life and questioned him about the divorce recently granted his wife in Seattle.
O'Ryan tried to show that Forbes had changed his name on the divorce papers to avoid publicity.
"Do you recall that an action was started against you on Oct. 6, 1922?" asked General O'Ryan.
“What action?” Forbes asked.
"A divorce action!"
"I object. That is not material," Forbes counsel interposed.
"I'll make it material," O'Ryan replied.
"How?" asked Chairman Raed.
"I prefer not to disclose it to the witness," O'Ryan answered.
The committee held a brief executive session with the two attorneys.

(L. N. S. Staff Correspondent)
LONDON, Nov. 15.—Prost Stanley Baldwin defended home and foreign policies speech in the house of commissary this afternoon.
It is indeed difficult to maintain indefinitely attempts work together when the make it so hard, but it would bring peace by making fresh militia," said the premier.
The concerted political against Premier began today in and outside the house.
Ramsay MacDonald, lab and leader of the opposition, speech supporting the motion censuring Baldwin's failure to have unemployment. MacDonalg that Russia be a beneficiary under the proposed export scheme.
Former premier H. H. Asqd in his opening campaign speech attached Premier Baldwin's eign policy.
LONDON, Nov. 15.—The Irish political campaign opens day with debate in commons the motion censuring the government.
It was introduced Tuesday Ramsay MacDonald, laborite leader of the opposition.
The motion gave the leader all parties an opportunity to their views upon the Ball cabinet's policies.
Dissensions are reported Tory ranks.
Lord Derby, secretary of for war, and a number of easihire conservatives, have out against Premier Baldwin's policy of protective tariff.
It was reported the labor in order to gain recruits from opposing political forces, have cided to drop from their form the plank demanding an on capital.
It is evident the labor will be caught at a disadvantage because of a lack of funds.
On his wedding trip, he to the Pacific coast at the expense of the government, O'Ryan continued.
"He went to the coast after he left the bureau."
"Do you swear you did not appoint him to please Mrs. Mortimer?" asked General O'Ryan.
"I swear."
"You sent men around the country and abroad at the expense of the government," said O'Ryan.
"All who went abroad were on a mission approved by the president." Forbes declared.
"You tried to get such a mission, but could not," said O'Ryan.
"The president did not want me to leave," was Forbes's reply.
"But you did go; did you pay your own expenses?"
"I did," said Forbes.
General O'Ryan went into the appointment of Matthew O'Brien, San Francisco, as architect for the Livermore (Calif.) hospital.
"I was instructed to appoint a court architect with endorsement from his senators," said Forbes.
'O'Brien must the requirements Under by instructions, a republican had to be appointed."
"It was more important that he had to be a good republican than a good architect."
"He had to be a republican and an architect." Forbes said, emphasizing "and."
The influences of politics on governmental appointments was revealed when O'Ryan rend a memorandum of veterans bureau experts opposing O'Brien's appointment.
"You took no action on that appointment," said O'Ryan.
"No sir, I couldn't very well."
"Why not?"
"He was appointed by direction."
"You mean he had to be a Republican and you had the choice of which Republician he would be?"
"Not exactly."
"You mean President Harding personally recommended M. J. O'Brien?" asked Chairman Reed.
"No, any. The president said I should appoint a Republican acceptable to the California senators. I picked O'Brien. He was Senator Johnson's man, and the whole California delegation recommended him."
"Don't put that in the records," Senator Reed observed. "I guess that is the way the government has trained its employees since the days of Andrew Jackson."
"Do you believe that you were justified in appointing Mr. O'Brien?" O'Ryan asked.
"I do, in view of my direction," Forbes said.
Forbes was then questioned
"How?" asked Chairman Reed.
"I prefer not to disclose it to the witness." O'Ryan answered.
The committee held a brief executive session with the two attorneys.
>The committee is of the opinion that M. council can produce any evidence showing moral turpitude in behavior of this witness toward any government authority, judicial or executive, at any time since his appointment to the veterans' bureau, we are entitled to hear," said Chairman Reed in announcing the committee's decision.
"You were defendant in that action?" O'Ryan then continued.
"Do you know why you were designated as Charles Forbes instead of Charles R. Forbes?"
"Yes."
"Why, was that done at your suggestion?"
"The truth is I inserted the 'R' in my name and my name really in Charles Forbes."
"Was it for the purpose of avoiding publicity?"
"I don't recall that." Forbes answered.
"Was that suit filed because of an understanding between you and the plaintiff?"
"We talked it over a good many times."
"Was there any understanding between you?"
There was an understanding about what I would have to pay her.
"Do you know Charles M. McCarthy?"
"No Mr."
"On a man named Loren A Thurston?"
"Yes, I know him."
At this point O'Ryan suddenly dropped the clvforce subject and directed the cross examination into compensation.
A little later and just before the morning adjournment, O'Ryan touched again on Forbes personal affairs.
"Why did you find Mortimer's companionship so welcome to you?"
"He seemed all right socially." When you met him you had already met Mrs. Mortimer?
"Yes, sir."
When you were motoring or calling on Mortimer, Mrs. Mortimer was with you!
"Yes, with us." Forbes said, shouting the word us.
On your trip with the Mortimers to Atlantic City did two actresses join your party?
That's right."
Who paid the expenses of this party?
"I know I paid my own."
Acess was then taken.
I picked O'Brien. He was Senator Johnson's man, and the whole California delegation recommended him."
"Don't put that in the records," Senator Reed observed. "I guess that is the way the government has hained its employees since the days of Andrew Jackson."
"Do you believe that you were justified in appointing Mr. O'Brien?" O'Ryan asked.
"I do, in view of my direction," Forbes said.
Forbes was then questioned about the "pink slips" attached to compensation claims which were given special consideration because of political pressure.
"That is always the practice," Forbes replied. "The practice is still done, but they use white slips."
O'Ryan read a statement by A.E. Graupner, an American Legion officer of San Francisco, in which Graupner said he had heard reports that $25,000 of the purchase price for the Livermore hospitalate was to be split between Colonel Charles R. Pobes and Charles T. Cramer.
Graupner, in his statement added, passed the report on to Forbes.
