PATHETIC APPEAL TO HELP BROTHER The figures of hopeless desolation and brotherly love and self sacrifice were personified in the dramatic setting of a courtroom, as Jacob H. Stern stood before the bar, laid bare a domestic tragedy and tried to lift to his own frail, bent shoulders the blame for an offense charged against his brother. It was among the most sensational, at the same time pathetic,enes witnessed in the local courts. "I have but a short time to live," said Stern. "As a physician, I know that My wife, for whom I slaved and spent every cent that I could get, has left me. My life is worthless to me." "My brother is innocent of the offense charged against us. He has a wife who needs him and he needs her. I have nothing, now. A cancer is eating my heart and lungs. At most, there is but a brief time left for me to live. I wish to exonerate my brother and take the punishment." Superior Judge Z. B. West sentenced the confessed embezzler of a $5,000 Premier car to serve a term of from one to ten years in San Quentin. The man's effort in his brother's behalf was futile so far as immediate results were concerned. S. M. Stern, the brother, who pleads not guilty to the charge, must stand trial, Jan. 2. The specific charge is embezzlement of the Premier car, which belongs to the First National bank, of Santa Ana, and of which the Stern brothers were in charge while conducting its raffle here for the American Legion. As he confessed his guilt and pictured himself as a physical wreck, deserted by the woman he loved, Jacob Stern also made the startling assertion that he had not embezzled funds received as proceeds for the ruffle. “If there is $1,500 missing, as is said, it is in the hands of American Legion members who were selling raffle tickets and who have evidently not turned the money in,” he declared. A number of Legion men were selling the tickets and there was no check kept upon them. I did not take money, nor did my brother.” Steer described the journey in the Press car from Santa Ana to Salt Lake City. BEQUEATHS ESTATE VALUED AT $48,550 Property in Santa Ana to the value of $30,000, together with land in Riverside and Los Angeles counties, constitutes the $48,550 estate left by Frances J. Rogers, who died November 27, according to a petition for probate of his will on file today in superior court in behalf of the widow; Isabella Rogers, 1010 North Ross-st., Santa Ana. He medied at first that he had alone changed to take charge of the raffle, and that his brother came to his aid, when his health failed. The brother left a position in Los Angeles, Stern said, and merely assisted with the raffle in the same status as the others who sold tickets, on commission. During the course of the raffle, it became necessary to raise a sum to "clear" the car, Stern said. He claimed that he had secured permission from the American Legion and the bank to take the car from Santa Ana to Los Angeles, where he expected to raise the necessary funds. Falling there he and his brother with their wives, went on to Reno where he had a friend, from whom he that he could get aid. There also, he met failure, so having three weeks more time in which to raise the money, they drove on to Salt Lake City, including to return to Santa Ana before the time expired. Then, said Stern, they received a message that the wife's father had died. Funds were needed immediately and urgently. The wife insisted that something be done. Stern worshiped her and had always, he said, slaved to provide her with money, which she spent easily. In a desperate effort to appease her he tried to sell the car. The arrest interrupted one of these attempts in Salt Lake City. Worshiped that girl." Jacob Stern said. "I gave her all my money and slaved for more. Now she has left me. I have nothing to live for.
