C. T. U. to secure the drafting of a new county ordinance by Dist. Atty. A. P. Nelson received a setback when the committee interviewed the district attorney. They were informed that a measure such as they advocated, prohibiting the transportation of intoxicating liquor thru the county, was already in force, but had not been enforced since the Volstead law went into effect because federal laws superseded state laws and county ordinances. The enforcement of the law in the county is a question of jurisdiction, in the opinion of the district attorney, as all liquor and bootlegging cases are tried by the federal courts. The constitutionality of the Fresno and similar ordinances passed in various places has been questioned and Nelson is awaiting a decision in at least one case before he will take any action. On account of the great number of cases on the federal docket in Los Angeles, where there are only two courts, federal action is very slow. Attorney Nelson intends acting upon some county case at his own expense in the event that Fresno or some other county does not do so in the very near future, in order to test the county's jurisdiction.
