ANAHEIM GAZETTE ANAHEIM, CALIFORNIA Thursday, April 5, 1962 LEGAL NOTICES (Publish: Anaheim Gazette March 29 and April 5, 1962) NOTICE TO CONTRACTORS Santa Ana, California Date: March 20, 1962 In pursuance of a resolution of the Board of Supervisors of the Orange County Flood Control District adopted March 20, 1962, directing this notice, NOTICE IS HEREBY GIVEN that the said Board will receive in Room 218 in the Court House at Santa Ana or before the hour of 10:00 A.M. of April 25, 1962 sealed bids or proposals for the construction of Fullerton Creek Channel, from Highland Avenue to Harbor Boulevard, including removal of an existing warehouse building at Harbor Boulevard (BID SCHEDULE A), and for the construction of Fullerton Creek Channel, from Highland Avenue to Harbor Boulevard including removal and reconstruction of an existing warehouse building at Harbor Boulevard (BID SCHEDULE B), all in the City of Fullerton, Orange County, California. Bids must be made on the form provided for the purpose, addressed to the Board of Supervisors, Orange County Flood Control District, marked "Bid for Construction of Fullerton Creek Channel." Bids will be received for BID SCHEDULE A (Bid Items 1 through 41) and for BID SCHEDULE B (Bid Items 1 through 42). In order to assume consideration of a bid, Contractor shall submit a proposal for both alterate Bid Schedules. The award of a contract will be made in the best interests of the District. The foregoing quantities are approximate only, being given as a basis for the comparison of bids, and the Orange County Flood Control District does not, expressly or by implication, agree that the actual amount of work will correspond therewith, but reserves the right to increase or decrease the amount of any class or portion of the work, as may be deemed necessary or expedient by the said District. Notice is hereby given bidder that in accordance with the provisions of Section 1770 of the Labor Code, the Board of Supervisors of the Orange County Flood Control District has ascertained the prevailing rate of per diem wages for each craft or type of workman needed to execute the contract which will be awarded the successful bidders to take possession. Provided that not less than one and one-half times the prevailing rate shall be paid for any working time in excess of eight (8) hours in a calendar day and for Saturdays, Sundays and seven legal holidays; travel New Years Day, Memorial Day, Fourth of July, Labor Day, Veterans Day, Thanksgiving Day and Christmas. For less than eight (8) hours per day, the per diem rate shall be that fraction of the foregoing per diem rates that the number of hours worked bear to eight hours. Provided that notwithstanding the general provisions contained herein, Flagmen, Guards, and Watchmen shall be paid not less than one and one-half times the prevailing rate for overtime (overtime shall be time worked in excess of eight hours per day or forty hours per week), and the straight prevailing rate for time worked on Saturday, Sunday, and holidays where such time does not constitute overtime. Bidders' attention is called to the above mentioned Statute which will require them, if awarded the contract, to pay not less than said general per diem rate of wages set forth in said resolution hereinafter mentioned, to all laborers, workmen and mechanics employed in the execution of the proposed contract. The bidding must submit with his proposal a satisfactory check certified by a responsible bank or a bidder's bond and payable to the order of the Orange County Flood Control District for an amount not less than ten (10) percent of a guarantee that the bidding will end the same is awarded to him, and such contract said check will be completed. The amount of the bond to be performance of the contract for sale of the contract price thereof, and equal to fifty (50) percent of the which bond shall provide that if faulty payer or materials provoke upon or about the performer done, or for any work or labor they due under the Unemployment Institution work or labor, that the surety or seller also in case suit is brought upon a fee to be fixed by the court. The contractor will also be made aware that he carries compensation in upon work to be done under the into between him and the said District work.
