WHEN IS A PRICE FIX?
Recent governmental prosecutions for price fixing
in industry have spotlighted the incongruous situation
in which government finds itself busily doing the very
things it says are naughty for businessmen to do.
Attorney General Stanley Mosk demonstrated this
dilemma the other day when he pointed to the fact that
"while our office's anti-trust division is suing the Caliberia Real Estate Association and many local real
estate boards for price-fixing, for fixing brokers' fees,
the Assembly has just passed a bill which would allow
the California real estate boards to fix commissions to
be charged by real estate brokers. Thus we have government passing laws to allow price-fixing at the same
time it is prosecuting price-fixing."
Thus also do we have the federal government fixing prices with one hand and slapping down price fixers
with the other. It is a confusing situation that government tries to explain away by blaming business for
seeking protection. But it can't be explained away that
easily. Business does not make the laws.
Letting not the right hand know what the left hand
doeth is a splendid precent "when thou doest alms".
There is considerably less to be said for it in the running of government.

During the 4th of July Release, the Chairman of the Ways
Means Committee asked
if I would go to Geneva
Zurich, to observe some
negotiations on the GenAgreements on Tariff and
e, which fall within the
new of our Committee's
diction, in that the RecipiTrade Agreements are
authorized in the Ways
Means Committee.
The Reciprocal Trade Agrees Act expires next year,
there is a feeling in Contact that this Agreement will
be renewed unless certain
amendments are made to it providing for the protection of some of our industries.
We have always had a "Peril Point" and an "Escape Clause", but these are not operational unless the Tariff Commission makes a finding of injury to an American industry, and then the recommendation of the Tariff Commission goes to the Executive Department which has to implement the findings of the Commission. Over the past 10 years, the Executive Department has not followed the recommendations of the Tariff Commission and many Congressmen feel that industrities in their District have been injured far beyond the "Peril Point", and unless some guaranty can be made that reasonable consideration will be given to these industries, Congress will not renee with Reciprocal Trade Agreements Act.
Negotiations are going on in Geneva at the present time among 30 members of GATT, and the State Department will present to our Committee a draft of the legislation which they wish to have enacted next year.
We were also requested to check up on the operation of the EEC, the European Economic Community, generally referred to as the European Common Market. The European Common Market consists of France, Belgium, Italy, West Germany, The Netherlands, and Luxembourg.
In order to compete with Common Market, there formed what is called the Seven which goes by name of FTA and stands Free Trade Association. Members of this Association are United Kingdom, Norway Sweden, Denmark, Poland Spain, and Switzerland. Ever, this organization is ing a hard time uniting nomically and politically.

The treaty or agreement for this Common Market was formulated in Rome and is generally referred to as the Rome Treaty. The surrounding countries scouted at the idea and said that this could never be successfully accomplished, but now after the passing of a few years it has demonstrated its ability to function well, and the economic growth of these six countries is far out-distancing the economic growth of the surrounding Western powers.
In order to compete with this Common Market, there was formed what is called the Outer Seven which goes by the name of FTA and stands for Free Trade Association. Members of this association are the United Kingdom, Norway, Sweden, Denmark, Portugal, Spain, and Switzerland. However, this organization has a hard time uniting economically and politically and the largest of these Nations. Great Britain is anxious to join the European Common Market end of course. If they do, Denmark, Norway and Sweden will also have to go into the Common Market.
The big question is whether or not the Common Market countries will accept them as members. General DeGaulle and President Kohlrad Adenauer insist that if Great Britain comes into the Common Market, it will have to come in under the terms of the Rome Treaty without any exception. They have told Great Britain that, if it becomes a member of the Common Market, it will have to cease its trade with Russia and Red China and other Russian satellite countries. DeGaulle and Adenauer are the real powers in Western Europe and can name the price of admission for any country to come into the European Common Markets Prime Minister Macmillan is completely over-shadowed by those other two great personalities and he will either have to take their program or leave it. The latter he cannot afford to do.
